17-002 1 2 ORDINANCE NO. 17-002 3 AN ORDINANCE OF THE CITY OF BOYNTON 4 BEACH, FLORIDA, AMENDING ORDINANCE 02- 5 013 TO REZONE A 9.78 +/- PARCEL OF LAND 6 DESCRIBED HEREIN AND LOCATED 7 GENERALLY AT THE SOUTHEAST 8 INTERSECTION OF FEDERAL HIGHWAY AND 9 WOOLBRIGHT ROAD AND COMMONLY 10 REFERED TO AS RIVERWALK PLAZA FROM 11 COMMUNITY COMMERCIAL (C-3) TO MIXED 12 USE 4 (MU-4); PROVIDING FOR CONFLICTS, 13 SEVERABILITY, AND AN EFFECTIVE DATE. 14 15 WHEREAS, the City Commission of the City of Boynton Beach, Florida adopted 16 Ordinance No. 02-013 establishing an Official Zoning Map of the City; and 17 WHEREAS, Isram Riverside, LLC. has made application to rezone a parcel of land, 18 said land being more particularly described in Exhibit "A" from Community Commercial 19 (C-3) to Mixed Use 4 (MU-4); and 20 WHEREAS, the City Commission, following public notice, conducted public 2 hearings as required by law, heard testimony and received evidence which supports rezoning 2 . for the property hereinafter described; and 2 WHEREAS, the City Commission finds that the proposed rezoning is consistent with 2A. an amendment to the Land Use which was contemporaneously considered and approved by 2 the City Commission; and 2: WHEREAS, the City Commission deems it in the best interests of the public to 2 amend the City's Revised Zoning Map as hereinafter set forth. 2: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF 2• THE CITY OF BOYNTON BEACH, FLORIDA, THAT: 3 s Section 1. The foregoing Whereas clauses are true and correct and incorporated (00164609.2 306-9001821) 31 herein by this reference. 32 Section 2. The land described and depicted in Exhibit "A" is hereby rezoned 33 from Community Commercial (C-3) to Mixed Use 4 (MU-4). 34 Section 3. The City's Revised Zoning Map of the City shall be amended accordingly. 35 Section 4. All ordinances or parts of ordinances in conflict herewith are hereby 36 repealed. 37 Section 5. Should any section or provision of this Ordinance or any portion thereof 38 be declared by a court of competent jurisdiction to be invalid, such decision shall not affect 39 the remainder of this Ordinance. 40 Section 6.
