AN ORDINANCE OF TEE CITY OFBOYNTON BEACH, FLORIDA,
EXTENDING THE ~UNICIPAL TE~R~LITORIAL LIMITS OF SAID
~MUNICIPALITY BY THE ANNEXATION OF A CERTAIN UNINCOR-
PORATED TRACT OF LAND CONTAINING LESS THAN TEN REGIS-
TERED VOTERS, LYING CONTIGUOUS THERETO AND WITHIN
PALM BEACH COUNTY, FLORIDA, TO WIT: A PARCEL OF LAND
IN SECTION 5, TO~SHIP 46 SOUTH, RANGE 43 EAST, MORE
PARTICULARLY DESCRIBED HEREINAFTER; REDEFINING THE
BOUNDARIES, OF SAID CITY TO INCLUDE SAID~LAND; REPEAL-
ING ALL 0RDTNANCES OR PARTS OF ORD'INANcESINCONFLICT
HEREWITH; P~ROVIDING FOR AUTHORITY TO CODI'FY; SAVINGS
CLAuSE~ kN EFFECTIVE DATE, ZONING CLASSIFICkTIONS
AND FOR OTHER PURPOSES.
WHEREAS, the owner of the property more particularly
described hereinafter has heretofore petitioned the City Council
of the City of Boynton Beach, Florida, requesting the annexation
of certain property lying adjacent and contiguous to the terri-
torial limits of said municipality and within the same County
to the municipal territorial limits of said City; and
WHEREAS, said tract of land contains less than ten
registered voters; and
WHEREAS, all requirements of the Charter of the City of
Boynton Beach, Florida, and of the laws of the State of Florida,
relative to annexation of contiguous territory have been
complied with; and
WHEREAS, the City Council of the City of Boynton Beach,
Florida, deems the annexation of said land to be beneficial to
and in the best interests of the said City and the owner of said
land that said land be annexed and included within the municipal
territorial limits of said City;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1: That the City Council of the City of Boynton
Beach, Florida, hereby annexes the tract of land more particu-
larly described in the attached Exhibi~ A, which is made a part
hereof, t~ the municipal territoria~ limits of the City of
Boynton Beach, Florida.
Section 2: That the subject property is hereby zoned
R-1AA pursuant to the Master Zoning Code of the City of Boynton
Beach, Florida°
Sec~ien 3: That the territorial boundaries of the City
of Boynton Beach, Florida, are hereby redefined so as to include
the above-described property.
Section 4: Repealing ~rovisions: All ordinances or parts
of ordinance~ in conflict herewith are hereby repealed.
Section 5: Authority to Codify: Specific authority is
hereby granted to codify and incorporate this Ordinance in the
City's existing Code.
Section 6: Separability: Should
of this Ordinance or any portion hereof,
of competent jurisdiction to be invalid,
affect the validity of the remainder hereof as a whole or any
part hereof, other than the part declared to be invalid.
Section 7: Effective Date: This Ordinance shall become
effective in the manner and at the ~ime provided by law.
