Minutes 10-05-59- MINUTES OF P~G[[LAR ~iEETiNG OF CITY COUNCIL OF' BOYN%ON BEACH, HELD IN cITY HALL BOTNTON BEACH, FLORIDA, OCTOBER 5th, 1959. PRESENT: James J. Nahoney, Mayor J. B. Bau~hmau, Vice-~Mayor ~artin ~rkin Walter Madsen Harvey Oyer Ronald Frmda, City Attorney Tereeea Padgett~ City Clerk Jack Tuite, Fire Chief F~ymond Senkpiel, Chief of Police DS_tek Grootenboer~ Supt. of Public Work The meeting was called to order at 7:40 P.M. Dr. C~orge Apel, South Side Baptist Church, Boyaten Beach, gave the invocation. ~inutes of the regular meeting of September 21st and ~pecial meeting of September 28th, were read and unanimously approved ~ith no corrections. Six bids were opened and read for the painting of "Beymton Bea&n'~ on the water tower. ~. Durkinmoved that they be referred to M~. Grootenboer to check the type of paint to be used by the three low bidders and report back to Couucil at the next meeting. ~r. Baughman seconded the motion ~.ich passed unanimously. Two bids were opened for a pumper for the Fire 0epartment. Mr. Dtu~kin moved that the City authorize the purchase of the pumper from Artex Fire Truck and Equipment Compauy~ .Ft. Lamderdale, Florida, in the amount o£ $7,251.15, with the allowance of $1,000 for the old equipment, making a total expenditure of $6~ 251o15. ~r. Madsen seconded the motion which passed unanimously. Mr. ~L~dsen moved that the Co~mcil authorize the transfer of $2,721.15 from the Seacrest bridge fund ~n this year's budget to the Fire Department account to msko the mecessary funds available for the purchase of this trmck. ~r. Durkin seconded this motion which passed unanLmously. T*o bi~s for insurance on the Recreation Building were opened and read. Mr. ~.dsen moved that the low bid, that of Seacrest Realty and Insurance in the amount of $487.1~ for a five year period, $105.90 for first year and $95.31 for each year thereafter, be awarded. Nr. Baugjaman seconded the motion which passed unanimously. One bi~ for r~bber r~umuers for the City Hall was opened and read from Province .~-k~niture, Ymc., Delray Beach, Florida. Totsl smount of this bid amounted to $483.00. M~r. ~mdmoved that the bid be awarded to Pro~nce Parnit~re in the stated amount. Mr. Durk~u. seconded the motion which passed t~animously, A letter ~s read from Earl G. Brown, of Gulf Oil Products, requesting that his company be given ~he opportunity to bid on furnishing the City's gaso~line requirements for a define~ period of time. ~a~ei2~ was read from the Supt. of Public Works recommending the bid procedure on oil projects be followed. ~M. Baughmanmoved that the Supt. ofP ublic Works prepare -1- specifications for bidding on gasoline and oil supply for the Cl y, giving minimum requirements, and that the City Clerk be authorized to ask for bids. Sir. ~adsen seconded the motion which passed unanimously. A letter was read from Chapel N~l - Mission Hill Assc. regarding proposed s~odivision known as Gol~ View Harbor and ~rg~ug the opening of GOlf Road before approval of this subdivision is given. A letter was read from Charles F. Gaffney, 3120 E. Atlantic Drive, City, thanking the City for fill. A letter was read free Renice M. Lansing~ Principal of Beynton Beach Junior High School, tharakimg the Police Department for patrolmen furnished at a recent athletic event. A letter was read from Joseph Tomberg, Attorney at Law, representing Boynten Development and Improvement Corp.~ requesting payment on a water refunding contract between his client and the City. l;.~r. F~ada stated that he had received a copy of the letter and had written to Mr. Tomberg regarding it. A letter was read from Royal Palm Village Assc. expressing appreciation of the installation of street lights in their section. A meetimg with the Advisory Board, sponsoring groups, and other interested persons, ~o discuss the report to be submitted by bhe Advisory Boar~ on the financing and cost of the four items to be placed on referendum vote, was scheduled on Thursday, October 8th, at 7:30 P.M. ~Lrs. Padgett was asked to send letters to the sponsoring groups and associated Boards ad-~ising them of the meeting. ~Lr. Bau~nman moved that tentative approval for lot lay-out o~ly be given th Consolidated Development Corp. for Golf View Harbour Subdivision, ~bject to a contract agreement with them that they ~rlll bear the expense of paving GOlf Road to make it a through street from its present termiuus to Ssacrest Blvd. l;~_r. Eadsen seconded the motion. ~r. ~rkin expressed dissatisfaction ~th the plat, in that there was no par~ indicated in the middle of the enb- division, that thirty lots to the south were not divided. Mr. 0yer was assured that the roads running to the south of the property connected up with other property in which right-of-ways were dedicated. The motion that tentative approval for lot lay-out only be given passed four to one, ~. Durkin voting ~o and stating that he voted no as he believed that the plat lay out was not in the best interest of the City or for the future residents of the area. Mr. Oyer moved that a review of garbage tax schedule as submitted by b[r. Grootenboer, be adopted effective the first of November~ 1959. Mr. ~dsen seconded the motion which passed unanimously. Lu regard to metered water by fire hydrants~ Mr. Baug~bs~an moved that a charge of $5.00 be made for installing the meter plus the actual cost of the water metered. 1~. M~dsen seconded the motion which passed nnanimouely. -2- The Building Report for the month of September, 1959, was read. Total building for the month was $997,9~5.O0. The Tax Collectors Report was read. The ~Iayor brought to the attention of Council the request by the Chamber of Commerce for $2500 for the purpose of promoting the armual fishing tournament, made at a meeting held with the Chamber of Commerce, on September 30th. Mr. Baugh;man moved that the City earmark $1500 from the publicity budget of 1959-60 to the Chamber of Commerce for a fishing tournament, pro- vided the Chamber of Commerce match the sum. Mar. ~adsen seconded the motion. I~r. Durkin moved the motion be amended to the effect that $2500 be awarded to the Chamber not requiring any particular matching terms. Mr. Oyer seconded the amendment which was d~-~nied three to tw~, Nr. Bam~bman, Mr. Nadsen ~.~d Nayor M~ahoney voting r~. Er. Oyer then moved %hat the restrictive clause be stricken from the motion. Mr. Durkin seconded; the motion was defiled three to two~ Mr. Baughman, ,Mr. M~dsen and Mayor l~ahoney v~i~.'~g no. Reverting to the original motion by Er. Baughman that the City earmark $1500 from the publicity budget of 1959-60 to the C~am~er of Commerce for a fishing tournament, provided the Chamber of Commerce match the s~m, the motion passed fear to one, Mr. Durkin voting no and stating that he voted as he did because of the restrictive clause in the n~tion. Mr. Oyer stated that he had voted for the motion as he wamted above all the Chamber of Commerce be given the opportunity of having the tournament. Eayor ~ahoney stated that he voted for this particular amouut as he had had a recent communication from the Attorney General of the State of Florida ruling that ia order t~ levy a publicity tax onall the people, all the people must benefit in some way from monies collected by the City for p~ablicity purposes amd the Publicity Fuad should cover as wide a field of publicity as possible. A letter of recommendation from ~pt. of Public ~orks on the awarding of the ~ell and Pu~p bid at the new city dump was read. Mzr. Grootenboer recom- mended that the hid go to D&C Well Drillers, at a price of $276.00, which included $1.65 per lineal foot for the well s~nd $177.00 for the pump. Mr. ~yer moved that the Comucil follow the recommendation and award the bid to D&C 'gell Drillers. Er. N~adsen seconded the motion which passed unanimously° Two requests for installation of t~mporary septic tanks in Rolling Green Ridge were brought to the attention of Council. Mro Oyer moved that Carroll Builders request for five septic tanks be granted. I~aro Madsen seconded the motion. ~ro Oyer further moved that the request of Cofteld, !nc.~ for one t~uk be granted. Er. Eadsen seconded the motion which passed muanimously. Mr. Tuite, Fire Chief, gave a talk on Fire Prevention week starting October 4tho The Counc~_l scheduled ~ednesday, October 7t~h at l:OO P.Mo to go through the new Recreation Building in order that it could be formally accepted. Thsre being no further business the meeting was adjourned at 10:20 P.M.
