Roy, of the First Eethodist Church, Boy~ton Beach, gave the i~vocatieno The minutes of regular meeting, Au~ast 17th, were read and approved with no corrections. Minutes of special meeting, August 22nd, were read and approved with no corrections. During the public half hoar Mr. William Eiller asked the Council for final approval on his plmt for Sky Ranch Estates. Nr. Grootenboer, Supt. of Public Works, informed the C~ancil that he could not recommend final approval he given due te the fact that the north half of S. E. 31st Avenue had been laid on a wet Discussion on this was iaterrup%ed for the opening of bids at 8:00 P.M. One bid for sprinkler system for Sara Siren's Memorial Gardens was opened and read. The bid, from J. P. Carroll, Inc., West Palm Beach, Florida, was in the amount of $1,645o00. Nr. 0yer moved that the bid be awarded to J. P. Carroll, low bidder. Mr. Durki~ seconded the motion which passed unanimously. Two bids for the paving of roads in Boynton Reach Memorial Park were opened and read. Mr. Durkin moved that the bids be turned over to Nr. Grootenboer and Mr. Madsen to go ever and briug back recommendations to the Council as to the appropriate surface to use and the low bidder. Nr. Oyer seconded the motion which passed unanimoasly. Returning to t~e discussion on final approval of the plat for Sky Ranch Estates, at the recommendation of Mr. Grootenboer~ Mr. Madsen moved that the approval of Sky Ranch plat be tabled ~ntil a bond has been posted by Fw. Miller te cover the north half of 31st Avenue for a period of two y~ars, the bond to be approved by the City Atterney. Mr. Baughman seconded the motion ~ich passed unanimously. Mr. Durk~n moved that the Fmyor be authorized to sign the p~at of Sky Ranch Estates, swhjec% to the City Attorney's approval of the bond w~ich is to be placed on the north half of S. E. 31st Avenue. Mr. BauEhman seconded the motion which passed mnanimeusly. Mr. Joseph Humphreyj Attorney-at-Law, reqmested that the Council write to the County asking them te deed a fifty-foot right of way at the north City limits to the City in order that his client, Mr. Visconsi, owner and builder of a new -1- shopping center to the south~ c~ld deal with the City regardi~ the installa- tion ef the read ~d~d the rsilroad crossing te the Federal Highway. Further stating that his client was willing Se pay for the installatie~ of the 800 feet ef read and the crossing. Er. Oyer moved that the matter be tabled autil September 14th. Mr. Durkin seconded the motion which was denied three ~o two~ Er. Baughmam, Er. Er~ Durki~ later in the meeting asked that the record show: that he voted for the motion on t~ he confer with hie ~en the road on. side amd A letter ~as read from the Boy, ten Yom~h Association calling the Ceuncilts a%te~tion to the need for a Recreation Bmildiug amd Swimming P~ol for youth an~ ad-its and asking these be placed on a referendum vote in the December elec- tion. A letter was read from the Shuffle Board Club advising of the installation of the awnings ~d expressing appreciation therefor, T~o letters were read from Donald B. Clark~ regarding housewiring ~nd a claim against Inter-County Co~str~cti~ Co. The letters required no action by Council. A letter was read from Mr. and Mrs. Harvey H. Weber stating that their claims against ~oye Construction Ce. and Inter-County Construction Company had been settled. A letter was read from Kenneth H, Adams expressing appreciation for the filling in of the north end of his property. A letter from Mr. Grootenboer to the Junior Chsmher of Commerce regard- ing landscaping island dividers on South Federal Highway was read for the i~for- nation of the Council. A letter of appreciation was read from Loreece E. Cabaniss for the assis- tance given regarding school children protection. Ordinance 59-11 relative to the re-registration of voters, was read for a first reading. After dis~ussien~ Er. Baughman moved that it be passed to the second reading, ~-lth the recommendation of Er. Durkin that it be amended to include that the City Clerk shall have authority to determine ~ether or nor the sworn statemant by an ind ~vidual giving reasons why he was unable to re- register, ~as sufficient cause for not registering d~rimg the required period. ,~Vir. Madsen seconded the motion ~hich passed unanimously. ~. Madsen moved that the City Artery be a~thorized to employ ~_~ associate counsel for the purpese of defending the City in certain suit~ brought ags~t it by N. Re Field~ Hiatus Corporation and other individuals or corpor~ ations associated with Mr. Field. Mr. Baughman seconded the m~tion. Mr. Oyer moved that the motion be ~me~ded to the effect .that the City Attorney ~nd ~he associate counsel meet with the CoUncil regarding the advisability of these suits. Mr. Durkin seconded the amendment which was denied three to two~ Mr. Madsen, Mr. Baughman and Mayor M~oney voting no. ReVerting to the oriEl- ha! moti*n, the motion carried three to two, Mr. Oyer and Mr. Durk4.~ veti~ no. Ers. Kath~ Hochmuth, Tax Assessor, gave a breakdown of ~ig~res for the 1959 Tax R~ll for th~ 9i . ~mere were as follows: Assessed Valuation $53,~960,578~ Widow & Disah~]i~t~ Exemptions $83,000; Homestead Exemption $10,332,190; Totd~l men-Exempt $43,545,388. Mr. Madsen asked te be excused at 9:45 P.M. At ~ suggestion of the Nayer, Mr. Baughman moved that the Advisory Board be requested to study and report to the C.ouncil all facts perts~ug to the si~e, costs, expenditures, amd other facts pertLuent to the holding of a referendum vote on the four items requested by the people for referendum vote, namely, a public library, swimming ponl white section, swimming pool colored section, and reereatien center. Mr. Oyer seconded the motion ~hich passed UnanLmously. A license request by Flash Clearner & Laundry, Inc. for 614 N. Federal High~ay was approved by a motion by Mr. Oyer, seconded by Mr. Baughman unanLmously passed~ A license request for beer and wine served on premises and take-out for 1107 N. ~ ~%~ilroad Avenue was brought before the Council. Mr. Oy~r moved that it be tabled until the P~lice Department could make an investigation. _Mr. Baughman seconded the motion which passed unenimously. A license request for bar end package and a nightclub, by Jack Henderson at the location formally licensed as the ~zistle St~, N. Federal Highway, was presented to the Council. After discussien~ Mr. Oyer moved that a license be granted for a bar and package license only. ~ir. Baugkman seconded the motion ~hich passed unanimously. Mr. Oyer further moved that the City Attorney and the Chief of Police be requested to check with the ether commmnities nearby to ascertain their policies and advise the Council regarding changes necessary in the City ordinance en alcoholic beverages regulating the hours for opening and closLng and general improvements. Mr. Baugbm~ seconded the motion which passed unanimously° A letter was read from the Palm Beach County Health Department requesting space in the City Hall for a representative of their department. Mr. Baughman moved tha~t the request be granted. Mr. Oyer seconded the motion which passed ~uauimo~slyo A letter was read from the Plumbing Inspector asking vacation time and recommending Mr. ~¥ed Messer act in his absence. Mr. Oyer moved that the re- quest be granted and that Mr. Nesser serve as acting Plumbing Inspector during the absence of Mr. McKecknie. Mr. DurkLn seconded the motion which passed unmLimously. A report on Sanitation in the colored section from the Plumbing Inspector was read. Mr. McKecknie was thanked for his work in this cennection. A letter from the Civil Service Board was read recommending the City employ a qualified firm to establish a job classification, evaluation ~d salary schednle for the emplcyees of ~he City. A letter was read from the Florida East Coast-Railway Company relative te au attached agreement pertai~ te applicati°n to install a water pipe cross~ug at Mile Post 314 ~ 600 . Mro Durkin moved that the matter be tabled and that the ~yor study it and make a report at the next meeting. ~r. Bau~ seconded the motion which passed unar~imously. ~A letter was read from Hugh L. Baker askiz~ the Council to approve the erection of a 10-unit colored apartment b~ilding on Lots 17 aud 18 located cn N. E~ 10th Avenue. It was determined that the lots i~ ~uestion were zoned commercial amd the requested usage w~uld be upgrading and therefore permissible, M~. Oyer moved that the request be gra~ted. Nr. Baughman seconded the motion which passed unanimously. A report from _~ssell end Axon reg~di~g construction costs and disbm~seme~ts i~ counection with the sewer system was read. Nr. 0yer moved that a date be set up for a meeting with Mr. Fields a~d his attorney and the ~lty Council end City Attorney aud Associate Co~mse!~ with the idea of reaching au amicable agreement regarding the suit brought by Mr. Fields in reference to the sewer system° Mr. Durki~ seconded the motion ~ich passed unanimously. A letter was read from Palm Beach County E~gLueer relative to right-of-way map covering the relocation of State Road S-804, in which the City was asked to execute the enclosed utility ~greement ~d a resoluation authoriziug execution of the utility agreement. Mr. Oyer moved that the Nayor be a~thorized to exe~te these papers upon the approval of the City Attorney. Mr. Banghma~ seconded the motion which passed unanimously, The building report for the month of August was read and showed total b~ildinE permits issued as $692,637. Mr. 0yer moved that tentative approve2 be given to Velaire ~l plat. Mr. Durkim seconded the motion which passed unanimously. Mr. 0yer moved that the City Clerk be authorized to advertise for bids for insurance coverage on the sewer system as recommended by Russell & Axon end ~ alternative tc it for vandalism A~d malicious mischief. Durkin seconded the motion which passed unanimously. ~. 0yer moved that the Ccuncil declare the old dm~D officially closed effective September 15th and the new dump site officially opened on that date. Mr. D~rkin seconded the motion ~nich passed unauimously. Mr. Iku~kin moved that the City Clerk be authorized to advertise for bids fer the clearing and leveling of the old dump ~nder specification of Nr. Groote~boer. Mro Oyer seconded the motion which passed unanimously. The Fire Chief read a request for a new truck to use in comuectien with brash fires~ citing reasons for the need. F~. Oy~r moved that the City Clerk be authorized to advertise for bids for a l~ ten track fully equipped with the trade-ia of the present equipment, after specifications are received from Fire Chief Tuite. Mr. Baughman seconded the motion which passed unn~f~ously. Lu connection with the suspension of Captain KLtmger by the Chief of Police from the Police Department for failure to report back to w~rk, Mr. ~Oyer moved ~hat Oaptain J~les Klinger be advised that the City Council will meet in public hear~g Md that he may present any witnesses ~nd evidence in his behalf aud ca~ be represented by counsel. Mr. tk~rkin seconded the motion which passed three te one~ Nayer Mahoney v~ting no amd stating that he felt that this ~irst hearing should be private as it concerns iatra-city and'imtra-departmemtal busi- ness. Mr. Oyer moved that Allen Nyquist be appointed as trastee of the pension board of the Volunteer Fire Department for a period of two years. N~. D~rkin seconded the motion which passed u~anim~usly. A repe~ on the Boynton Beach Elementary School, East Building, from the Fire Chief was read. Mr. Grcotenboer reported to the Council the need of a well aud pump at the new dump site f~r use by the caretaker employed there. Mr. Oyer moved that the Supt. of Public Werks draw up the specifications and that the City Clerk be anthorized to s. dvertise for bids for a well aud p~mp t~ be installed at the new well site. Mr. Baughmau seconded the motion which passed unanimously. By a unanimous vote of the Council the Snpt. of Public Works was grauted five days leave without pay~ Mr. Oyer moved that the Snpt. of Pablic Weeks be authorized to have the b~ulldozer repaired. Mr. Bau~aman seconded the motion which passed unanimously.
