Kain, City Nan~ger The meeting was called to order by ~ayor l~adsen at 7:30 P.M. The invocation was given by Rev. Henry Jar~is, Southside Baptist Church, and the flag salute was led by Mrs. Anne Bartley, C o~uc il stenographer. Mayor ~L~dsen recognized ~ir. Cecil S. Farrar, the new Chamber of Commerce N~nager. [,ffNUTES Regular Meeting - December 5, 1966. On psge four of these minutes reference is made to Ordinance No. 66-27, regarding a conditional use in Lakeside Gardens. This should actually read Ordinance 66-28. Also, on page five, paragraph one, l~st sentence should read "The only alternative now is to proceed with abatement, and after that is done, place a lien agaiust the land". Mr. Boos moved that this change be made in the wording mud that the miuutes be approved. ~. Banks seconded and it was unanimously carried. Special Meeting - December 7, 1966. Mr. McCoy moved for approval of m~uutes of December 7, 1966, seconded by Mr. Banks and it was unanimously carried. Statement.,by Tax Aesesso,r Mr. Allan has submitted a letter dated December 9, 1966. He has specifically requested to h~ve this placed on the agenda and for it to be read at the public meeting. Mrs. Clanton read the above-mentioned letter from Mr. Allan in its entirety. -1- Mayor Madsen asked P~rs. Ella Bishop, Personnel Director, who was present at the meeting, if she could verify the fact that Mr~ A%lan was tested ~ Civ~ ~ice ~ f~d to be qu~ed to f~l the positions he occupies as T~ Assessor ~d ~c~ Agent. ~s. B~hop verified t~t ~. ~ took th~ ~itten test for ~3.rchas~ ~ent on October 18~ 1962~ ~d on D~c~er ~, l~ he took an or~2 and w~tten e~.~tion for the position of Tax &~sessor~ Lyma~ Pro~erty-__R/W N. E. 6th Stree~ ~{r. Moore has received a letter from Mr. Tomberg, who represents Mr. Lyman. This letter st~ip,,l~tes ~hree .requirements that Mr. Lymph has requested before deedling this right-of-way to the city. Copies of this letter were circulated to Council earlier. ~L~yor ~dsen, M~. Boos, F~. McCoy and Mr. Moore then engaged iu a discussion as to whether Mr~ L,ymsn's stipulated requirements were proper and ~ithin reason, and Mr. Moore assured them that they were. Mr. Banks .made a motion that council proceed and negotiate frm~ther with M~. Lyman regardLug this matter. Mr. Boos seconded m~d it was ~un~uimously carried. ~_rovement of Lots 53 and ~, Dewey's S~ A partial improvement can be made on this property for approximately $15,000. This would provide au estimated two feet of average fill cover on the tract in question. This would be belo'~ the elevation required by the code before the land can be utllized and would not provide for b~Jakheading. N~. Moore related there had previously been an estimate made of $~5,O00 to bring the area up to street level ~lth bulkheading, He suggested the o~mers be contacted to see if hhey are to proceed on a 1Lmited basis rather than the full abe~tement. Mr. Banks said ne thought there might be a slight cor~lict of their thinking here since this happened to another piece of property. He recommended they contact the o~ere to see if they would put in this fill. Then if they do not do it, we would have to go all the v~y and bring it up to the required grade. Mr. Banks made a motion that Mr. Moore be authorized to negotiate further with the owners of this property. Mr. McCoy seconded and it was ~uanimously carried. M~yor Madeenre-emphasized the city's need for a new fire station. He stated the people ~d voted in favor of this and that he had been advised legally that they may proceed with this matter, that is, they n~y borrow money for this purpose if they wish~ He stated the Police Department ~ichwas short on space could probably use part of the old ff~e station after completion of the new fire station, which would cost appro~=tely$75,000. -2- He said he realized it was not up to the present council reg~rdirg this, but he was ~i~.~o].y stating bis vie~ c~ the ~tter. Mr. Banks a_uuou_uced that 1~. ]fain had requested leave of absence from ~l.e counc~ meeting tonight: and t~h~t such leave was granted him by the cotmcil at the ti~e of the conference tonight. PUBLIC AUD XE~NCE Mr. ~Iard A~. Cummfimgs, 2610 S. ~Y. 8th Street, came forward and r~ad a letter addressed to City Council conmending M~. ~H1]iam McKecbnie, Plumbing Inspector, and Mr. Leon Gr,ummons~ Electrical Inspector, for their exceptional perfo.,~m~nce of duty. They requested that these man have their automobile allowance restored to its previous rate and possibly have their salaries raised, Mayor Madsen asked; ~tr, Bob carnahau ~,~o is in cbz~vge of t~.t dep~a.r%ment to see if he could ,help these gentlemen out regsmding this matter. Mr. Carnahan agreed to do this, BUSINESS ~[r, Banks related that Mr. Kain sti]l had a few days vacation and a few days sick leave due him, and since he felt it was the desire of the cotuucil bo give h~m a check for severance pay, he noved that ~[r. Kain be paid $500,00 severance pay. F~r. Boos seconded and it ~s unanimously carried. Ordinance 66-28 - 2nd readir~ - Request for Conditional Use~ Lots~125 12~-=127~ a__u_d. E30" of 128 smd 129, C~or~e Burgs ~lin Moore read the second readiug of Ordinance 66-28. ~Lr. Banks moved it be passed for second reading, seconded by Mr. McCoy and it was unanimously carried. Ordinance 66-29 - Repesling Ordinance 66-15 re Conditional Use of ~leck Property- 730 N. W. 2nd Avenue ~ As you v~lll reca]]: Mr. Fleck was to have begun construction of a building by November 15, or sho%~ cause why construction should not begin. AFter discussion at the last meetirg, it decided to repsal the ordiuance grar~iug conditional use of the property, In the event Mr. Fleck wishes to construct such a building~ it would be necessarV now for him to re-oetition the Council for this usage when the requirements can' be met. ~. Moore read the first reading of Ordinance 66-29 dated December 19, 1966 repealirg Ordinance 66-15. Mr. McCoy moved to accept Ordinance 66-29, seconded by Mr. Banks and it was unanimously carried. Authorization of an Agreement to Install Force Main Crossing of the F.E.C · tracks and to E~end the Force lgmin Along the Railroad Right-of-Way as part of the Construction of Sanitary Sewer ~.Ls~t. em 5B Authorization for the execution of this agreement should be done by the adoption of Resolution 66-~~. This agreen~nt calls for an annual payment for the first year of $40.00 and ~i!toO0 per year thereaf%er. Moore read Resolution 66-~,f~f, Mir. Banks moved for adoption of this resolution, ~tr. Boos seconded mud it was unanimously carried. Receipt of Letter from Mr, H. E. Thon~scm, in Reference to s~__~3_prpposed ADngxa~tion matters Mr. Thompson asked to have his letter placed on this agenda. Mr. ~'toore related that the proper action would be to accept this particular request ar~ authorize legal steps to annex this property. ~fr. McCoy made a motion this be carried out, seconded by Mr. Boos and it was unanimously carried, the appropriate legal description to be attached to the minutes of this meeting. Thompson P~signZug as Chairma~n of the Induetrial Commission, Mrs, Ctanton read the above-mentioned letter. Mayor Madsen~ ~. Collins and Mr. Banks individually expressed regrets relative to P~. Thompson's resignation of this poet. Receipt of Letter from Florida State Road Department concerning Blue Star Mem_p_or~al Pla~ue~ U.S.~_~t ~_ Mr. Kain stated the Road Department has asked whether or not the city would have any objections to this proposed installation. He said he saw no reason wh~ this plaque shotuld not be iustalled at the location indicated in,ir. Land~'s letter. -5- Mayor M~dsen read the above-mentioned letter. ~r. Banks moved that this request be gr~nted~ seconded by ~[r. Boos and it was unanimously carried. Request of Seventh-day Adventist Church to Solicit Funds f_or E~uc.ational and ~el£are Pro, ram. ~Lr. Boos made a mo~ion that permission be granted and fee waived. N~. McCoy seconded and it was unanimously carried. Request for Approval of Bi~ for Chevrolet truck te be Used h%' t?~ Parks Deoartm~nt. ~Lr. main stated this was a bid item which was awarded at a recent meeting. Funds have been provided in Activity 21%O-512. The bill from Benz Chevrolet, Inc., is in the amount of $1,566.25 and payment is recommended. Mr. Banks moved that this recommendation be carried out. Mr. McCoy seconded and it was uns~uimously carried. Request from Mrs. Ann Barrett for Settlement of a Lien for Improvement to Lot 72 of the La,ns ~[r. Kain stated Mrs. Barrett has indicated to him that she feels the lien is excessive in view of the improvement made to this property. The amount of the assessment is $660.25. Mr. Collins related that Mrs. Barrett had been insulted to attend the meeting to defend her position but she said she could not be here tonight. ~r. McCoy made a motion that Mrs. Barrett's offer of $300.00 be rejected and to let the original price of $660.25 stand. MLr. Collins seconded. The vote was 3 For. Mr. Boos abstained from voting. }~yor Madsen cast ~he dissenting vote. Letter of Reo~uest from the Boynton Docks. Mr. I&ain stated the various owners and operators of the Boynton fishing community have listed several requests in a letter received today. Mrs. C!anton read the above-mentioned letter in its entirety. ~Lr. Banks made a motion t?~is letter be turned over to Mr. Oec±l S. Farrar with the request he check this out and make recommendations to the Council. ~Lr.
