PLAIN, CITY ~NAGER GENE ~00RE, CITY ATTORNEY TEREESA PADGETT, CITY CLERK Mayor Nahoney called the hearing to order with approximately eight five people in the audience. PUBLIC HEARING The public hearing was called to consider six proposed B amendments to the Charter of the City of oynton Beach to be sub- mitted to the 1988 session of the Florida Legislature. 1. Special Act amending Section 7(12) of the City Charter to provide authority for City to grant exclusive contracts for sewage and garbage disposal. ~fr. Noore explained that the amendment would allow the City to grant exclusive contracts. The Charter now allows the grant- ing of non-exclusive contracts. This amendment would afford addi- tional protection so that private concerns could not come in and make contracts ~ th individual businesses to pickup garbage. It was drawn primarily for garbage, but, since garbage end sewage are Under the aame classification in the Charter, it would also hold for sewage. Several citizens questioned the Council for clarification of the proposed amendment and lauded the present garbage service in the City and voiced objection to letting contract, or contracts, to iudividual~compan~es. These were Nfs. Emmly Jackson, 728 N.E. ~th Aven~e, Nr. Hay Senkpiel, and Mr. H. H. Yoangjohn, 815 Chapel Hill Blvd. ~r. Donald ~ard spoke in favor of the amendment. ~. SPecial Act to amend certain portions of Sections ~9, 80 and 81 ~f the City Charter, providing for appointment of Chief of Police and Police Officers of the City by the ~ayor, end to delete certain provisions providing for control of the Police and Fire Departments by the ~ayor. These provisions are now obsolete, inasmuch as the City has previously adopted a merit system and a City ~anager form of government. Nfs. Jackson questioned the Council as to whether or not, with this amendment the Council would still have the final word on who was sdopointed Chief of Police. She was assmred that the Council would. There were no objectors to this amendment. -1- ~ I N U T E S PUBLIC HEAE~G and SPECIAL ~ETING City Council, Boynton Beach, Fla. February 8, 1968 8:00 p.m. ~. Special Act to amend Section 53 of the City Charter to provide for election cf ~ayor and Vice ~yor by members of the City Council at its organizational meeting in January of each~ar. This amendment will become effective in January 196~ and will in no way affect the term of Walter A. Nadsen, who was duly elected ~1ayor for the year 1~88, under the provisions of the existing charter. ~Irs. Emily Jackson obJ~ected to this amendment, stating that she felt the present system should be given a longer trial. l~ayor Mahoney explained the Council'S reasons for the amend- ment, stating that the Council felt that the present system had caused a great deal of one-shot voting in the past. Others objecting to the amendment were Mr. Harry LeFort, 725 Ocean Inlet Drive and Mrs. Eathleen KirSch, 603 N. Seacrest Blvd. Mr. George ~iles stated tha$ he was in favor ~f leaving Section 53 the way it ~as; however, if it were put to a vote the people, he would go along with the outcome. of ~r. Donald Nard asked Nr. ~adsen if he was in favor of this amendment. ~r. Nadsen said that he would like to s~e Section 5~ stay the way it was. ~r. Banks stated that he was in favor of the amendment for the reason stated by ~ayor Nahoney, that is, one-shot voting. However, he realized that there were a lot of pros and cons to this type of election DUi since the position of Nayor was, with the City ~nager form of government, more honorary than anything else, he felt that it would be ~etter ~o let the Council go ahead and select the ~ayor from among themselves. Nfs. Howland, 1819 N. E. 3rd St., asked Council how the present system was harming the City. ~ayor ~ahoney explained that when you have a candidate that works very hard for the high spot in the voting and then have a man who comes in second with very few votes difference and the high mmn had the most number of votes because of single-shot voting, the election is not as fair as it would have been, had people not single-voted for only one man in order to ma~e him ~ayor. ~. Special Act to amend Section S5 of the City Charter to ~rovide for salary of City Councilmen in an amount not to exceed $180.00 per member per month with the ~ayor to receive no addi- tional compensation because of his office, together with further provision to increase said salary an additional $100o00 per mem- ber per month, subsequent to approval of f~eeholders voting upon the issue of such increase at a special or general election. -2- I~IN UT E S PUBLIC HEARinG and SPECIAL NEET!NG City Council, Boston Beach, Fla. February 8, 1985 8:00 P.~. Mrs. John Stewar~, 1512 N. E. 2nd Ct., asked the Council why they had asked for such a large increase. ~ayor N~honeyexplained that the Council was only getting $50.00 at present, the amount of money handled and commensurate salaries in other municipalities, Y~ answer to ~s. Stewart's question as to where the money would come fhom, ~ayor N~?ney stated that the budget this past year was underspen9 by $64,000.00. ~r~._~Emily ~ackson spoke against the amendment, stating that she felt ~ne 200~ increase was too much, that it had been turned down in 1981 and in 198~. ~r. H. H. Youngjohn asked how much the salary increase would increase taxes. Nr. Archie said that it would amount to 1/8 of a mill and on a $10,0OO home this would amount to $1.~0 a year. Nm. ¥oungjohn also stated that he had no idea how small an amount the Council received and felt possibly other citizens may not know either. Nr. Albert ~ehrell stated that he felt that t~e Council was asking for too much although he felt that they were entitled to more than they were getting at present. Nfs. Edith Latcham asked the Council what thei~ fringe benefit~ were. ~ayor ~ahoney asked to what she was ~eferring. Nfs. Latcham did not answer the question. ~r. Donald ~ard spoke in favor of the amenmment. 8. Special Act amending Section 8~ of the Cit~ Charter to allow for adoption of budget and setting of annual millage rate on or before the second ~onday in September of each year. Nr. ~oore explained that this amendment was proposed to give the City personnel an additional working time. As ~he Section is now worded, the budget has to be presented "on the second Nonday ~n September of each year." The new wording would ~imply be on or before the second Nonday in September of each year." Ers. Emily Jackson asked if a specific time period could not be indicated so that the public could have assurance that it could not be slipped in in the summer when many people were away. Nr. George ~iles stated that he was in favor of the amendment as it would probably save the city money in the long run by not requiring personnel to work overtime. Nfs. Kay Flock, former city employee, stated that from her experience as Tax Assessor, she would certainly approve of the amendment. Mr. MOore explained that possible amendment to existing annexation procedure was an item that would have to await the final outcome of pending litigation. Due to recent court rulings, the whole question of municipal annexation was in a state of flux. SPECIAL ~EET ING The Council agreed to go into special session to act on the five amendments to the Charter as heard in the public hearing, to be submitted to the State Legislature. Mayor Mahoney requested r. Ka~n to prepare the proper notice for Council signature for 9:10 p.m. Monday, February 8, 1965 for the special meeting. Nr. Madsen moved that the five amendments as submitted to the public hearing be approved by the City Council and that the City Attorney be instructed to prepare them and submit them to the Florida.
