R93-~ A RESOLUTION OF THE CITY CO¥~ISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN THE CITY OF BOYNTON BEACH AND PALM BEACH COUNTY HOUSING AUTHORITY (AUTHORITY) TO SECURE THE SERVICE OF POLICE OFFICERS IN THE VICINITY OF THE AUTHORiT¥'S PROPERTIES LOCATED ON NW 12 AND NW !3TH AVENUE; SAID AGREEMENT BEING ATTACHED HERETO AS EXHIBIT "A"; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Authority and the City are desirous of entering into an Agreement for the performance of certain enhanced law enforcement services and functions for the purpose of improving the safety and security of the Autho~ity's tenants residing in public housing units on N.W. 12 and N.W. 13th Avenues within the corporate limits of the City; NOW, THEREFORE, BE iT RESOLVED BY THE CITY COMMISSION OF CITY OF BOYNTON BEACH, FLORIDA T~AT: Section 1. The City Commission of the City of Boynton Beach h~reby authorizes and directs the Mayor and City Clerk to execute an Agreement between the City of Boynton Beach and Palm Beach County Housing Authority as attached hereto as Exhibit "A". WHEREAS the Authority wishes to contract with the City for the performance of certain enhanced law enforcement services and functions for the purpose of improving the safety and security of the Authority's tenants residing in public housing units on Northwest 12th and Northwest 13th avenues within the corporate limits of the City, and the City agrees to provide enhanced law enforcement services and functions, the Parties, intending to be bound, hereby agree as follows: 1. By entering into this Agreement, it is the Authority's intent to secure the service of Police Officers in the vicinity of the Authority's properties located on Northwest 12th and Northwest 13th Avenues for between__ and __ hours per It is the Authority's desire to have a high profile patrol to promote a higher degree of protection and security for the property, residents and users of the Authority's property. The City agrees to provide law enforcement services as prescribed by Florida Statutes and the Code of Ordinances of the City of Boynton Beach, Florida. 3. In order to provide these services, the City shall furnish and supply all labor and supervision necessary to accomplish the terms of this Agreement and equipment and supplies not otherwise provided for in this Agreement, which are necessary to perform the services required by this Agreement. 4. The activities of officers assigned to perform services under this Agreement shall be reported and documented and records will be maintained as required by the City and Florida Statutes. 5. The rendition of services, standards of performance, discipline of assigned officers and other matters incident to the performance of services and the control of police personnel assigned shall be within the sole discretion of the City. 6. The City is required, pursuant to this Agreement, to provide services of no less than __ hours per , or hours per day, days per week. Specific duty hours, daily manpower allocations and days of service will vary in 2 order to most efficiently achieve the purposes of this Agreement. Scheduling of police officers will be coordinated with the Authority's contract liaison. 7. The total cost to the Authority of personnel under this Agreement shall be $ The City shall submit monthly invoices to the Authority detailing the hours worked under the terms of this agreement. Amounts due under this Agreement shall be .payable on or before the 10th day of each month following the month in which the services are provided. If payment is not received by the last day of the month for which the payment is due, the contract shall be in default. 10. The Authority wilt expend funds for maximum of $10,550 and for supplies to a maximum accordance to its procurement policy. All equipment and supplies equipment to a of $ 1,117, in purchased by the Authority with the Drug Elimination Program Grant Funds will be the property of the Authority following completion of the Service Agreement. 11. The Authority acknowledges that the City is self-insured and accepts the levels of self insurance provided by the City. 12. To the extent permitted by law, the City agrees to indemnify and hold harmless the Authority from liability on account of any injuries, damages, omissions, commissions, actions, causes of actions, claims, suits, judgments and damages accruing, including court costs and attorneys' fees, as a result of services performed or not performed, or any negligent act by the City its agents, servants and/or employees, or any action arising out of the operation of this Agreement. 13. This contract may not be assigned or subcontracted to any other party by the City without the prior written approval of the Authority. 14. Notices: all notices required hereunder shall be in writing and shall be addressed to the following representative of the parties: 4 A. The authorized representative of the Authority is Barry F. Box 310, Boynton Beach, FL 33425. 15. This Agreement contains all the terms and conditions agreed upon by the parties. No other agreements, oral or otherwise, regarding the subject matter of this Agreement shall be deemed to exist or to bind any of the parties hereto.
