A RESOLUTION OF THE CITY OF BOYNTON BEACH,
FLORIDA, APPROVING AN ADDENDUM TO THE
INTERLOCAL AGREEMENT WITH THE TOWN OF
LANTANA, PROVIDING FOR WATER MAIN
INTERCONNECTION FOR AN ADDITIONAL FIVE (5)
YEARS; AUTHORIZING THE CITY MANAGER AND
CITY CLERK TO SIGN THE ADDENDUM; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, on January 3, 2012, the City Commission approved an Interlocal
Agreement between the Town of Lantana and the City of Boynton Beach for a Water Main
Interconnection; and
WHEREAS, the Interlocal Agreement provides for five (5) year extensions in writing
to continue the Interlocal Agreement; and
WHEREAS, staff recommends continuing the Agreement which will provide both
parties with a valuable back-up supply of potable water in the event of an emergency.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. Each Whereas clause set forth above is true and correct and
incorporated herein by this reference.
Section 2. The City Commission does hereby approve and authorize the City
Manager and City Clerk to sign an Addendum to Interlocal Agreement with the Town of
Lantana to provide for an additional five (5) years of water main interconnection, a copy of
which Addendum is attached hereto as Exhibit "A".
Section 3. That this Resolution shall become effective immediately upon passage.

ADDENDUM NO. 1 TO INTERLOCAL AGREEMENT
BETWEEN THE CITY OF BOYNTON BEACH AND
THE TOWN OF LANTANA FOR WATER MAIN CONNECTION
This Addendum shall take effect on signature by both parties.
THE CITY OF BOYNTON BEACH, FLORIDA, a Florida municipal corporation,
hereinafter referred to as "CITY",
and
THE TOWN OF LANTANA, FLORIDA, a Florida municipal corporation,
hereinafter referred to as "Town"
WITNESSETH:
The Interlocal Agreement between the City of Boynton Beach and Town of Lantana for
Water Main Interconnection entered into January 24, 2012 is amended as follows:
In consideration of the mutual terms and conditions, promises, covenants and
payments hereinafter set forth, City and Town agree as follows:
A. Pursuant to SECTION 6 TERM: RENEWAL. The Interlocal Agreement may be
renewed for additional five (5) year periods upon the mutual, written consent of the
parties, which consent must be reached by the parties prior to the expiration of the term or
any extended term. The initial Agreement was for a term of five (5) years to expire on
January 23, 2017. The parties wish to extend the term of the Agreement from January 24,
2017 through January 23, 2022.
B. SECTION 10: NOTICE. Any and all notices required or permitted to be given
hereunder shall be deemed received three (3) days after same are deposited in U.S. Mail
sent via certified mail, return receipt requested.
