18-004 1 ORDINANCE NO. 18-004 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING ORDINANCE 02-013 TO REZONE A PARCEL OF LAND DESCRIBED HEREIN AND COMMONLY REFERRED TO AS TIMELESS LIFE CARE AND 601 S. FEDERAL HIGHWAY FROM MIXED USE LOW INTENSITY 2 8 DISTRICT (MU-L2) TO MIXED USE 2 DISTRICT (MU-2); • PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN 1 s EFFECTIVE DATE. 1 1 WHEREAS, the City Commission of the City of Boynton Beach, Florida has 13 adopted Ordinance No. 02-013, in which a Revised Zoning Map was adopted for said City; 1 and 15 WHEREAS, the City of Boynton Beach has made application to rezone land, said 1. land being more particularly described hereinafter, from Mixed Use Low Intensity 2 District 1 (MU-L2) to Mixed Use 2 District (MU-2); and 18' WHEREAS, the City Commission conducted public hearings as required by law and 19 heard testimony and received evidence which the Commission finds supports a rezoning for 20 the property hereinafter described; and 2 WHEREAS, the City Commission deems it in the best interests of the inhabitants of 22 said City to amend the aforesaid Revised Zoning Map as hereinafter set forth. 23 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF 24 THE CITY OF BOYNTON BEACH, FLORIDA, THAT: 25 Section 1. The foregoing Whereas clauses are true and correct and incorporated 26 herein by this reference. 2 Section 2. The land herein described be and the same is hereby rezoned from 28 Mixed Use Low Intensity 2 District (MU-L2) to Mixed Use 2 District (MU-2). A location 29 map is attached hereto as Exhibit "A" and made a part of this Ordinance by reference. That the aforesaid Revised Zoning Map of the City shall be amended 51 accordingly. 52 Section 4. All ordinances or parts of ordinances in conflict herewith are hereby 53 repealed. 54 Section 5. Should any section or provision of this Ordinance or any portion thereof 55 be declared by a court of competent jurisdiction to be invalid, such decision shall not affect 56 the remainder of this Ordinance. 57 Section 6.
