Mr. Boos moved that the above item be removed from the table.
Banks seconded. ~otion carried 5-0.
~r. Boos urged the Council to take some action regarding
this street improvement, which was being blocked by the encroach-
ment of the Shook Building on the right of way. Discussion was
held during which ~r. Moore reviewed the facts to date. Mr. Madsen
moved that the abutting property owners which would be assessed for
the street improvement be requested to bear the cost of moving the
house and also pay for the street improvement. Br. Archie seconded.
Motion carried 5-0.
It was determined by Council not to proceed further with this
matter if the property owners effected did not agree to bear all
cost~
Acquisi$ionof Additional Beach Property
Br. Archie moved that any and all parties interested in
selling beach property to the City provide the City with an apprai-
sal, at their expense, by a Member of the American Institute of
Heal Estate Appraisors to be chosen by the City, and that the
offer and the appraisal be given to the City on or before August 1,

Call for Tenders ~ $25,000 - Refundin$ Bonds~ Issue of 1946
At 7~45 p.m. the call for tenders was made. Mr. Archie
moved that the drawing be held at the end of the meeting~ for the
twenty-five coupons since no tenders had been received. Mr. Banks
seconded. Motion carried 5-0.
Ordinance 65-22 - let aeading
~r. Moore read Ordinance 65-22 which created an R-3A zoning
classification which allowed only ~ultiple family residences.
This zoning classification had been recommended by the Planning
and Zoning Board along with the previously enacted R-2A zoning
classification. Public hearings had been held on it and no ob-
jections were registered. ~r. Madsen moved that Ordinance 65-22
be passed from first to second reading. Mr. Archie seconded.

Zonin~ Change - 702 S. Federal Highway
Public hearing was called on the following requested zoning
change:
That part of N~ of NW~ of SW~ lying west of
FIND Canal, Ac 27/45/~3, ?0Z $. Federal Hwy.,
from R1AA to C-1
No objections were recieved either in writing or by voice
against this rezoning. The Planning and Zoning Board had recom-
mended approval of the request° Mr. Moore read Ordinance 65-23
which amended the zoning to C-1. Mr. Archie moved that Ordinance
be passed from first to second reading. ~r. Madsen seconded.

Zoning Change - Boynton Ridge, from R-! to R-3
Public hearing was called on the following requested zoning
change:
Lots 1,2, and 3, Block 215 Lots 1,2,3,4,17, 18,
19 and 20, Block 25; all of Blocks 24 and 33,
Boynton Ridge, from R-I to R-3.
Speaking in favor of the rezoning was Mr. Phillip Schlissel,
a part-owner in the property. He stated that he and Mr. Weinstock
desired to build condominiums on the property, and that R-3A zon-
ing would be satisfactory with them instead of the requested
Mr. ~4adsen asked Mr. Schlissel if he would object to a time limit
for the start of construction. He said that he would object~
giving his reasons as plans, finanoing~ etco
Mr. Joseph Hill, president of the Royal Palm Village Assc.
spoke in favor of the rezoning.
Attention was celled to the petition favoring the rezoning
which had been received bearing 102 signatures° There were some
seventy-three persons present who stood in favor of the request.
Additional petitions were received with fifteen signatures in
favor of the request.
Speaking in opposition to the rezoning was Mr. Joseph
Tomberg, who stated that he represented persons living contiguous
to the property who were strongly objecting to the requested
rezoning. ~r. Tomberg presented the Council with a petition bear-
lng sixty signatures which petitioned the Council net to grant
the zoning change. Eighteen people stood as objecting to the
rezoning.
Persons present residing within two blocks of the property
to be rezoned were seven in fevor and eight objecting.
Mr. Moore read 0rdinanoe 65-24 which changed the zoning
from E-1 to R-3A. ~r. Madsen mo~ed that the ordinanc~ be passed
from first to second reading. Mr. Arohie seconded. ~iotion

Utility Easement - Florida Power & Light Company
The Chair recognized Mr. Charles Senior of the Florida Power
and Light Company. ~r. Senior called the Council*s attention
to a requested utility easement which had been submitted about
six weeks earlier and had been tabled for further study. He said

that the City ~4anager and, City Engineer had investigated the
matter with his men and that he was sure that they would confirm
the fact that the right of way was necessary. Five poles would
have to be installed and, if at any time in the future, the City
needed the right of way, his company would not stand in the way
of progre with the City, It was agreed that upon
the return of the City a poll of the Council could
be made and the go-ahead given on the right of way.

Mr. Moore explained to Council that the City records show
that ~4innie Lee Barker paid $200.00 for the lots on January 3,
1949~ however~ the unrecorded deed was misplaced. He reco~nended
that a quit claim deed be issued to remove the cloud on the
title, ivLr. Banks moved that the City Attorney's recommendation
be accepted and that the and City Clerk be authorized to

OT~inance 65-28 - Rates,and Fees for Sewage Disposal
Mr. Moore read Ordinance 65-28~ which amended Chapter 23A of
the Code of Ordinances and affected changes in the rates and
fees for the sewage disposal system: commercial rates were set
at $4.00 minimum charge with 50¢ for each fixture over twos a
connection fee of $100,00 to be paid prior to the issuance of
the building permit on ~11 new construction six months after
sanitary sewer service becomes availableo Mro Archie moved
Ordinance 65-28 be passed from first' to second reading° Mr. Banks
seconded. It was p~in~ed Out that motels mhd hotels were class-
ified under commercial rates.
Discussion was held as to whether or not the minimum sewer
rates charged resident&alS could be reduced by means of charging
vacant property own:ers for the availability of the sewer at a
rate of $2.00 per month. Upon a call for the motion~ the motion
carried 3-2- AYES: Messers. Banks, Archie and Mahoneys NAYES:

Resolution 65-BB - Amending Water Pmtes
~r. ~oore read Resolution 65-BB whicla amended water rates
in that users of over 35,000 gallons would pay 20¢ per thousand
gallons instead of the present 6~ charge applied to all over
$5,000 gallons. ~r, Archie moved that Resolution 65-BB be
adopted. ~r. Madsen seconded. Motion carried 5-0°
Stud~ to Determine Feasibility of Vacant Property Sewer Charge
Mr, Boos stated that he and Mr. Banks had attempted to
ascertain by a survey how much vacant property located within
the City was sewered~ and that it was his opinion that since
the value of this property had increased due to the availability

of sewers that the property owners should help pay for the
indebtedness. Mr. Banks said that he ~-zould like to have the
Council authorize a study by Russell & Axon to see if this
was feasible. The Council agreed to meet ~th I~lr. Osteen of
Russell & Axon in regard to this study. Mr. Osteen was expected
in the City the next week.
Ordinance 65~29-- Declaration of Intent to Annex Property in
Trade Winds Estates
~r. Moore read Ordinance 65-29 ~-;hich declared the intention

~r. Harry LeFort questioned the Council regarding the
recently enacted sewer charges. Mr. Thomas Wagenhausen asked
about the ordinance dealing with parking of trucks on private
property.

Sro Donald ~cKone of 718 Shore Drive requested Council
assistance with regard to the conditions existing at the site
of the construction of the flood gates on the Boynton Canal.
He noted the repeated breaking of promises and disregard for
the welfare of the people in the area by the contractors. He
asked that the City mere against the contractors, Mr. Archie
moved that the Council authorize the City Attorney to make
every effort that he could to investigate arid bring back to
Council his recommendations as soon as possible. Mr. ~iadsen
seconded. Motion carried
~r. Banks called the Council's attention to the need to
up-grade S~ra Simms Memorial Gardens ar~lBoynton Beach Memorial
Pa rk, as recon~ended by the C~metery Board. He read a
letter from the Civic Improvement and Beautification Committee
which recommended that the cemetery be up-graded and put on
a self-sustaining basis.
~;z~. Banks also called the Council's attention to a peti-
tion from the residents of N. We 10th and l~th Avenues regard-
ing the old City dump and requesting that the area be cleaned
up° The City Engineer was asked to continue in his efforts
to clean up this area.
