Kain, City Manager Tereesa Padgett, City Clerk Gene Moore, City Attorney The meeting was called to order at 7:30 P.M. by Mayor Madsen. The invocation was given by ReVerend Earl Downey, First Presbyterian Church, and the Flag Salute was led by Mr. F. T. Kain. Recognitionwas given members of the Beautification Committee present. They were Mrs, Helen Day, Dr. N. N. WeemS, Mr. Don Combs, Mrs. Martha Pulver, Mrs. Frances Brinkm~ier.~ndNr.!iich~e~ Michael. Mr. Hanks made a motionto approve the minutes of April 18, 1966. Mr. Boos seconded and it was unanimously carried. OLD BUSINESS ProRress Repo?t - Cemetery Tmprovements Mr. Kainnoted that Mr. ~D0ghsonhas prepared an extensive presentation on his preliminary studies. He said Mr. Hughson is required to make periodic reports and this is his first one. A meeting has been set for Tuesday, May 3, at 2:00 P.M. LEGAL Proposed OrdLg. ance 66r!2 Mr. Moore read Proposed Ordinance 66-12 amending Sec. 29-8 of the Code which provides for the removal of Junked or abandoned automobiles. The recommended amendmentw~ll provide that the cost of removal shall be charged to the person receiving notice of the violation of the junk car ordinance. Mr. Banks moved for the passage of the proposed change in Ordinance 66-12 from first to second reading. Mr. McCoy seconded and it was unanimously carried. -1- Regular City Council Meeting May 2, 1966 Prooosed Resolution 66-T re: consolidation of tax assessing and collec- tio'n procedure with Pa]~ Beach County Mr. Moore read the proposed Resolution 66-T. Mr. Boos moved for passage of Resolution 66-T. Mr. B~nks seconded and it was unanimously carried, Proposed Resolution 66-U amending Article III, Section 5, Paragraph 2 of the Civil. Service Rules and Regulations - Mr. Moore read .t, he proposed Resolution 66-U which amendment will .enable the administration to autho?mze or. al and .~. i. tten.e~t..ion~ _t_ow~O~nt Mr. McCoy moved for adoption ox Eeso£u~lon and it was unanimously carried. ADMINISTRATIVE Discussion of Im0rov~t Of Pioneer Park Mr. ~ain reported that the ultimate objective is to install the following:~ 1. Sprinkler System 2. Sidewalks at the south and west llm4ts of the park 3. Enlargement of the existing basketball facilities &, Install a one-eighth mile running tract 5. Install horseshoe pitching lanes 6. Install handball courts ~w. Kain recommended ~mediate work on the first two items. The est~Ated cost for the sprinkler system is $1,185 and construction of sidewalk is approximately $700. ~r. Kain noted that the refurbishment of this park was part of the revitalization of the downtown area brought out in the Master Plan in 1962 by Mr. Simon. Mr. Kain said this would require going out for bids on the sidewalks and that most of the work on the sprinkler system could be done by city employees. Mr. Banks moved that the city manager be authorized to proceed with this program; to secure bids for sidewalks and plans for the sprinkler system to be left up to the city manager. Mr. Boos seconded and it was unani- mously carried. BIDS - 7:&5 P.M. 20~000 cubic yards of *~11 for Lots 5~ and 5~ Dewo.vs S/D. There ware no further bids from the audience. -2- ~LINUTES Regular City Council Meeting May 2, 1966 Mrs. Padgett opened two bids which were received in the mail. 1. Keatts Trucking Service, Boynton Beach, $115 per cu. yd. Total was not extended. 2. Hardrives, Delray Beach, $.79 per cu. yd., $15,800 total It was noted that the bid from Keatts was probably a typographical error. Ne. McCoy moved to turn these bids over to the city manager for tabu- lation and consideration. Mr. Boos secondedl Mr. Boos noted that this matter should be continued through the Legal Department in the proper way for court's approval at a later date. Motion was una=~ously carried. Mr. Madsen recognized former mayor, James ~honey, in the audience ADMINISTRATIVE C.o. ntro! Wir.e - Christmas Lights Mr. Kain explained that the power c~mpany has requested bhe city to con- sider the installation of a permanent control wire to be used for Christmas light installation on U. S. #1. This wire would greatly simplify the work done each year in hanging the Christmas decorations and it would also decrease considerably the cost involved in this work. The power company has agreed that they would do the work for $670 and would look to the city for payment after the beginning of our next fiscal year. Mr. K~in recommended that the power company be instructed to go ahead and do this work at the cost of $670. Mr. Banks moved to approve the recommendation of the city manager and to have the work done as soon as possible. ~. McCoy seconded and it was unanimously carried. Request authorization to advertise for tenders on the 19~6 Refunding Bond Issue Mr. Kain explained that the city has $25,000 currently available to re- deem these bonds. A provision in that issue states that the city can advertise a~nually calling for tenders for redemption. A motion authorizing this advertisement is recc~mended. Mr. McCoy moved to authorize this advertisement as recommended. Mr. Boos seconded and it was unanimously carried. MINUTES Regular City Council Meeting May 2, 1966 NE~I BUSINESS N.orth 2nd Avenue Storm DrainaEe N~, Kain reported that council had discussed at their Saturday morning meeting the participation of the city with the county and state in the draining of 2nd Avenue. Mr. Kain noted that if the city desires to go into this program it should notify the county immediately. The city must agree to pay additional engineering costs involved and that all additional engineering work~ shoo, Id be done by the same engineers~ Mr. Kain suggested that the city should make immediate arrangements for financ~ this project. He stated that the county's cost to install 2nd Avenue drainage ~r~tl be $4007000, but that the city could tie in now for about $200,000. Mr. Kaln ~ecommended that the city proceed with all possible haste to mauthorize engineers to de this work. He stated that the city sho~ find out how mueh money we are talking about then determine what the best .method of financing would be and make arrangemants for that financing. Nr. K~ Statod he felt the city should participate in this program and urEed ceuncil bo act favorably. Mr. Banks stated he felt this would be a very substantial saving to the city not only from the standpoint of dollars but would also help us speed up storm drainage in this area. Mr. Banks suggested tha~ ~r. Kaiu be given the authority to proceed with gett~ the engineering work done and to work with ~. Moore on the financing and let com~cil, know their findings. Mr. McCoy stated that the feeling of the council was that on an expen- diture of this size it would be very good to take it to referendum, but due to the time element it would be impossible. He stated this would be a tremendous saving to the city and to duplicate the expenditure in the future would be a mistake if we can do it now. Mr. Banks moved to give Mr. Eain the authority to go ahead with the engineering work and for ¥~. Moore and N~r. Eain to work out some feasible plan to finance this as soon as possible. ~. Boos seconded and it was ur~nimoualy carried. ,PUBLIC HEARING 8:00 P.M. Re: Opening S. E. 2nd Avenue from S. E. 3rd Street eastward to S. E. ;.th Street Mr. Kain noted a letter signed by 16 people in this area protesting this request. Letters were sent to 28 owners on the street notifying them of the intention to open the street and construct a signalized crossing. MINUTES Regular City Council Meeting ~y 2, 1966 Mr. Kainstated the city was furnished a form of Agreement from the F.E.C. last year; however there ~re several questionable provisions in this Agreement which should be gone over before decision is made to sign such an agreement w-lth the Railv~y. Mr. Kainnoted that ~. Simon indicated in theMaster Plan that 2nd Ave. is a part of the perimeter system. Mr. McCoy noted that it was the unanimous decision of the Planning and Zondng Board at a Special Meeting held April 28, 1966 that this opening is ill-advised at this time. Mr. Kain stated that if council does not go ahead with this opening that it should be Studied in the overall street and drainage program. He noted that no preoise or accurate traffic study has been made, and that this should be a definite item in the overall street program. Studies may show that it should be done there or an alternate location. Mr. McCoy moved that we do not consider opening this street at this time. N~o Banks seconded and noted that the Planning and Zoning Board ex- pressed their opinion that this should not be done at the present time hut at s later time. ~s, Emily Jackson came forward and stated she felt there were more important things to spend money on at this time. Mr. Hartwig voiced objection to the opening of this street, also John Deller. N~. Boos remarked that there are so many errors in the License Agreement that it should be buried at this time. He said all but ll of the 28 property owners on S. E. 2nd Avenue had refused to sign the petition. N~, Boos stated that he felt there is no other problem more important or has a more direct effect on our pocket book than the revitalization of the do~town area. He stated that every homeowner in Boynton pays mere taxes on his home than he shotuld pay because the city does not have enough commercial property on which to levy taxes, and property sells less than true value because of this m~jor problem. N~. Boos said he will ask for a meeting of the property owners of downtown BoyntonBeach tO pursue the proposal. Mr. Boos stated he felt the perimeter Est be opened and that no one is thinking of spending $25,000 to do so. The city attorney and administrator can best recommend the procedure and they are working on it. Mr. Boos stated that the city should not maintain the status quo but should move forward- He notedthat there are 23 acres in the city today which represents less th~n 1/3 of 1% of the total area but pay over 5% of the total taxes. N~ BUS~SS Mr. McCoy moved that the city attorney be instructed to prepare a resolution to be sent to President Johnson, Paul Rogers and our Senators on the Vier Nam situation. The thought to be conveyed is not to enter into any pros or cons of whether we should be there, we are there, but encourage them to use every resource, w~apon and man at this nation's disposal to end this nightmare as soon as possible and get our people back home. Mr. Banks seconded and it was unani- mously carried. Com~m~ity Antenna Service Mr. ;~Coy moved to instruct the city attorney to prepare proper specifi- cations to go out for bid at this time. Mr. Moore explained that a private enterprise comes into the city and builds a T.V. antenna sy- stem and runs service to individual homes. This service is available to people at a monthly charge. No one has to do this, it is a voluntary third. There is a franchise tax connected and a certain percentage of the gross revenue goes to the city. This partic~lar type of business has been in effect several years in other parts of the country. Mr. Kain read the changes in precin~cts for voting purposes~ Mr. E~inread a Proclamation naming May23, 1966 as '~aritime Day". Mr. Boos moved for the adoption o£ this Proc]a~.tion.
