3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
4 FLORIDA, AMENDING ORDINANCE 02-013 TO REZONE A
PARCEL OF LAND DESCRIBED HEREIN AND COMMONLY
6 REFERRED TO AS OCEAN BREEZE EAST FROM MIXED USE -
7 LOW INTENSITY 2 DISTRICT (MU-L2) TO MIXED USE 2
8 DISTRICT (MU-2); PROVIDING FOR CONFLICTS,
• SEVERABILITY, AND AN EFFECTIVE DATE.

1 WHEREAS, the City Commission of the City of Boynton Beach, Florida has
12 adopted Ordinance No. 02-013, in which a Revised Zoning Map was adopted for said City;
13 and
14 WHEREAS, the City of Boynton Beach, owner of the property has made application
15 to rezone a parcel of land, said land being more particularly described hereinafter, from
16 Mixed Use - Low Intensity 2 District(MU-L2)to Mixed Use 2 District(MU-2); and
17 WHEREAS, the City Commission conducted public hearings as required by law and
18 heard testimony and received evidence which the Commission finds supports a rezoning for
19 the property hereinafter described; and
20 WHEREAS, the City Commission finds that the proposed rezoning is consistent
21 with an amendment to the Land Use which was contemporaneously considered and approved
22 at the public hearing heretofore referenced; and
23 WHEREAS, the City Commission deems it in the best interests of the inhabitants of
24 said City to amend the aforesaid Revised Zoning Map as hereinafter set forth.
25 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
26 THE CITY OF BOYNTON BEACH, FLORIDA,THAT:
27 Section 1. The foregoing Whereas clauses are true and correct and incorporated
28 herein by this reference.
29 Section 2. The land herein described be and the same is hereby rezoned from
30 Mixed Use-Low Intensity 2 District (MU-L2) to Mixed Use 2 District (MU-2). A location

3 map is attached hereto as Exhibit "A" and made a part of this Ordinance by reference. Legal
3 Description:
3 3 Lots 1 through 12, inclusive Block 1,PALM BEACH COUNTRY CLUB ESTATES,
34 according to the Plat thereof as recorded in Plat Book 11, Page 43, Public Records of
3 5 Palm Beach County, Florida, and the south half(S. '/2) of the east half(E. '/2) of Lot
3 6 2, Subdivision of the west half(W. 1/2)of the southeast quarter(S.E. 1/4)of Section 21,
3 7 Township 45 South, Range 43 East, according to the Plat thereof as recorded in Plat
3 8 Book 1, Page 4, Public Records of Palm Beach County, Florida, less the south 125
3 9 feet, thereof and less the right of way for Seacrest Boulevard as shown on Road Plat
4 0 Book 5,Page 182,Public Records of Palm Beach County,Florida.
41 Section 3. That the aforesaid Revised Zoning Map of the City shall be amended
4 2 accordingly.
4 3 Section 4. All ordinances or parts of ordinances in conflict herewith are hereby
44 repealed.
4 5 Section 5. Should any section or provision of this Ordinance or any portion thereof
4 6 be declared by a court of competent jurisdiction to be invalid, such decision shall not affect
4 7 the remainder of this Ordinance.
4 8 Section 6. This ordinance shall become effective immediately upon passage.
