Mayor [~adsen gave recognition to members of the Industrial Com- mission. Mr. Henry Thompson, F=. Clyde Worrell and 14to Howard Riley were present. Mayor £~adsen also recognized past mayors James ~iahoney and Harvey Oyer. _MLNUTES Mr. Boos moved that the minutes of the regular meeting of July 18, 1966, be accepted. ~4ro Collins seconded an~it was unani- mously carried. zusIN s_s ProDosed OrdZnance 66-14 Mr. Kain explained that there have been several attempted con- tacts with the owner's agent and a letter was sent to the owner on July 19, 1966, requesting execution of a deed for adequate right-or-%pay for perimeter road construction. To date no response has been received. F~. Kain recommended continuance on the table until the City's requirements have been me=. Mr. Boos moved to leave this item on the ~able due to lack of information. ~4r. Banks seconded and it was unanimously carried. Re.__view of Balance of Sanitary Sewer,.~ro~ram Mr. Kain noted that at a special meeting on June 1, 1966, Counci~ authorized the preparation of plans and specifications for sani- tary sewer construction of systems 2BB, 5 and 5B. This was reviewed in Russell & Axon's letter of July 1, 1966, written by colonel ~eff. Parti- cular attention to Paragraph 4 is suggested. Russell &Axon has reviewed system 2-C and has suggested a modi- fied program in this area as an alternative to se%~ering systems 5 and 5B. If we apply the estimated costs of System 2BB and System 2C Modified (this includes enginee lng and contingencies), we would have a free balance of $19,00~37 The 1964 Bond Issue was predicated upon early completion of the proposed sewer system in order that revenues would meet operating and non-operating (debt service) costs. This issue %-~s sold in October 1964 and as yet the program has a large portion of the proceeds uncapitalized. This is in excess of t_he estimated costs b~ done wit3 our present financial resources~ Mr. Kain recommended that the 9ouncil authorize the city manager to sO notify the School Board in order that they may make other arrangements to obtain these servzces. Mr. Boos moved, due to the ~rogress that Council has learned from Mr. MOore~in regard to acquiring right-of-ways, that the proper persons b? instructed to proceed with Systems 5B and 2BB which havepreviousiy been authorized at a cost of $50,200 including construction and engineering contingencies. ~4r. McCoy seconded. It was noted that this would l~ve money available for three or four major projects contemplated in the downtown area iht he ve~g near future. Motion was unanimously carried. Mr. McCoy moved to have the city manager notify the School that the city wilt be unable to pro~ide water and sewer service to th~ because of the cost, therefor~ this will allow them to make other arrangements. Mr. Ba~ks seconded and it was unanimously carried. MIA~TES Regular Meeting City Council August 1, 1966 Cottrill RequeSt - Abandonment of 20 Foot Alley - Continued fro~: July 18~ 1966 meeting ,. ~r. Kain noted that this alley is located east of U. S. ~1 and runs from N. E. 6th Avenue to No E. 7th Avenue. The City and South_em Bell both have installations in this alley, consequentl~~ abandonment is not recommended. ~r. Boos moved for recommendation of the Planning & Zoning Board~ Mr. Mr, F~dsen noted that the Planning and Zon lng Board ~is request and that this hearing had been continued to give ~s. Review of Storm ~rainage Participation Program with the State Road Depar~t North Second Avenue Mr. Kain noted that at the meeting of May 16, 1966, the Council voted to of plans and estimates in order that the city could in a joint storm drainage program with the State Road Departmemt tO be carried on under the /mprov~ ment project for ~orth Second Avenue. Council authorized the study to include the area bOUnded as follows= On the north by N. 6th Avenue= on the east by the FEe, right-of-way; on the south by S. 6~h Avenue; on the west by the right-of-way of 1-95 (State Rd. ~9). A report from the~engineers~ Adair, Brady & Pishe, show~ that the cost of additional sizing to drain the original area would be in excess of the amount originally d~scussed. Drainage to coincide with the or~ would reduce the authorized area. Mr. Kain suggested I t~eareas be reviev4ed to decide if the program should tde with the original cost. Also ~. Kain suggested 1 project is selected, the city manager and theengineersbe ~ze~ to notify the State Road Department in,mediately so the project can proceed without further Mr. Adair and Mr. Jacobson, engineers on the project, came forward and explained their plans. ~r. Adair said the cost for the 235 acres involved in the total project, which does not include engineering costs, would be $140,000. By eliminating areas C and D as shoval on their map, the cost would be $!09,000, hut the cost of draining these areas at a later date would be considerably more. He explained it would be more economical to go ahead and size for pipe now. Mr. McCoy moved to go ahead and provide sizing of pipe for all four sections at $140,000 and to present plans to the State Road Department to enable the city to participate in a joint storm drainage program for ~ese areas ~rked on the map as A, -4- MIb~JTES Regula--~ Meeting City Council 1 August 1, 196G B, C and D. ~r. Banks seconded and it was unanimously carried. Mr. Adair noted that they have an appointment with the Road Department later an the week. Mr. Boos stated tahat Mr. Vain should write a letter to the County Commission and apprise thom of the decision arrived at tonight. Insurance Cover~ Mr. Kain noted that Mr. Oyer had notified the city tb.,at the Phoenix Insurance Company of ~artford will be ur~ble to provide coverage on Bonds, Money and Securities, Fire and Extended Coverage, Fire ara Extended Coverage on the Casino and Water Tower Insurance. Mr. Kain stated he had met with the insurance committee and they recommended coverage on the foregoing be placed with the Allen Insurance Agency writing '.r~rough the Ameri- can Fire and Casualty Company. The difference Ln premium costs is as follows: Oyer Allen Differenc9 $2,952 $3~136 $184 Mr. Kain recommended that the insurance committee's recommenda- tion be accepted. Mr. Boos so moved and Mr. McCoy seconded. ~otion was unanimousll carried. Mr. Boos asked ~4r. Allen to contact AmericanFireand Casualty Company to explore the possibility Of a new package filing for next year. Mr. Kain noted that the insurance committee recommends obtaining boiler and machinery insurance and reviewing the inventory of insured items with the objective of removing smaller items and revising the premium after deletion. Mr. Boos moved for the recommendation of the Insurance Committee that the City place coverage on boilers and machinery with Hart- ford Steam Boiler Company and instruct the company to revi~ items for deletion. WestphaI & Lydia Westphal East 27/45/43 Mr. Moore noted that the Planning & Zoning Board recommended unfavorably on the above requests. Mr. Henri Trudeau, 1965 South Ocean Boulevard, Pompano Beach, cam~ forward and stated that the Gore people of Fort Lauderdale are interested in buying this property and having his firm develop it. There is planned for this area a shopping center for high-class specialty shops. He stated he felt any investment along that strip would have to be a commercial complex; that is, a good restaurant, a mote~ situation and specialty shops. Mr. Trudeau requested that the Lotto property be referred back to the Planning & Zoning Board and that the request for rezoning be requested for this property alone. He stated that the rezoning on the Westphal property is withdrawn and that they will proceed anew with this property. He stated he wants to talk with more people in Lee Manor Isles when they return and to make plans with their consent. ~. Westphal come forward and also stated that the application for rezoning of his property is withdrawn. Mr. Raymond Moud~y came forward and stated he was pinch-hitting for Mr. Nemco who represents the people in Lee Manor Isles object- ing to this rezon~ng. He stated the Planning & Zoning Board has had a review of the situation and that there are property owners mn Lee Manor Isles who object to this change in zoning, also it zs spot zoning. He urged Council to support the Zoning Board's recommenda%ion to reject this change on the Westphal and Lotto parcels. Mr. Banks noted that if we were dealing with one parcel, it would throw a different light on this; that is, the Lotto property as opposed to the Westphal property. If separate applications were- made, it might make a difference as to the opinion handed down. Mr. Bauks moved to table this matter and ask the Planning Board to look again into the possibility of rezoning the Lotto propert~ since the ?~estphal application is withdrawn. Mr. McCoy seconded and the motion was unanimously carried. -6- Regular ~{eeting City Council Aug'~st 1, t966 Abandonment Reque_s_t To consider abandonment of that portion of S. E. 1st Avenue lying between U. S. $1 and S. E. 4th Street Original Town of Boynton, as recorded in Plat Book 1, Page 23, Palm Beach County Records: Requested by Robert D. Rapaport, dba Holiday Builders, V-nc~ Mr. Moore noted that the Planning & Zoning Board recommended favorably on this requst. Mr. Rapaport, 500 South Federal Highway, came forward to speak in favor of this request. He stated that they plan to contribute to the community in the form of a large motel having in excess of 100 units and having related facilities with it. This would be a substantial contribution to the community in terms of the wel- fare of the people employed in the construction of the motel. The people wil% benefit by having additional tourist facilities and the city wall benefit becaus~ of additional utilities used. In addition,, the facility wilt employ a number of people in its operation. He requested on behalf of his firm that the city abandon this street. He stated construction should get under way next spring. Mr. Madsen stated the City spent $2,350 for tearing down the Shook building on this property and said he would like to have this money repaid to the city. Mr. Rapaport stated that Council must have had a purpose in mind when they allocated funds to remove building and in only sixty days of taking this action his company has made the offer of making a very substantial investment in that area %.~hich is for thebetterment of the community and 'that area. Mr. Banks stated that the Planning & Zoning Board has recommended this request be granted and with the information given Council this evening by Mr. Rapaport that Council should approve this abandonment. He stated that in regard to the removal of this building from the street, this was allowed because somewhere back in the years gone by a man was permitted to build a house on the street right-of-way. Since the City permitted it to be built there, the city should pay to remove it. The reason was so that this property could be developed all the way through. It has accomplished its purpose because the property wili be developed. That was the purpose of Council voting as such. Mr. Banks moved that the recommendation of the Planning & Zoning Board be accepted and, ~ontingent upon the closing of this prop- erty in the n~me of Holiday ~ilder~ ~c., that the City would go ahead and vacate the street right of way. Mr. Collins seconded, -7- M~3T~S R~gular City Council Meeting August 1, 1966 ~ir. Madsen stated that he ~;ould still like to get that money back. Mro Thomas F. DaVis, District ~ngineer of the Telephone Company, Pompano Beach, carae forward and stated treat he is not objecting but that his company has two cables involved in this area and there would be a cost of $603 to re-route these cables and his company would have to be reimbursed if the street is abandoned. Mr. Boos assured Mr. Davis that the Telephone Com- pany will be rein%bursed so that they will have no loss. Mr. Boos and Mr. McCoy abstained from voting because of conflict- ing and perS~al interests. The vote was two for the motion and I~r. Madsen voted against itt Motion wa~ carried. Mr. Moore stated that the t~o abstentions go to the majority. ~PUBLIC AUDIENC,E ~ir. Bill Edell came forward and asked Council to waive a charge for the showing of "Plorida Sing Out 1966" in the Civic Center. He asked for the date of August 17th or as near thereafter as possible. Mr. George Johnson stated that it is the policy to charge a fee for the auditorium. He stated there is no admittance but a collection is taken up after the performance. Fir. Collins made a motion to let this group have the use of the Civic Center ~ithout fee. Mr. Banks seconded and it ~.~as unani- mously carried. Mr. Kain stated that there is an established policy and that policy has held forth to any and all and he hoped this would not happen again. Correspondence Junior Woman's Clu~ Mr. Kain stated that he is in receipt of a letter from the Junio~ Woman's Club requesting the City to urge the State to declare Fire%,orks Island as a public park. They request that the City direct this request to Fir. Ney Landrum, Director of the Florida Outdoor Recreation Council. Mr. Boos moved that a letter be sent to the State of Florida urging the State to declare Fireworks Island a public park. Mr. Banks seconded. Motion ~;as unanimousl~ carried. Request from Roger Zo%a Mr. Kain stated he had a request from Roger Zone for permission to beautify e portion of N. E. 3rd Court, being the unpaved por- tion of this road from N. Mr. Kain stated his intention is to landscape and have decorative islands, provide a' sprinkler system, maintenance and water for three years. Fir. Kain said this is agreeable to the city and recommends approval. Mr, Boos so moved and ~ir. Banks seconded. It was unanimously carried. LEGAL Ordi~.ance 66-15 - granting conditional use - Lots 7 through t0, Block 3, Lake Bc~nton Estates - Fleck Request Mr, ~oore noted that this Ordinance was incorrectly read on first reading which provided for a zoning change. This should have bee for conditional use. Mr. Kain stated he is in receipt of a lette' from £~r. Fleck dated July 28, 1966, stating construction on a garage building in which to do repair work will begin in sixty days. Fir. Moore read Ordinance 66-15. Mr. Banks made a motion that OrB~nance 66-15 be passed from first to second reading. Mr° Boos seconded and it was unanimously carried. Ordinance 66-16 (2nd Reading) rezoning Lots 16 and 17, Block 7, Bowers Park - Advance Air Conditioning. Mr. ~4oore read Ordinance 66-16 by caption only. Mr. Boos moved for passage of Ordinance 66-16 on second reading. Mr, Collins seconded and it was unanimously carried. Review of Contract withAdair, Brady & Fishe, Inc., drainaqe - l{orth Second Avenue for storm Mr. Moore stated that he and the city manager had reviewed this contract and everything is in order and recommends authorizing the ~yor andCity Clerk to sign. In several of the cases the water has already been turned off. FiRE CONTP~CT - Ocean Ridge, Briny Breezes and Gulfstrea~ Mr. Kain stated that he had hoped to set up a long term contract with all three communities, but now recommends that each have a separate contract. Mr. Boos asked Mr. Kain if he would come up with a firm contract before the next meeting. -11- Regular ~eeting City Council August 1, 1966 Review bv city Manaqer of Status of Ambulance Service Mr. James }~. Dickson and Mr. T. J. Croft came forv~ard and stated that they are maintaining an ambulance service and have applied for a license in Boynton Beach. They will operate as an inde- pendent a~bulance co~pany not associated with any funeral directo~ They will be listed as AA Ambulance Service, Inc., and will be ready to go on the 15th of August. ~. Kain read a letter from National C~.apels in Lantana which stated they are in the ambu- lance service also. Reorqanization of Fire DeDa~tment Mr. Gene Wright came forward and stated that within the past three years work has had to be reorganized within the department due to ~e increased number of runs. Reorganization is badly needed. Mr. McCoy moved to accept Chief Wright's proposed re- organization of the Fire Department. ~r. Banks seconded and it was unanimously carried. Tax Billinq P~chine Mr. Kain pointed out that if the city accepts this contract with the BurroughsCorporation for lease of a tax billing machine, we will be oblig-ated to pay for one year. Mr. Kain recommended that the city go ahead and lease this machine to do the job for $311.11 Mr. Boos moved for recommendation of the city manager. Mr. Banks seconded and it was unanimously carried. P~. Boos stated that I~. Ray Piantanida told him that the pa~%tin% "Cyclorama" would be presented to the city if the city would consider moving the building. He stated it would cost between $8~000 and $10,000 to move the building. Mr. £4~dsen said Council members would take a look at it. ~4r. Boos asked about the concession stand at Wilson Pa~. Mr. Kain said he is working on it. Mr. Kain sbated he would make another date with i~ro Greet con- cerning the Child Care Center and have a list of properties available. Mr. Boos noted that the city has a boat ramp ~hich is not being used to its highest and best use.
