O74-20ORDINANCE NO 74-20 AN 0RDINA~CEOF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING ORDINANCE NO. 62-9 OF SAID CITY BY GRANTING CONDITIONAL USE FOR CONSTRUCTION OF ADDITION TO RESTAURBiNTON PORTION OF LOT SIX, SAM BROWN JR.'S PAGEHYPOLUXO8 · SUBDIVISION, RECORDED IN PLAT BOOK ONE, 1, PROVI~DING FOR SAVINGS CLAUSE, REPEALING PROVISIONS, AN EFFECTIVE DATE AND FOR OTHER PURPOSES. WHEREAS, the owner of the property more particularly described hereinafter has heretofore filed an application with the City of Boynton Beach, Florida, requesting conditional use of subjectproperty for the construction of an addition to the restaurant facilities located thereon and has filed plans appurtenant thereto with the Planning and Zoning Board of said City, and the said Board has unanimously recommended the grant- mng of said conditional use application~ and WHEREAS, the City Council of the City of Boynton Beach, Florida, after having conducted a properly advertised public hearing relative the granting of subject application, deems it in the best interest of the public, and mn accordance with the general master plan of the City, that said conditional use be permitted; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE 2ITY OF BOYNTON BEACH, FLORIDA: Section 1: That a conditional use for the construction and operation of an addition to the restaurant facilities on the following described property is hereby granted: That portion of Lot Six (6), S~,~ BROWN JR.'S SUBDIVISION, as recorded in Plat Book One (1), Page Eighty-One (81), Public Records of Palm Beach County~ Florida, which is presently zoned ZONE R-3. property is therefor now on file Official. to be completed mn accordance with the plans mn the office of the City Buildin~ The official Zoning Map of the City of Boynton Beach, Florida, shall be amended accordingly. ~ectioq 2~ ~parabil~ity! Each of the provisions of this )rdinance are separable, including word~ clause, phrase, or sentence, and if any portion hereof shall be declared invalid, the remaining portion shall not be affected, but shall remain in full force and effect. Section 3. of ordinances in Section 4. ~epealing Provisions: Ail ordinances or parts conflict herewith are hereby repealed.
