AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING SECTION ~6-11.1 OF CHAPTER 26 OF THE CODIFIED
ORDI~$ANCES OF SAID CITY PROVIDING MORE. SPECIFIC PRO-
VISIONS FOR BILLING INTERIM SERVICES AND FACILITIES
FEE; PROVIDING FOR'AUTHORITY TO CODIFY, SAVINGS CLAUSE,
REPEALING PROVISIONS, AN EFFECTIVE DATE AND FOR OTHER
PURPOSES.
WHEREAS, the City Council of ~-b~-e City of Boynton Beach,
Florida, ~deems it necessary and advisable that Section 26-11.1
of Chapter 26 be amended as hereinafter provided:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1: That Paragraph (f) of Section 26-11.1 Interim
services and facilities f.ee is hereby amended to read as
follows:
"Section 26-11.1. Interim services and facilities fee.
(f) The administrative procedure shall be as
follows: As soon as a permanent, tempprary or partial
certificate of occupancy is issued, the building depart-
ment will notify the director of finance. In the month
after the issuance of the Certificate of Occupancy, the
director of finance will calculate the fee based on
one-half of one percent (1/2 of 1%) per annum of the
non tax-exempt building permit value of the new com-
mercial and/o~ residential construction, pro-rated
according to the number of months remaining to January
1st of the following calendar year. This amount is to
be billed to the property owner of record at the date
the Certificate of Occupancy was issued~"
Section 2. Authority to Codify: Specific authority is
hereby granted to codify and incorporate this Ordinance in the
City's existing Code.
Section 3. Separability: Each of the provisions of this
Ordinance are separable, including word, clause, phrase or
sentence, and if any portion thereof shall be declared invalid,
the remaining portion shall not be affected but shall remain in
full force and effect.
Section 4. Repealing Provision: All ordinances or parts
of ordinances in conflict herewith are hereby repealed.
