A RESOLUTION OF THE CITY COmmISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
URGING THE FLORIDA LEGISLATURE TO MAKE NO
CHANGES TO THE CONTRABAND FORFEITURE ACT
WHICH WOULD RESTRICT OR IMPEDE THE
ABILITY OF LAW ENFORCEMENT AUTHORITIES TO
CARRY OUT THE PROVISIONS OF THE ACT.
WHEREAS, there is a serious crime problem in the State of
Florida, including the large scale importation and sale of illegal
narcotics and attendant money laundering activities; and
WHEREAS~ there is a need for effective means of curtailing
and discouraging said criminal activity; and
WHEREAS~ civil forfeiture of property is a well established,
widely accepted, and effective means of deterring criminal
activity by depriving criminals of property used or acquired
through illegal means; and
WHEREAS~ the Florida Contraband Forfeiture Act Sections
932.701-707, Florida Statutes, was conceived with the intent of
assisting law enforcement in combating crime, and, was extensively
amended and reformed effective July 1, 1992; and
WHEREAS, civil forfeiture has proved to be a powerful tool in
combating crime and removing the profit incentive from criminal
activities; and
WHEREAS, the proceeds of civil forfeiture have been
effectively utilized in the past to provide funding and equipment
for the enhancement of law enforcement efforts; and
~EREAS, the Contraband Forfeiture Act has been used
responsibly and effectively by the law enforcement agencies of
this state.
NOW~ THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. The City Commission of the City of Boynton
Beach, Florida, urges the Florida Legislature to make no changes
to the Contraband Forfeiture Act as it is presently written.
Section 2. The City Commission of the City of Boynton
Beach, Florida hereby directs the City Clerk to forward a copy of
this Resolution to the appropriate Legislative delegation.
Section 3. This Resolution shall take effect immediately
upon passage.
