5 AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
6 FLORIDA, AUTHORIZING ABANDONMENT OF EXISTING
7 UTILITY EASEMENT RIGHTS WITHIN A RESIDENTIAL
8 ACCESS ROADWAY - TRACT R-5 LOCATED WITHIN THE
9 FLAVOR PICT TOWNHOMES PLAT RECORDED IN PLAT
10 BOOK 121 PAGES 193 - 201, SUBJECT TO STAFF
11 COMMENTS; AUTHORIZING THE CITY MANAGER TO
12 EXECUTE A DISCLAIMER, WHICH SHALL BE RECORDED
12, WITH THIS ORDINAN IN THE PUBLIC RECORDS OF
14 PALM BEACH COUNTY, FLORIDA; AND PROVIDING AN
15 EFFECTIVE DATE.

17 WHEREAS, the owner/ developer, is requesting the abandonment of an existing
18 utility easement recorded within the Flavor Piet Townhomes Plat on July 7, 2016, in Plat
19 Book 12 Page 193 — 201 of the Public Records of Palm Beach County; and
20
21 WHERE the Owner/developer intends to replat this section of the
22 development upon finalizing the acquisition of the abutting landscape nursery property to
23 the east; and
24
25 WHEREAS, the developer will re-dedicate City of Boynton Beach utility
26 easements associated with the re-platting of this Townhome Development; and
27
28 WHEREAS, comments have been solicited from the appropriate City
29 Departments, and public hearings have been held before the City Commission on the
30 proposed abandonment; and

32 WHEREAS, staff finds that the - utility ea-semera no longer serves a public
33 purpose, and the City Commission adopts that finding.

35 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
36 OF THE CITY OF BOYNTON BEACH, FLORIDA THAT:

38 Section 1. The foregoing Whereas clauses are true and correct and
39 incorporated herein by this reference.

41 Section 2. The City Commission of the City of Boynton Beach, Florida, does
42 hereby abandon an existing utility easement recorded within the Flavor Piet Townhomes
43 Plat on July 7, 2016, in Plat Book 121, Page 193 — 201 of the Public Records of Palm
44 Beach County, subject to staff comments. The property being abandoned is more
45 particularly described as follows:
