3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH,FLORIDA,
4 AMENDING ORDINANCE 89-38 BY AMENDING THE FUTURE
5 LAND USE ELEMENT OF THE COMPREHENSIVE PLAN FOR A
6 9.78 +/- ACRES OF PROPERTY LOCATED GENERALLY
7 SOUTHEAST OF THE INTERSECTION OF WOOLBRIGHT ROAD
8 AND FEDERAL HIGHWAY AS MORE SPECIFICALLY
9 DESCRIBED HEREIN TO CHANGE THE LAND USE
10 DESIGNATION FROM LOCAL RETAIL COMMERCIAL(LRC)TO
11 MIXED USE CORE (MX-C); PROVIDING FOR CONFLICTS,
12 SEVERABILITY,AND AN EFFECTIVE DATE.

14 WHEREAS,the City Commission of the City of Boynton Beach,Florida adopted a
15 Comprehensive Future Land Use Plan inclusive of a Future Land Use Element pursuant to
16 Ordinance No. 89-38 and in accordance with the Local Government Comprehensive Planning
• 17 Act; and
18 WHEREAS, Isram Riverside, LLC has made application to reclassify a parcel of
19 land, said land being more particularly described in Exhibit "A" from Local Retail
20 Commercial (LRC) to Mixed Use Core (MX-C); and
2 WHEREAS, the procedure for amendment of a Future Land Use Element of a
22 Comprehensive Plan as set forth in Chapter 163, Florida Statutes, has been followed; and
23 WHEREAS, after two (2) public hearings the City Commission acting in its dual
24. capacity as Local Planning Agency and City Commission finds that the amendment
2 hereinafter set forth is consistent with the City's adopted Comprehensive Plan and finds it in
2 the best public interest to amend the Future Land Use Element (designation) of the
2 Comprehensive Plan as hereinafter provided.

36 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
3 CITY OF BOYNTON BEACH, FLORIDA, THAT:
3 - Section 1: The foregoing WHEREAS clauses are true and correct and incorporated
3 herein by this reference.
3 4. Section 2: Ordinance No. 89-38 of the City is hereby amended to reflect the
3 " following:
3 : That the Future Land Use of the land described and depicted in Exhibit "A" is
3 amended from Local Retail Commercial (LRC) to: MIXED USE CORE (MX-C)
3 Section 3: This Ordinance shall take effect on adoption,subject to the review,challenge,
3 • or appeal provisions provided by the Florida Local Government Comprehensive Planning and
4 . Land Development Regulation Act. No party shall be vested of any right by virtue of the
4 adoption of this Ordinance until all statutory required review is complete and all legal challenges,
4 - including appeals,are exhausted. In the event that the effective date is established by state law or
4 special act, the provisions of state act shall control.
