17-019 / 1 / ORDINANCE NO. 17-019 i 2 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, / 3 FLORIDA, AMENDING CHAPTER 10 OF THE CITY'S 4 CODE OF ORDINANCES, "GARBAGE, TRASH AD , 5 OFFENSIVE CONDITIONS," ARTICLE II, "REFiy E, 6 GARBAGE AND TRASH" ALLOWING FOR SOLID 7 WASTE RATE- INCREASE; PROVIDING-' FOR 8 CONFLICTS, SEVERABILITY, CODIFICATI'N AND 9 AN EFFECTIVE DATE. /// 10 WHEREAS, the Public Works staff has conducted a%ursory review of the Code of 11 Ordinances, Chapter 10, Garbage, Trash and Offensive C iditions and has proposed minor 12 revisions to the Code language; and 13 WHEREAS, the rate increase proposed is eeded to continue to maintain sound 14 operations due to increased fuel costs, increased/equipment maintenance expenditures and 15 added residential communities; and / 16 WHEREAS, the City Commission finds the adoption of the proposed ordinance is 17 in the best interest of the health, safety, and/welfare of the citizens and residents of the City of 18 Boynton Beach. /' 19 NOW THEREFORE,IT ISIEREBY ORDAINED BY THE CITY COMISSION 20 OF THE CITY OF BOYNTON BEACH FLORIDA, THAT: / 21 Section 1. Each ')Vhereas" clause set forth above is true and correct and 22 incorporated herein by this/reference. 23 Section 2. /Chapter 10, Garbage, Trash and Offensive Conditions, Article II, 24 Refuse, Garbage a/Trash, is amended as follows: 25 / . 26 OTICLE U. REFUSE, GARBAGE AND TRASH* 27 / . 28 ... 29 / 30 Se V10-30. Rates and charges for City service. 31 /he rates and charges for refuse collection service provided by the City shall be as follows: 32 ' (a) Commercial containerized, excluding multifamily residential units: 33 � (1) Monthly commercial charges shall consist of a total of the following three (3) items: 3 a. Rental charge.- The charge assessed to account for expenses related to the provision 36 ofof commercial refuse containers. Disposal charge-A fixed disposal charge as set and modified from time to time by 38 the Palm Beach County Solid Waste Authority. This price shall be passed on to the customer 39 directly. 40 c. Operating charge-A fixed charge per cubic yard to cover all other labor and 41 equipment hauling expenses and charges of the Solid Waste Department. The rate in 2014 - 42 2015 will be fixed at four dollars ($4.00) per cubic yard and shall be increased,annually 43 thereafter based upon changes to operating expenses at the discretion of the P lic Works 44 Director at the beginning of each fiscal year, or as otherwise provided by th City 45 Commission. 46 (2) Partial monthly service will be charged on a prorated basis, bas d on the rates in 47 subsection (la.) above. 48 (3) Mechanical compressed or compactor refuse shall have the isposal rate computed at 49 a three-to-one (3:1) ratio of the disposal rates set forth in subsecti/n (lb.) above. Containers 50 with compactors shall be furnished by the owner, therefore, no rental cost shall be charged. 51 (b) Noncontainerized commercial service: Refuse picked P from residential type cans at 52 commercial establishments shall have their level of service egotiated by the Public Works 53 Department. 54 (c) Collection rates: 55 Residential Multi-Family FY 2013-14 $14.00 $10.75 FY 2014-15 $15.00 $11.75 FY 2015-16 $16.00 $12.75 FY 2017-18 $17.00 $13.75 FY 2018-1.9 $18.00 $14.75 56 57 (d) Roll-off rates. Rates for .11-off dumpsters for construction and demolition debris shall 58 be established and modified f .m time to time by the Director of Public Works based upon 59 private markets conditions. 60 61 62 63 Section ..
