Mayor McCoy called the meeting to order at 7:30 P.M.
The invocation vms given by Rev. Louie B. Black~ell, First Methodist
Church, and the flag salute ~ms led by Vice ~ayor FL~chael V. Mich~et.
Mayor McCoy issued a statement that they had the Department Heads of
the City of Boyuton Beach on hmud, in case it should be necessary to
call on them to ansv~r any questions tonight.
Mr. M~ichael moved for approval of minutes of Regular Meeting dated
January 3, 1967, seconded by F~r. Collins and it was unanimously carried.
Mr. ~Lichael moved for approval of minutes of Special Meeting dated
January 9, 1967, seconded by PLr. Summers and it was unanimously
carried.

~Lr. Carnahan stated he believed there is reason for this Council to
make clarification of the motion presented by~Z~r. Banks at the meeting
of December 19, 1966~
The minutes read as follows:
"...that Council proceed and negotiate further with Mr. Lym~n
regarding this matter." He further stated he believed it was the
intention of the Council to authorize acceptance of the terms stated
in a letter from Mr. Tomberg to Mr. Moore for the securing of the
Lyman property. Therefore, it would be in order that this Council
move to accept these terms and authorize the payment of $3~150.00.
Mr. MicB~el inquired as to the recommendation of the city attorney on
this matter and Mr. Fruda said he would like to confer ~ith ~. Tomberg,
attorney for [Lr. Lyman, and obtain a title commitment and search the
title first to see what they are buying. ~[r. Fruda further stated
that he had nothing indicating the status of this piece of property.

salary was discussed. It ~as suggested that Council indicate the salary
adjustment by motion, retroactive to the time Mr. Eaiu left.
Mr. S~w~mars made a motion that a salary adjustment of $165.00 m~nthly
be add,~ed to his present salary ~.s City Ez~ueer, and that vacation t~me
due ~m,.. from 1966 as City Eng~eer be pOstpOned until such time as

a conditional use. Mr. Carnahan related he bad discussed this with
Mr. Fruda and he recommended that Council clarify the stipulations for

Mr. Summers moved that 1'.~. Clapper's request for rezoning be tabled
until the nexb meeting so that a proper ordLuance can be prepared,
and let the records show that Ordinance 67-~ was read in error and
should be stricken from the records. ~r. Michael seconded and it was
unanimously carried.

Mayor McCoy and Mr. Callaway, attorr~ey for ~'ir~ Clapper, engaged in
a discussion regarding the time ~. Callaway was to have been notified
to appear to further discuss zoning change on this parcel.
Mayor ~J~Coy related he knew council h~d promised to let him know when
they were going to consider it further, but that he would have to
check the minutes regardiug the Planning and Zoning Board meeting, etc.
fter checkzng these manures, Mayor MoCoy stated the PlannJ_ng and
Zoning Board at their last meeting dated January 5, 1967 had voted to
deny this request ~-O.
Mr. Summers stated they v~re sitting in the ~udience when this was
brought up and said he ~uld like at this time to have ~Lr. Clapper's
attorney~ Mr. Callaway~ explain the entire thir~ to refresh their
m~mories on this m~ttar. Mr. Callav~y, with the. aid of an aerial
~ap, came fo~rd and explained ~ir. Clapper's request again ir. full
detail.
~. Summers asked ~ether C-1 zoning would permit a trailer park and
Mr. Carnahan said it would not. ~[r. Callav~y stated that no place in
the present code does it specifically permit a trailer park.
~. Callav~y~ Mr. Summers and }:ir. Fruda then engaged in a discussion
regarding the exact location of this t~ailer park, facilities for ~ter
and sewage~ etc, and Mr. Summers said he did not see under the C-l,
Section 31, that they would be setting a precedent if they ~uld
permit tha$ s~s the only ~,my this could be done would be under C-2.
}~Lr. Fruda stated the city he~d specifically zoned that for Dr, Nelson,
the former owner of this land, as a trailer park and they put a
limitation on it up to that street. Later on they hind a master plan
come into effect s~nd they seemed to have wiped out the trailer park
and they zoned this something else. He stated further, he is now
operating on a non-confo~ use of the trailer park, and now he ~nts
to go back and eked on the non-conforming use.
Mr. Dirck Grootenboer, 210& N.E. &th Court, car~ forward to speak in
opposition to the request again.
2,ir. James Culver~ Representative for the Four S~asuns, came forward to
speak in opposition to the request.
~yor McCoy mphasmzed that in the R-1 as it is now zoned, if ~.
residence %~re built there, there would be real estate tax on the
dwelling. If this is zoned for a trailer park, the ls~ud itself would
be taxed but not the individual trailers.
~,Sr. Summers made a motion to table this matter so that further study
can be done on this matter. He offered the follov~ing explanation for
his motion: He said if they ~ll stop to realize that 1-95 coming
through 17th ~venue, comes right through this trailer park.
The access to it comes through this trailer park and Dr. Nelson at
one t~e paid for the crossing gates, gave them a right-of-way thho~gh
it, and it ~.~s given back to him and the money refunded by the

and appropriate persons for tabulation and have them returned to

~,~. Summers related that it vas customary to have a councilman sit in
on this meeting, and that he would like to sit in with the committee
to study this bid. ~yor McCoy stated that this would be perfectly
mlright.
~ir. Michael said he wished to make a statement regarding de]4uquent
v~ter and se~,~r bills due the city; the prior council had instructed
the City ~nager's office to give the people 90 days from that date
t~o com~ ~lth connecting to the sewer ~hereby they would not be
charged vlO0.O0 cor~aection fee, etc. He said at the end of this period
they are going to give very serious consideration to anyone who is
delinquent on their tater and sewer bills, and at the end of this
period they ars going to take some action to coIlect this money.
At this time ~. Collins stated he would l~ke to have the salary and
travel allowance of the councilmen brought up to the same level as
the ma~or'% and made a motion to this effect. The motion, however,
died for lack of a second. ~. Michael stated had it been any other
time, he would have gone along with Mr. Collins, but that right now
there is no room for it in the budget.
Board of Equal~zatmon - Assessment Roll for Demolition of Structures
in Accordance ~,&th Resolution 65-DD
~Ir. Car~han e~olained regarding the assessment roll covering demolition
of cartain structures in accordance ~*lth Resolution 65-DD.
This roll is presented for equalization hearing and should be opened
to the floor to see whether there are any objectors present.
After the hearing, a motion for the acceptance of the assessment roll
Edll be made.
Mayor McCoy inquired if there ~s anyone who wished to speak in
opposition to this and no one c~me forward.

Light Company has contacted him relative to the installation of three
street lights ~o be located eas~ of U.S. ~l to the new bridge across
the Intracoastal ~tsrway. He £urther related that arrar~ements have
already been made for the installation of street lightiug on the new

br dge. ~The To~m of Oc.ean R~dge has made similar art..a~ements with
the Flormda Power and Light Co, any for whiteway lighting, k~en the
ne~ bridge is ooen~d to the oubli t ~ ~ ~s~t ~ ~ .... ~+ ~
area. For ~he cost involved, $28.00 per light per year~ he
r.ecommended that Counc~ authorize the Po~r Oompan~ to erect these
lights. Money approprdated in Activity #5900, Account #522.
}ir. Summers moved for the above recommendation, seccaded by ~r. IZaichael
and it was unanimously carried.

~. Carnahan e~plained they have prepared specifics, tions and material
requirements for the C~ty's annual material needs. Bids will be
received on February 6, for the following items:

Galvanized pipe and fittings and brass goods
Gasoliue and oil
Tires and batteries
k~ater meters
Chloriue for ~*ater and se~r plant
Road Rock materials

MayorMcCoy related that from their agenda review during the
conference tonight, it v~s decided to table these two matters for
further study. Mr. Summers suggested it might be advisable to explaiu
why their thinking ~s that way. MayorMcCoy related this w~s on the
annexation of a couple of parcels on the beach, and they thought they
might run into a little problem ~-~th the ~ording as it was not spelled
out iu great detail. He then asked ~.. t~uda, city attorney, to go
into further detail regarding this matter. ~ir. Fruda stated it read

he ~ob classification.for an electrical and mechanmcal maintenance
man, which covers his job~description, duties l resoonsibilitissA
necessary knowledge of sk~lls pertaining to this job. He stated in
line with this, he has also directed a memorandum to the Electri6al
Board asking t.hem to give him a recommendation ~s to what they felt
the quali~icat~ons and requirements of this particular job should
inc0rp. 0rate, or what they f~lt about ~his particular job description.
He said he would like to sUggest to this council that before any
further action is taken on it that they w~it until these r.~commend-
ations ~are forthc~, frgm this particular ~oard, and his discussion
without. G~mmons tod~y'w~s that they were ~g this under
consideration but they did not D~ve a~hing to offer him at this
time, but that they WO~ld Hav~ it fo~ him in the near fUture.
Mr. Summers stated he did not feel they should wait for this board's
recommendations because they ~h~e so m~ny problems ~ht now that
need attention, and he felt t~ey should go ahead and do Something.
~r. Summers moved t~y establish this job and set hi~ ~y from an
established job classifica~t~ion for electrical ~chanic~ maintenance
man, with the specifications Mr. Car~aahan has prepared.

Mr. Carnahan stated they do have this board set up and established

conflicting with some of their ordinances. Therefor% he would
welcome any sUggestions they ~might have to go ~ong with this and
to get their views, as he f~l~ ~urei they were more e~ipped to
answer these qUestinna than he wa~ and felt it ~as ~oe~s~ry to
consult expert~ in this ~e. ld~ to :~termine wha~ :claSsification this

Mr. ~chael stated he believed we have a wonderful set of boards,
and they should put them to werk on this. He further stated since
Mr. Carnahan, City Er~ineer and Ac~ng City ~nager~ suggested it
go back to them, he me,ed that they ask their boards by the next
meeting to have a recommendation £o? them So that they can act
as they do need some0~e in this p~sttion to ~o to wor~ r~ht awa~

and get some action as soon as possible. It was pointed out at this

Request transfer of Funds from Unsppropri~ted Surplus - Co--unity
P__ro__motion Fund.
~yor McCoy related they had bills in the amount of $228.69 which
were in excess of the amount they have in Activity No. 7000-19 and
he suggested someone entertain a motion to transfer $228.69 from the
Unappropriated Surplus of the Community Promotion Fund into
Activity No. 7000-19 to meet the bills.
Mr. S~mmers moved that this be carried o~h, seconded by Mr. Michael
and it was unanimously carried.

At this point, ~L~. Collins requested clarification of Petty Cash
payments m~de during this month and said he noticed 28 entries for
a total of 3800.00 and stated he would like to know roughly what
thi.s r~presented. ~e asked Mr. Carnahan for a report on this later
on zu the week and ~Lr. Carnahan a~greed to do this for
Mr. Sun~ers moved to receive the list of payments and make it a
part of the minutes. Mr. Nylund seconded and it was unandmously
carried.

He said he would like to have a report telling him howmanytax
dollars the city is going to arrive at. Mrs. Padgett said the
assessor applies the ratio to that building value for the t~xroll
~fter the buildirg is completed. This represents the monththe
permit is taken out based on the contractor's figure of the value
at that time. The assessment figure is arrived at in an entirely
different manner she said, ~nd that these fi~res give an idea of
the building permits issued.
~. ~!ichael made a motion that the departmental reports be received
and approved. Mr. Summers seconded and it ~s unanimously carried.
~. Summers stated the Departmental Reports are very thoroughand
complete, s~ud they are to be complimented on them.

OTHEP~
~rs~ Padgett stated a request came in today in the form of a letter
from the Cavalier Club requesting permission of City Council to bring
their annual festival back to the dity of Boynton Beach.
The purpose of this affair is to raise money for our yearly
scholarship award. They requested permission to hold the affair at
the same location ne~b to ~ilson Park from January 30 to February ~,
1967. After conferring wlth Chief of Police Thompson regarding
this ~atter, it ~e decided to grant this permission.
M~. Michael made a motion to grant this permission to the Cavalier
Club, seconded by ~. So~mers and it was unanimously carried.
