This meeting was called to order by Mayor Archie at 7:30 p.m,
Councilman Summers led the Flag Salute followed by Invocation given by Vice
Mayor Banks.
Mr. Madsen moved the Minutes of Regular Meeting, July 15 and
Special Meeting-July 24th be accepted as ~vritten. seconded by lVir. Summers and
motions carried. (On July Z4th rneeting Mr..Mahoney abstained from voting}
A4r. Mahoney moved that the City Manager be instructed to check the
possibilities of providing air conditioninE for the Civic Center and Senior Citizens
Building. Motion seconded by Mr..Summers and unanimously carried.
Mr. Banks moved that the City t~lanager be authorized to go out for bids
on subterranean 10" water main on Ocean Avenue and bids for two raw water wells.
Motion seconded by Mr. Mahoney and unanimously carried.
A letter of appreciation from the Jaycees in regard to City's participation
in,soap box derby was read by City Clerk.
Letters from the Shuffleboard Club and Castoff Square Dance Club -~vere
held in abeyance until the budget meeting.
Mr. Mahoney moved that the request of the American Legion be granted
to provide up to $250. for publicity at the American Legion Convention. Iviotion
seconded by Mr. Summers and uns~uimously carried.
In reference to Mr. Summers request to apply for Federal Funds for
vocational purposes to be used through the Recreation DeparTment, it was agreed
to have ~he City Manager check with the School Board and Federal Government
and report back to Council.
Legal:
ivir. Mahoney moved that the item in reference to abandonment of alley
Lot $ threugh 9, Block_Z, Ls~ke ~ldition be removed from the table, seconded by
1Vir. Summers and unanimously carried.
Tho City Attorney read l{esolution 63-II, a request £er vacating and
abandoning of a/ley and return to acreage on tax rolls.
1V~r..Summers moved Resolution 63-11 be accepted, seconded by l~r.
lV~ahoney inasrn~ch as a new 25~ r/w has been dedicated. 1Viotion carried
unanimous ly.
The City ~ttorney read by- caption only, Ordinance 63-Z 3 amending
Ordinance 6Z-9 authorizing conditional use of Sam Brown S/D on Lot 6.
l~[r. l~ahon0y moved the adoption of Ordinance 63-23 on second and
final reading, seconded by Mr. Summers a~d unani~nously carried.
l~ublic hearing was held pursuant to advertised notice relative to
approval of assessment roll on N,E~ 6thAve., N..E. 1st to N. E. 3rd Streets and
no objectors were present, iV~r. /Viadsen moved th~ ~ssessment roll be approved
and August 19th be set as~ the public hearing and that the City Clerk be authorized
to advertize. Motion seconded by Iv~r. 2~ahoney and unanimously carned.
The City Attorney read proposed l{esolution 63-NM regarding hiring
of department heads and administering of examination, tV~.~ l~ahoney moved that
l{esolution 63-KK be adopted, seconded by /Vfr. Bar,ks and unanirno~sly carried.
Mr. Banks moved that departmental reports be accepted, seconded
by 1Wit. Mahoney and unanimously c~rried.
Recess:
Public Hearingwas held in regard to zoning of Lots 5 and 6, B1. Z1,
Bowers Park and ~ one was present to speak for or against the request.
A/ir. Banks moved that this be referred back to zoning board and asked
that another recommendation be given and notify them that their recommendation
was inconsistent wvith the ordinance, tViotion seconded by 1Vir. 1V~ahoney and
unanimously carried.
In reference to the zoning reqt%est at 1518 S. Federal Hig~hway, Mr.
A4ahoney moved that this be referred back to the Zoning Board for a definite
recommendation on the parcel that is being requested and that it be wvithout a~y
other conditions attached to it. lv~otion was held in abeyance until those interested
parties spoke for or against this request.
Mr. McI<iinney representing Mr. William Fordon appeared in fa~or
of the reque st, stating they wanted to develop the land fo r a /~arina.
Mr. ~restphal, owner of property ~o the north ~ppeared in opposition
to the reques~ because he expects to develop his property in the same manner as

Lee l~anor Isles as soon as the sewer system is completed,
Emil Freund, P~iviera Drive. Lee Manor Isles, appeared in opposition
to the request~ He stated he knew what a A4arina can do to proper~y around it
because he had previously owned a Marina. He stated anytime a lift is permitted
it will be a commercial enterprise, and the proper classification would be a
boat yard.
Mr.~ lVitliarn Fordon stated he had the franchise for.a Chris Craft deal-
ership and he favored the requesT.
lvir. Lotto: owner of the land, favored ~he request.
l~everting back to the motion, Mr. Madsen seconded and the motion
carried unanimously to refer the zoning request of Mr~. Fordon back to Zoning
Board,
At the public hearing for paving assessment of Lawns S~D on equalization
of proposed assessment roll, there were no objectors. The City Attorney read Ordinance 63-24.
Mr~ tViadsen moved that Ordinance 63-24 be accepted on first reading,
seconded by Mr~ Banks and unanimously carried.
There were no objectors at the public hearing on pav~ng assessment
at ~ 13th St. between NV~ 7th Street and 7th ~ourt.'
