3 A RESOLUTION OF THE CITY OF BOYNTON
4 BEACH, FLORIDA, AUTHORIZING THE MAYOR
5 TO SIGN A SUBORDINATION OF UTILITY
6 EASEMENT INTERESTS FOR PARCELS 101-5 AND
7 102-5R FOR THE FLORIDA DEPARTMENT OF
8 TRANSPORTATION (FDOT) SIGNALIZATION
9 PROJECT AT WINCHESTER PARK BOULEVARD
10 AND BOYNTON BEACH BOULEVARD; AND
11 PROVIDING AN EFFECTIVE DATE.

13 WHEREAS, FDOT is installing a new traffic and pedestrian signalization poles at
14 the intersection of Winchester Park Boulevard and Boynton Beach Boulevard; and
15 WHEREAS, as part of FDOT's customary procedures, it is requesting that the
16 City subordinate the utility easement interests to FDOT; and
17 WHEREAS, the City will retain the easements; however, the easements will be
18 considered to be in the FDOT right-of-way and a utility permit will be required if the City
19 needs to perform future work within the easements; and
20 WHEREAS, once the subordination is executed, FDOT will reimburse the City
21 for any relocation of the utilities or other impacts that may arise due to FDOT's roadwork
22 in the future.
23 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
24 OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
25 Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed
26 as being true and correct and are hereby made a specific part of this Resolution upon
27 adoption hereof.
28 Section 2. The City Commission of the City of Boynton Beach, Florida does
29 hereby approve and authorize the Mayor to sign a Subordination of Easement Interests for

30 Parcels 101-5 and 102-5R for the Florida Department of Transportation signalization
31 project at Winchester Park Boulevard and Boynton Beach Boulevard, a copy of the
32 Subordination is attached hereto as Exhibit"A".
33 Section 3. This Resolution will become effective immediately upon passage.
