The meeting was called to order at V:30 The Rev. Keith'Love, of the Presbyterian Church, Boynoon Beach gave the invocation. ~inutes of the last regular meeting, held December 2t, 1959, were read and unanimously approved with no corrections. D~ing the public half hour ~r. George C. ~iles from the audience asked to be recognized. He presented the Council with a letter addressed to tb~ Council~ which was read for the record. The letter requested that the City pay or caused ~o be oaid into the ~ater Revenue F~ud a sum equal to the amount paid out of the Water Revenue F~uud with interest sad tb~.t all tb~ Covenants of the Bonding Agreements be enforced. The letter also requested t~t all liens and enc~mberances except those established by th~ Bon~ing Resolution be made null and void. The writer stated that he was holder of ~ater Revenue Bonds dated l~/1/50 ~os. ~ and iEr~ Durkin moved that the letter and the legal opinion ~daich was attached be turned over to the new City Council. ~r. 0yet se~ nded the motion ~ich passed ~v. animously. ~ Eiles requested tha~ a copy of the letter be rmade a part o£ the minutes~ (Copy attached~) Recommendations of the Zoning Board which were tabled at the last regular meeting, were removed from the table by a unanimous vote of the Council~ l~r. 0yet moved that Lots 17, 18, 20 of Block E Hathaway Park be rezoned to light industrial. D~r. Durkin se~nded the motion which passed unanLmously. D~. Baugbanan moved that the Council deny the application for relieving the setback requirements for Lot l, Block 8, Central Park Annex. ~. Nadsen seconded the motion w?~ch passed unanimously. ~'Lr~, ~,~adsen moved that the application for rezoning to Commercial for Lots ~57, ~58, ~59~ Cher~y Rills be approved° ~m~. The Building Report -.o~ the month of December was read sno~mng a total Reconsideration on b._ds for Traxcavator Parts, Report on bids for i~fater Service Fittir~s, Cement Glaze Finish ~ w am_ the Casino, and bids _.or a p~p motor were referred to th~ new ~omnc!i by a unani- mous vote of the Council. ~. u~kmn moved that the ~ayor final plat on Vslaire Subdivision ~io ~ich passed unanimously, be authorized to sign the ~o 0yer seconded the motion The series of items listed on the agenda were referred to the new Council by a une~imous vote of the outgoing Council: Russell Axon, Chamber-of C o~w~erce, H~nicutt & Associates, Architect for Swi~uing Pool, Electrical Code, Railroad Crossings,.request for waiver of..penalty on ~ licenses, Tow~ o~ Oces_u Ridge~ petition and applications for Finance Director. The ~easurer~s Report was read by totals. Dr. Charles Akes and John L~ Archie recently elected Councilmen and Cotuucilman Martin Du~kin stepped down f~om the Council table. ~g~. ~adsen moved that all C o~mci~en be given their name pla~ues [~o Oyer seconded th~ motion wh_ch massed ~uuanimously, Er. Oyer took the Chair, and asked for nominations for the office of ~ayor. ~o Madsen nominated John Archis for Mayor. ?~r, Bau~n~an seconded the nomination. Mr. Archie declined the Mayorship stating that he felt that he would not at the present time be capable of being ~ayor~ Dr~ Akes nominated ~!r. 0yet for ~ayor and ~r. Archie seconded the motion. Mro Archie moved that nominations be closed. Dr. Akes seconded the motion which passed unanimously. Upon a call for a vote on the appointment of Mr. 0yet for Mayor, the appointment carried three to two, ~. Madsen and ~. Baughman voting no. For the office of Vice-Mayor, Dr~ Akes nominated Mro Archie. ~r. 0yer requested ~. Madsen to take the chair in order to second the nomination. ~. Bau~hman nominated Dr. Akes as Vice-Mayor. ~r. ~adssn seconded the nomination of Dr. Akes. Mr. Archie was elected to the Vioe-~ayorship by a four to one vo~e, ~, Baug~Iaan voting se~ted the following ~he~r own choice, ~=~ The Councilmen, by ~ ~ Boards to serve on: ~r. Baug~man Sanmta~mon~ Arehie - Streets and Parks & Playgro~uds, Dr. Akes - Water~ A list of proposed appointments for tb~ appointed officials of the City was given each Council member by Mayor Oyer. ~r. _~chme moved that Gene ~oore be appointed as Cit~~ iv~o. ney~ Dr~ Akes seconded the motion. Iv~o Baughman,.~.m)ovsd that Rona~d Fruda be appointed to the position. ~. ~adsen seconded the motion. Lengthy discussion as to the propriety of the appointment of a new City Attorney in view of the suits pending was held. Nr. Baughraan asked Nayor Oyer whether or not the appointments made at this meeting would be permanent. ~ayor Oy~r stated that he would ~eco~end all appointments other than the city Attorney and the City judge be.on a temporary basis. ~r. Baugb~nan requested that in voting for the Gmty ~t~orney tha~ ~r.~Fruda's name be called first. The appointment of M~. Fruda as City Attorney was denied by a three tO two vote, ~. Archie, Dr. Akes, and ~ayor 0yet voting no. The appointment of ~. Noore was approved by a three-two vote, ~.Nadsen and ~. Eaugb~nan v6ting no. · U~on a call for nominations for City Judge, ~V!r~ Baug~man nomznated Joseph Humpbm~ey$ ~m~. ~gadsen_ seconded the nomination. ~,~r. ~rchie .nominated Peter Van Vost; Dr, Akes seconded the . Van~ Vost was approved by a t~es to two vote, ~. ~adsen and ~. Baughma~u voting no. Mayor 0yet recommended to the Council that all other appoint- ments be o£ a temporary nature to await the hiring of a City ~anager ~dao, upon familiarization, would m~me recommendations to the Council regarding permanent appointments. ~r. ~adsen moved that all appointments be for one year, ~. Baughman seconded the motion. Upon a call for a vote, the motion was denied t~ee to two, ~r, £mrchie, Dfc Akes, a~. ~ayor 0yer voting no~ Thereupon, ~r~ Archie moved ~nat all the remaining dsp~tment heads be appointed on a temporary basis and that if a new City ~anager is hired that he be free to make recommsndations to the Council. Padgett be appointed Tax Collector, Mr~ Archie seconded the motion which passed unanimously, ~r. Arehie moved that ~rso Olive Cierpik be appointed as Finance Director. Dr, Akes seconded the motion, After discussion, ~, Baug~man moved that the nomination be tabled u~util the Council could go over the applications for Finance Dirsctor on hand. ~m. Dr. Akes seconded the motion which passed ~_nanimously, After discussion 'as to contrasting recommendations from Batsman & Jeffirss, s~s~ditors~ regarding administrative appointments~ ~ Baughma~ moved that the offices remain as they were last yesar, that being~ Mrs. ?adgett as City Clerk~ Assistant Treasu~er~ anm Tax Collector and. ~g~s. Cierpik as Treasurer, Comptroller, and Deputy City Clerk~ -~r. ~adsen seconded the motion which passed four to one~ ~. Oyer voting no. ~. Jo~hn ~. ~eterscn was nominated for Tax Assessor and Purchasing Agent bY Dr. Akes. i~. Baughman nominated ~rs. Katb~yn Hocbnnuth for the position. HoweverS after discussion as to~the duties he wOuld perform and the necessity of hiring ~r. Peterson and Hunnicu~t, Assoc. for the same year, ~r. Kathryn Hoc~muth be maintained as Purchasing Agent a~d Tax Assessor, and Assistant Tax Cei!ector. ~/~. Madsen seconded the motion. ~ayor Oyer sug- gested that t~e'Council d~fer action on the administrative appoint- ments and se~ up a meeting with Batsman ~ JefFries. ~r. ~dsen moved that ~he present a~inistrativs heads within the City Hall continue as actin~ in their i~esent c~pacit~ and that the Co~ci! set up a meeting wmth Batsman and Jeffrm'ss and make the appointments at a later date, ~. Bau~an seconded the motion which passed unan~ously. ~. Archie nominated lY~s~ Kath!een Kitten as Council Stenographer° Dr. Akes seconded the nomination. ~s. Kitten was appointed to the position by a unanimous vote. ~r. Baugb~an moved Supt. of Public ~orks. t~_~animous~yo that Mr. ~irck GrOOtenboer be appointed as ~Y~. ~adsen seconded the motion ~nich passed ~ayor 0yet, submitted the name of Jack Tuite for Fire Chief. Dr. Akes moved that Mr, Tuite be appointed Fire Chief. ~r. ~dsen seconded the motion which passed unanimously. >~, Baughman nominated~Ray Se~l~piel for Chief of Police. Mr~ ~adsen seconded the nomination. The appointment of,~r. Senkpiel for Chief of Police was denied three to two, ~,ir. Archie, Dr. Akes and Mayor ~zer voting no. Mayor 0yet submitted the name of Js~es Erwin for Chief of Police. Dr. Akes noz~nated James Erwin for Chief of Police. Mr. Archie seconded the nomination. Mr, Erwin was ~ppointed Chief of Police by a three to two vote, ~r, ~dsen ~nd ~. Baugbman voting no. ~. Archie moved that Mr~ Harold Building Inspector, ~{r. Leon Grom~mons, ~,~. '~. McKec~e, Pl~mbing Inspector. motion which passed unanimously. Bianchette be appointed Electrical Inspector~ and Mro ~adsen econded the t~r. ~adsen moved that the appointment of all the Boards be taken up on ~fednesday afternoon. Mr. Baugb~an seconded the motion which passed unamimously. The City Clerk brought to the attention of Council a request from Paul Eercer for use of the Cotuucil Chambers on January 12th at 8 P.I~. by the United Fund. ~r. Archie moved that the request be granted. ~r~ ~iadsen seconded the motion which passed unanimously. A letter was read from the Chamber of Cormmerce pledgir~ their support to the new City Co,3mcil. ~. Archie m~~ ed that a resolution be drawn up authorizing the signatures of the new ~!ayor and Vice-Mayor on checks drawn on City accounts° Dr. Akes seconded the motion which passed unanLmously. ~. :~cb~le move8 that the City Clerk be instructed to advertise through p~oper channels for a City Recreational Director, a City Engineer, and~a City Manager. Dr. Akes seconded tb~ motion ~nich passed unanimously.
