A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
BOYNTON BEACH, FLORIDA, AUTHORIZING AND DIRECTING
THE ~AYOR AND CITY CLERK TO EXECUTE AN AGREEMENT
BETWEEN THE CiTY OF DELRA¥ BEACH AND THE CITY OF
BOYNTON BEACH, ATTACHED AS EXHIBIT "A"; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Delray Beach and the City of Boynton
Beach desire to effectuate a trade, wherein the City of Delray
Beach will transfer to the City of Boynton Beach the "box" on its
1987 Fire Department Rescue rig in exchange for the 1988 Ford
Econoline Rescue rig with V8 engine owned by the City of Boynton
Beach.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH~ FLORIDA THAT:
Section 1. The City Commission of the City of Boynton
Beach, Florida hereby authorizes and directs the Mayor and City
Clerk to execute the Agreement between the City of Delray Beach
and the City of Boynton Beach~ attached hereto as Exhibit "A".
Section 2.

This Resolution shall take effect immediately

AGREEMENT AND GENERAL
This Agreement and General Release, is made this
/~- day of ~a-~=-//~-~ , 1992 by and between the City
of Delray Beach, Florida and the City of Boynton Beach.

WHEREAS, the City of Delray Beach is currently the
owner of a 1987 Fire Department Rescue rig, which is damaged
and determined to be "totalled" by the City of Delray Beach
Risk Management Division; and,
WHEREAS, the City of Boynton Beach owns a 1988 Ford
Econoline Rescue rig which no longer fits the needs of the
City of Boynton Beach Fire Department; and,
WHEREAS, the City of Delray Beach and the City of
Boynton Beach desire to effectuate a trade, wherein the City of
Delray Beach will transfer to the City of Boynton Beach, the
"box" on its 1987 Fire Department Rescue rig in exchange for
the 1988 Ford Econoline Rescue rig with V8 engine.
WHEREAS, the City of Delray Beach and the City of
Boynton Beach make no representations, assurances or guarantees
as to the mechanical condition and/or suitability of the
equipment for the needs of each other.
NOW, THEREFORE, for the mutual covenants and matters
set forth herein, as of the date set forth above, the parties
hereby agree as follows:

the above-stated equipment is to the mutual benefit of both
parties and make no other warranties or guarantees regarding
the fitness of. the particular property for its intended purpose
nor does it warrant that the vehicles or parts thereof, are in
mechanical or in otherwise sound condition.
3. Each party accepts the transfer of the equipment
"As Is" with no responsibility on the part of the other for
repairs or liability to persons or property that may arise from
any defects in the exchanged equipment, or the use thereof.
