Minutes 10-18-65MINUTES OF THE REGULAR CITY COUNCIL ~ETING HELD IN GITY FALL, BOYNTON BEACH, FLORIDA, OCTOBER 18, 1965 at 7:30 .?RESENT: JAMES J. MAHONEY, MAYOR WALTER A. MADSEN, VICE F~YOR JOHN L. ARCHIE, COUNCILMAN J. ALLISON BANKS, COUNCILMAN CMAS. N. BOOS, COUNCILMAN F. T. KAIN, CITY MANAGER GENE MOORE, CITY ATTORNEY TEREESA PADGETT, CITY CLERK Mayor Mahoney called the meeting to order at 7:30 P.M,, Mx. Banks gave the invocation and the flag salute was led by Mr. Archie. MINUTES Vice Mayor Madsen moved to accept the Minutes of the Regular Meeting of October 4th a~d Special ~eting of October 6~ 1965. Motion seconded by Mr. Bard, s and unanimously carried. OLD BUSINESS Revised Assessmemt Roll - Paving S. E. 9th Avenue between S.E. 1st St, and FEC Mr. Archie moved to accept the reVised roll and to authorize the clerk to advertise for public hearing November 1, 1965m at 8:00 P.M. Seconded by Mr. Boos. Unanimously carried. BoyntonCanal Ernest G. Simon, attorney for the homeowners of Coquina Cove and Harbor Estate~ said that although the representatives of the homeowners and the fishermen had met, no compromise had been reached because none was possible. Mr. Simon said he had a petition in the form of a resolution sigmed by 150 residents of Coquina Cove and Harbor Estates, 7:45 P.M, - Mayor ~honey interrupted the attorney to issue final call for bids. Mr. Simon subm~itted the resolution to the P~yor and Council and commended the CounCil for passage of the ordinance and requested that it remain tmchanged. Mr. Ward Wagner, attorney representing the fishermen, said that his group had submitted several ideas at the October llth meeting of the two groups with FCO representatives and Council that were entirely for the benefit of the homeowners. Mr. Wagner said the fishermen felt that the homeowners had no right to deprive the public the use of publio property. Mr. Madsen stated that he had listened carefully to:both sides in all their discussionsand could see mo reason to rescind or delete any part of the MINUTES City CoUncil, Boston Beach, Florida October 18, 1965 ordinance and said the fact that the FCD was willing to supply $5,000 worth of fencing to cooperate with the people of Coquina Cove and Harbor Estates for their protection just proved the point, p~. Madsen than moved there be no change in Ordinance 65-41, Motion seconded by Mr, Archie. 1~. Banks cited portion of a letter from the FCD where they recoranended continuance of the ordinance. Motion unanimously carried 5-0. Mr. Archie moved to ask the FCD to erect the additional fencing. Seconded by Mr. Madsen. Motion carried unanimously. DeMarco Property The City Attorney met with Mr. DeFmrco and his attorney to discuss the City's suit against the nuisance at the DeMarco property. Mr. DeMarco indicated a willingness to sell his approximately ten to twelve acres to the City. Mr. Archie said the property had about 2,000 foot frontage on the waterway and was an ideal location for a City park. He moved that ~. Yain and Mr. Moore meet with Mr. DeP~rco to discuss a possible offer on the property and that the Planning and Zoning Board be instructed to hold a meeting to check into the feasibility of this purchase and the information referred to Council for further study. Seconded by Mr. Banks. In the discussion which followed, Mr. Boos said that although he thought }~. Archie's plan had much merit, he had mixed emotions about it, as he felt it might be considered an ~out" for a party who had been defacing the City. In answer to Mr. Madsen's question of the possibility of a developer purchas- ing the property so it would be ratable, Mr. Boos said that the cost of fill- ing this land for building purposes was almost prohibitive, but he felt only a small amount of fill would be necessary to create an attractive park. Mr, Archie imdicated his intention that the funds for the purchase come from the Capital Improvements Program. }~yor Mahoney said he felt the plan had merit and should have further study. The vote was called and the motion carried unanimously 5-0. BIDS .Opening - Air Conditioning and Heating Units for Wilson Recreation Center One hid was received and Mr. Banks moved to open as it had been properly advertised and others had had a chance to bid on the item. Motion seconded by Mr. Archie. Carried 4-1. Mr. Ymdsen voting "NO". Boynton Metal Craft $3,693 - delivery and installation within 30 calendar days ~. Kain indicated this figure was less than the estimated $3,900 and Mr. Archie moved to accept the bid, Seconded by Mr. Boos. Mr. Kain stated in answer to Mr. Madsen's question that this was approximately -2- ~INUTES ~ity Council, Boymton Beach, Florida October 18, 1965 14 tons in size. Mr. Boos inquired whether ahy GOvernment fUmds would be available due to the Day Care Center conducted at Wilson, Mr. Kain said the Government would pay for maintenance and operation under this program but asked the communities to supply the facilities. Mr. i~adsen mentioned all the difficulties that had been encountered with air co~ditiomi~g of the Senior Citizens' building at the Shuffleboard Court and made a motion to table the item. Mr. Boos seconded. Unanimously carried. ,Awarding ...Two Police Cruisers The iow bid of Florida Chrysler-Plymouth opened at the October 4th meeting offers equipment which equals or exceeds the specifications. Mr. Kain recommended accepting their hid of $4,493.10 for two Fury I police cruisers. Mr. Boos moved to accept the recommendation of the City Manager. Seconded by Fir. Banks and nmanimously carried. One Trash Tractor with Loader Bids for this ecfuipm~at were opened at the October 4th meeting. The tractor is to be used to pick up trash for the sanitation scows. With regard to the question of the specifications, Yz. Kain said the specs were designed to meet the suitability of the work to be done and they were not meant to favor anyone, lz~. Kain recommended the alternate bid of DeMarco Tractor and Imple- ment Company for a Massey Ferguson P~del 3165 with an FA~200 heavy duty loader at $4,395j delivery within ten days or less. Mr. Banks moved to accept the recommendation of the City Manager. Seconded by }~. Madsen and unanimously carried 5-0. ~pwage Works Project Twelve bids were received at the last regular meeting and a complete tabula- tionwas submitted to Council by Russell & AXon. Their recommendation is the low bid of Whitmire Mock, Inc., in the amount of $113,202.98 with the project to be completed in 120 days. A motion to accept the recommendation was made by ~. Archie and seconded by Mr. Banks. Unanimously carried. NEW BUSINESS The Mayor read a letter sent by Lake Lytal, Chairman of the Board of County Con~aissioners, dated October 13, 1965, from the Florida State Road Depart- ment which advised the date for letting and bids for the bridge at S. E. 15th Avenue will be November 23, 1965. Mayor Mahoney indicated that work would probably start no later than the first of the year. Appointment to Resources & Development Board Mr. Banks moved to appoint Mr. Madsen to fill the vacancy on the Resources -3- ~INUTES City Council, Boynton Beach, Florida October 18. 1965 and Development Board. Seconded by Mr. Archie and unanimously carried. Mayor Mahoney directed Mr. Kain to send checks in the amount of $150 each to the Junior and Senior High School Bands as budgeted. '.EOaL Ordinance 65-44 - 2nd reading - amending the Parking Cod~ Mr. Moore read the ordinance by caption only. Mr. Banks moved for passage of the ordinance. Seconded by Mr. Madsen and unanimously carried. Emergency Ordinance 65-45 - amending the 1964-1965 Budget This ordinance authorizing budgetary transfers was read by Mr. Moore. Mr. Archie moved for adoption. Seconded by Mr. Banks. Unanimously carried. Ordinance 65-46 - mending Section 23A-7 re collection of Sewer Se~ice ~r~n~ Mr, Moore read the proposed ordinance and Mr, Archie moved to pass to second and final reading, Seconded by Mr, Madsen. Mr. Banks said he was in favor of a sewer rate reduction nnd since Chis could not be accomplished under the bonding agreement, he would go along with the discount; however, he felt that a 10 per cent penat~y if the bill is not paid within twenty days was too strict, ~. ~oore ~oiuted out this provision was in the 1959 ordinance and was the same as the State law, but it was a matter that was up to the discre- tion of the Counc.il. Mr, Banks said he felt the penalty was not enforced because it was too strict, Mr, Archie said he was willing to amend his motion to include thirty days allowed before a penalty be imposed and forty- five days before turn-off, Mr. Madsen accepted the revision. Mr, Boos stated h~ wpuld Vote for the ordinance, but felt discounting bills usually led to b~d p~blicrelations, Mayor }fahoney said the City had a letter from Russell & Axon and T, R, Alcock turning down recommendatian for rate reduction and approving the discount on sewer bills. Vote was called on the revised motion and was carried 5-0. The ordinance will tgke effect about December 1st and the Mayor instructed l~r, Kain to have a ~6tice in red ink attached to the first billing after this date and possibly an explanatory leaflet, Mr. Boos brought out the fact that tra~ler parks are billed on industrial sewer rate and he said he felt this was. a gross injustice. ~myor Mahoney suggested he ask ~. Kain to prepar~ areport on this situation and submit it to the Council. Discussion on the taxing and licensing of trailer parks followed and Mr. Kain said he would ala~ include these items in his report to Council. -4- MINUTES City Council, Boynton Beach, Florida October 18, 1965 .~UBLIC AUDIENCE Dwight Roehm of 703 S. W. 27th Terrace questioned why there was not house delivery of mail in Forest Hills. tVir. Boos and Igayor Mahoney suggested that Pit. Monahan~ the Postmaster, would be able to help M~. Roehm. Richard La~ontagne, one of the owners of Knoll~ood Groves, said he and his wife and five young children had recently bought a home in Boynton and had been extremely disturbed by loud noises amd improper conduct by a Boynton Police officer who lives in the neighborhood and he wanted to know what had been done as a result of his complaint. The Mayor said he had just been formed Sunday evening by two persons who called at his home, and he had conveyed same to the City ~&~nager Monday and Mr. Kain said he had met with the Police Chief on the matter. .ADMINISTRATIVE Heart Association - permit to solicit during February 1966 }~o Archie moved to grant the permit and to waive fee. Mr. Boos seconded. Motiom carried 5-0. Delray Beach Radio Club - permit to solicit October 19, 1965 through February 20, 1966 Mr. Kain explained on request that this was to be primarily solicitation of ads from local merchants for the Jamboree Call Book. This club has given assistance to the City in time of emergency and can be of great aid in the event there would ever be loss of telephone communications as in a hurricane. ~. Banks moved to grant the permit. Seconded by Mr. Archie and unanimously carried. United Fund - Permit to solicit during February, 1966. Motion to grant the permit was made by Mr. Ban~ and seconded by Mr. Archie. Unanimously carried. Application for Beverage License - Capri Dining Room, 110 N. E. lOth Avenue Marion Bell ~. Archie asked the clerk if everything had checked ontproperly and being advised affirmative, moved to grant the license. Seconded by Mr. Boos. It was noted the request was for beer only served on the premises and take-out. Motion carried 4-1. P~, Banks voted ,'NOV. Receipt oflList of Coupons and Bonds paid bY Morgan Guaranty Trust Co,~ 1961 Issue, Series A & B, Water and S~wer Revenue Bonds ~. Archie moved to acknowledge receipt of list in total amount of $33,737.50. Seconded by Mr. Ymdsen and unanimously carried. MINUTES City Council, Boyuton Beech, Florida October 18, 1965 Briny_Breezes' Request for Radio Service They wish service similar to that we extend to Ocean Ridge. }~. Kain said such service would be beneficial to both Boynto~ and Briny Breezes and suggested contract similar to that with Ocean Ridge at a cost to Briny Breezes of $25 a month. Mr. Madsen so moved. Seconded by Mr., Archie and unanimously carried. T~o Fountains Presentation of plans mud estimated cost for construction of two fOuntains-- one to be located at the west side of U. S. ~I north of Boynto~ Ca,al and the other at the beach picnic area. M~. Archie moved to go out for bids. Seconded by Mr. Banks and unanimously carried. Sewer Works Pro~ect Proposed Change Order #3 - Bumby & Stim.oson - Mr, Kaim requested Council withhold action on this until he had additional information available. So moved by F~. Banks. Seconded by Mr. Boos and unanimously carried. Receipt of List of Payments made in September Mr, Archie moved to table at the request of ~. Madsen. and unanimously carried. Seconded by Mr. Bank~ Approval of Bills Mr, Archie moved for p~yment of hill to Russell & Axon in the amount of $1,266.53. seconded by Mr. Banks. Unanimously carried. Departmental Reports Banks moved to accept the reports. Seconded by Mr. Boos. Motion carried 5-0. OTHER Mr. Banks said that although he had no report at present on the feasibility of a Municipal golf course, F~.
