~ayor Mahoney called the meeting to order at 9512 a.m.
meeting had been called forth, purpose ef awarding bids on
sewer pro~ects~ street surfacing and other matters.

Mayor ~ahoney read a letter from Russell & Axon, Consulting
Engineers~ evaluating the bids received by the City and recommend-
ing awarding as follows:
Section 1 - Bumby & Stimpson $217,364.25
Section 2 - ~- ' ~

Pit. Banks moved that the recommendation, of Russell & Axon be
accepteds that the bids be a,.~arded as reoommer~ed, that the Mayor
and City Clerk be authorized to sign the contracts and that a
copy of ~ussei1 ~ Axon~s tabulation and recommendation be appended
to the minutes of the me,tinge ~r. Archi, seconded the motion
which carried unanimously.

The City ~anager presented the Council with tabulation on
the bids received for the above captioned work. The low bidder
was Turner Nursery & Landscape Co.~ Boca E~ton~ Floridas in the
amount of $1~16.00. The counnittee assigned the evaluation of
these bids recommended acceptance of t~his low bid. ~r. Archie
moved that the Mayor and City Clerk or Deputy City Clerk be
authorized to sign a contract with Turner Nursery in the amount
of $1D16.00 according to the bid specifications. }~. Banks
seconded the motion ~fhich carried 5-0.

Mr. Kain reported to Council that the low bidder in this
instances Turner Nurserys in the amount of .~$3~833.00, vzas appro-
ximately $1,000.00 above the estimated cost for the paving.
~r. Fmdsen suggested %hat the low bidder be awarded the bid
~lth the stipulation that payment of $1s000.00 be delayed for
ninety days until the new budget was in effect. Mr. Jack Carver~

representing Turner Nursery~approved this payment procedure and
stated that the company would confirm it in writing. Nrc Archie
moved that the low bid be awarded to Turner Nursery in the
amount of $3,833.00~ the work to start immediately, that $1,000.00
of this sum be withheld until November 1~ 1965, and that the
Mayor and City Clerk or Deputy City Clerk be authorized to sign
the contract. Mr. ~adsen seconded the motion which carried 5-0.
TO~ OF GULFSTREA~ REQUEST,FOR WELt FIELDS LOCATIOI~
A letter was read from the Town of Gulf Stream asking per-
mission to use property within the City limits for their water
supply, The property vms located at the extreme southerly limits
of the City~ immediately ad~cent to the Florida East Coast right
of way. Mr. Moore advised Council that from the zoning standpoint
there could be no objeotion as the property was zoned for public
utilities structures~ however~ the State Board of ~ealth would
have to be contacted i~ order to See what effect this would have
on the City's

Mrs, Carrie Gladney requested Council support and financial
assistance in sending the D~xietahders Band to the ~orldes Fair
to represent Boynton Beach,. She explained plans for chartering
a bus and selling ~surplus ~ s to help finance the trip.
Mr, Eain said that funds in the promotion con-
tingency fund. 2,fr. ArChiemoved that the City donate $250.00 to
the Dixielanders f~r the purpose efa trip to the Ne~ York World,s
Fair contingent on plans ~Orking out as outlined by Mrs, Gladney.
~r. Madsen seconded the motion which carried 5-0.
SEWER PROJE~£ ~SPECTION
The Council discussed the sewer project inspection work
relative to the City performing the inspections or hiring Russell
& Axon as inspectors for the installation. ~ro Kain pointed out
that the cost to the City would be approximately $1~700.00 a month
for Russell & Axon to do the inspeoting~ two qualified men
could be hired by the City~ plus other expenses~ for a maximum
figure of $1~000.00 per month. ~ne City Engineer recommended
that the latter course be folio~zed~ indicating that his depart-
ment could accomplish the jobe
Mr. Archie moved that the City Manager be authorized to
employ two men to ac~ as inspectors along with the City ~ngineer

to be hired on a specialized contingency basis, non-classified,
during the period of installation of the sewer project. Mr. Banks
seconded. Motion carried 5-0.

Discussion was held regarding the stand taken by the State
Board of Health with regard to the installation of septic tanks
within the City and the adverse effect it was having on new con-
struetion in some areas.

Mr. Moore s~ated that under Section 22-69 of the Cede our
Plumbing Inspector is not a~lowed to issue a permit for a septic
tank installation, unless it is approVed By the State Board of
Health an/that this part of the code would have to be amended to
allow the issuance without Health Department approval. The
reasoning behind the ban on septic tanks in outlying areas~ where
possible water polution was less likely, ~¢as no~ understood by
0ouneil. The ban, in effect, denied land usagee
~r. Banks moved that the City Attorney prepare an ordinance
for Council approval that~ouldamend Section 22-69 and allow
the City to issue permits for the installation of septic tanks
without Health Department a~roval~ so that something ~ould be
in the cods to make a test case with. Mr. Archi, seconded the
motion which carried 5-0.
RELEASE OF FUNDS TQ HARDH!VES, INC~
The City Attorney recommended that the Council accede to the
request of Southern Gulf Utilities regarding release of the balance
of funds due Hardrives, Inc. and that the City Manager be authorized
to sign the release of escrow. ~ir. Boos so moved. Mr. Banks
seconded the motion ~nich passed unanimously.
NATIONAL LEAGUE OF ~4UNICiPALITIES
~r. Madsen moved that~ in view of the fact that the money
was budgeted, any Councilman desiring, could attend the National
League of Munipalities in Detroit, l~chigan, July 24 through
July 28. As of this date Mr. Archie~ Mr. Madsen~ Mr. Moore were
scheduled to attend. ~Ir. Banks would advise the City ~anager~s
office later in the day of his intentions. Mr. Banks seconded
the motion. Motion carried

I, as are the number of days to complete the work. B~nby & Stimpson, Inc.
also suhmt[ted a letter stating that they would decrease ~he ~ni~ price
for asphalt pavement rep lacement by the amount of $0.50 per square yard,
reducing the estimated contract amoun~ by $3~080.00. The bid submitted
by Whit~ira-~ock, Inc, for Section II is the Iow bid for both the base
and alternate bids.
It is recomanended that the contract be awarded for Section I to Bumby
& Stimpson, Inco in the a~ount of $217,364.25, which takes into consider-
ation the reduced cost for asphalt pavement replacement, with a completion
time of 150 days.
