AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA,
A~NDING SECTIONS 24 AND 25 OF ARTICLE II OF THE MUNICIPAL
CHARTER OF SAID CITY BY PROVIDING 'THAT THE AFFIRMATIVE VOTE
OF THE MAJORITY OF A QUORUM OF.THE CITY COUNCIL SKALL BE
NECESSARY T@ ENACTANY ORDINANCE OR AD~OP~ ANY RESOLUTION
AND THAT TWO'T~IRDS OF ~THE MEMBERSHIP OF THE CITY COUNCIL
SHALL BE REQUIRED TO ENACT AN ~M~RGENCY ORDINANCE, AND BY
PROVIDING~THAT ALL ORDINANCES OR~RESOLUTiONS PASSED BY T~E
CITY COUNCIL SHALL BECgME EFFECTIVETEN DAYS AFTER PASSAGE
OR AS OT~ERWISE~PROVIDED T~EREIN, AS 'AUTHORIZED UNDER
CHAPTER 166 OF THE FLORIDA STATU~ES ENTITLED "MUNICIPAL
E0ME 'RULE p~WERs ACT"; ~FURT~ER P~V!DtN~ .FOR AUTHORITY TO
CODIFY, SAVINGS' CLAUSE, F~EPEA~I~ PROVISIONS, AND FOR
OTHERPuRPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA:
Section 1: That Sections 24 and 25 of Article II of the
Municipal Charter of the City of Boynton Beach, Florida, be
and are hereby amended to read as follows:
"Sec. 24. Passage of ordinances and resolutmons--
Compulsion of quorum.
The majority of the members of the City Council shall
constitute a quorum, but a less number may adjourn from
day to day and compel ~_he attendance cf absent members
in such manner and under such penalties as shall be
prescribed by ordinance. The affirmative vote of the
majority of a quorum presenf shall be necessary to enact
any ordinance or adopt any resolution other than an
emergency ordinance. On final passage, the vote of each
member of the City Council voting shall be entered on
the official record of the meeting. Any proposed ordinance
or resolution shall be introduced in written or printed
form. No ordinance, except an emergency ordinance~ shall
be passed until it shall have been read at two meetings
not less than ten days apart, and the second rea~ing of
any regular ordinance may be by caption only. An emergency
ordinance may be passed upon reading at one meeting to
take effect immediately or at such time as shall be desig-
nated in the ordinance.
Sec. 25. Same--Emergency measures.
Ail ordinances or resolutions passed by the City Council
shall become effective ten days after passage or as other-
wise provided therein. Two~thirds of the membership of the
City Council shall be required to enact an emergency
ordinance. An emergency measure shall be defined as an
ordinance providing for the immediate preservation of
public peace, property, health or safety, or for the daily
operation of a municipal department; in any case, the
emergency shall be set forth and defined in a preamble
thereto. Ordinances appropriating money may be passed
as emergency measures, but no measure making a grant,
renewal or extension of a franchise or special privilege,
or regulating the rate to be charged for its services
by a public utility shall ever be so passed."
SectiO~ 2. Authori%y~tO COdify: Specific authority ~is
hereby granted to codify and incorporate this Ordinance in
the City's existing Code.
S~ction 3. ~eparability: Each of the provisions of this
Ordinance are separable, including word, clause, phrase or
sentence, and if any portion thereof shall be declared invalid,
the remaining portien shall not be affected but ~shall remain in
full force and effect°
Section 4. Repealing Provision: All ordinances or parts
of ordinances in conflict herewith are hereby repealed.
