3 A RESOLUTION OF THE CITY OF BOYNTON BEACH,
4 FLORIDA, GRANTING A UTILITY EASEMENT TO FLORIDA
5 POWER & LIGHT TO ENABLE INSTALLATION OF AN
6 UPGRADED POWER FEED TO THE EAST WATER
7 TREATMENT PLANT; AUTHORIZING THE MAYOR TO SIGN
8 THE UTILITY EASEMENT; AND PROVIDING AN EFFECTIVE
9 DATE.

11 WHEREAS, the existing power supply from FPL to the East Water Treatment
12 Plant has insufficient capacity to meet the needs of the plant following the upgrades
13 currently taking place; and
14 WHEREAS, the easement will allow the installation of a new larger transformer
15 while maintaining operations at the plant; and
16 WHEREAS, the easement will run from the power pole on Woolbright Road to a
17 new transformer at the north end of the East Water Treatment Plant site through the city
18 park by the Utility Administration Building.
19 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
20 OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
21 Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed
22 as being true and correct and are hereby made a specific part of this Resolution upon adoption
23 hereof.
24 Section 2. The City Commission of the City of Boynton Beach, Florida does
25 hereby approve the granting of a Utility Easement from the City of Boynton Beach to the
26 Florida Power & Light to enable the installation of an upgraded power feed to the East Water
27 Treatment Plant and authorizes the Mayor to sign the Utility Easement, a copy of which is
28 attached hereto as Exhibit"A".

29 Section 3. This Resolution will become effective immediately upon passage.
