This being a continuation of the meeting of January 5th, 1959,
the Nayor opened the meeting with a welcome to all those present
in the audience end, an introduction of all the newly appointed
officers who were present.
A letter was read from Winfield H. Adams making application
for City Judge. The City. Clerk was asked to write him a letter
informing him that the position had already been filled and ex-
pressing regret that his letter was not brought to the council's
attention in time for consideration.
A letter was read from Ludick & Ritter~ Attorneys for J.
Richard Ogden, Jr., Architect, in reference to an additional
bill he holds against the City in accordance with his contractual
agreemen~o The letter was referred to the City Attorney for his
consideration so that he may advise the council as to whether
these additional ch~wges axe justifiable according to the contract.
A letter was read from No L. Doughty, Spbkesman for Parents
and others ~'~mvh~g'~ _~n Rolling Green$ another letter was read from
i. Eo Hamilton. of the F!ori~a East Coast Railway Company, both
in regard to protection of railway crossings in the City of Boynton
Beach. Nayor ~ahoney e~plained that according to an agreement
in 1952 with the Florida~East Co~st Railway Company that the City
will have to stand the expense of protection on the crossings
at No E. l~tn Ave., E. ~. z~n~ Ave., and S. Eo B~rd Ave. Nr-~ 0yet
told the CO~ucil t~at in his discussion with Er~ Hamilton on
December BTth that he understood that it would be agreeable with
the railroad company .f£ after crossing gates were installed that
the trains maintain a maximum sp~ed of fifty miles per hour° He
also informed the council of ~. Hamilton's wil!ingmess to meet
with the council and discuss the financing of the crossings for
which ~he City is responsible. ~r. 0yet recommended to the
Counc.~l th~t.they sst some time i$o discuss with ~r~ Hamilton

Upon a motion by Mr. Durkin, seconded ,by

Highway by the Holiday Gas Station was referred to the Wlarmin2
Board for their recommendations, with the Council,s rec~mmenda~ion
that Mr. Rowles, the.applicant, be invited by the Planning Board
to present his ~!ans'and proposals to them. The motion passed.

Mr. Oyer brought up the question of keeping the City Hal!
open on ~ednesday afternoon for the convenience of the oubllc.

Ur. Oyer further brought up the hiring of a City ¥~anager.
After much discussion, it was moved by Ufo Durkin, seconded~by
Ur. Oyer that this matter be turned over to the Advisory Board
asking that ~hey b~amn ~ leasv five applications for a Cl~y
Uanager and/or City Engine~er and report their findings to the
City Council~
Also referred to the Advisory Board for their recommendations
was the subject of natural gas which will presently be coming to
this area, possibly in June or July of this year. Possible actions
that the Council should take~incDGde~ granting franchise to a
private utility company,.going im the business of dispensing this
gas, the City's perogat~ve to own this facility ~nd lease it to
a private group~
After discussion as to the necessity of an audit for 1988,
it was moved by Mr. 0yer~ seconded by Mr. Baugb~an that the City
Attorney be instructed to write to the State Auditor and to the
Governer~s office, if necessary~ to in~aire into the C~verner~s
directive for a ten year audit and also if the last audit ~nich
took place for the fiscal year of 1957 would have to be incD~ded
and if it would have to inclqde the fiscal year of
Fruda was authorized to telephone the State Auditor.
~.~ug~ moved and Mr. Madsen seconded that a board of
volunteers be appointed for the purposes of purging the voting
lists of the City. The motion carried. Board members are as
follows: 5~rs. Paul Startzman, Chairman, Uts. Louise Lefort,
Mrs. George Latchum, Nfs. Thelma Bau~hman, Mrs. Walter Uadsen,
and Ers, William Daly°
Chief of Police Senkpiel requested authority from the Council
to employee Gane L~ Hu!tgren was one of two applicants who passed
the Civil Service examinati0n. It was pointed out that two new
patrolmen are included in this 'years ~mdget. Nrc Baugb~an moved
that the Chief of Police be granted this authority, ~r. Uadsen
seconded° ~otion passed.
~r~ John Tuite asked the Council to advertise for Civit
Service ex~ainations for additional Firemen. ~3rs. Padgett was
instructed to plac9 the necessary advertisements in the n~wspaper.
Two resolutions were presented to the Gouncil for their
approval and signature, ?egarding signature for Safety Deposit box
and signers on checks. Ur. Baug~man moved that they be approved~
~adsen seconded. The motion passed~
A resolution for the ~alary of the Chief of Police be
~200~00 per year was read for approva2. Mr. ~adsen moved that
it be approved~ ~r. Baughman seconded~ Uotion carried~
