Appointments to be made Commissioner Fisher requested a list of alternates on the advisory boards in case a Commissioner wants to promote someone to a regular position on a board. He also requested an updated talent roster list. · V.B.3. Presentation of certificates of completion to graduating members of the City's first City Services Institute It was noted that members of the team will assist the Mayor in the presentation of the certificates. VI.B.3. Rescind Bid #051-2710-01/C3D "ANNUAL CONTRACT FOR SECURITY OFFICER SERVICE FOR THE EZELL HESTER 3R. COMMUNITY CENTER, THE PUBLIC LIBRARY AND THE SCHOOLHOUSE MUSEUM," AWARDED TO Safeguard Group Holding LTD who subsequently is affiliated with VGI, Inc., in the amount of $36,036 When asked regarding this item, City Manager Bressner stated that this item will be m-bid and the odginal vendor could re-bid it, City Attorney Cherof said that the Commission does not have to accept the lowest bid, just the most responsive one. VI.B.6. Award the '"THREE-YEAR LEASE OF EIGHT NEW AND UNUSED VEHICLES," for the Citizens On Patrol program, Bid #009- 2110-02/KPv to SATURN OF DELRAY, for $28S~14 per vehicle per month, for an annual expenditure of $23,951.76 (Proposed Resolution No. R01-298) Police Chief Marshall Gage stated that the lease expires in December 2001 or 3anuary 2002. The lease is,less than what was budgeted and the City would be leasing seven vehicles rather than eight. Meeting Minutes Agenda Preview Conference Bovnton Beach, Florida November15,2001 · V/.B.8. Approve purchase of SUBMERSTBLE WASTEWATER PUMPS for the Utilities Department from ELLIS K. PHELPS & COMPANY of Riviera Beach, Florida on an as-needed basis, utilizing City of Boca Aaron contract #99-02S, with an estimated expenditure of $200,000 City Manager Bressner asked the Utilities Department to reevaluate the replacement cycle of the pumps with repair/refurbishment as an option. VZ.B.9. Approve the "SURPLUS VEHTCLE/EQUIPMENT LZST" as submitted by Public Works and allow for the sale of same (Bid #019-1411-02/KR) It was the consensus of the Commission that this item will be pulled for comment au the Commission meeting. VI.C.2. Proposed Resolution No. R01-300 Re: Approving Task Order #01-02 with General Engineering Consultant, Hartman and Associates, Inc., for an amount not to exceed $S7,0S0 to perform a hydraulic analysis of the Water Distribution System City Manager Bressner noted that it is good to have this analysis of the water system and it has not been oone for quite some time. Assistant City Manager Dale Sugerman said that the City would receive the report in 150 days. V1.C.6. Proposed Resolution No. R01-304 Re: Approving Change Order no. 2 (Final) from CDM Engineers & Constructors (CDM E&C) for the project Downtown Regional Stormwater Facility - Basin 1; and authorizing payment of 50% of the contract savings in the amount of $24,271.50 City Manager Bressner has asked staff to look at placing a fence near the pumping station so that people do not walk along the retaining wall. Vice Mayor Weiland asked whether aqua/dc vegetation was provided. Assistant City Manager Sugerman stated that it was provided by the contractor and he will ascertain the names and quantities of the plants. The contractor has met the landscaping plan, Vice Mayor Weiland said that there is standing water between the entrance to Mangrove Park back to the first cut into the parking lot of St. Mark's Church. Assistant City Manager Sugerman stated that the Utilities Department does not believe that this is the contractor's responsibility; however, the Utilities Department will solve the problem. He asked that this item be pulled from the consent agenda since a check will be presented to the City because the project came in under budget. 2 Meeting Minutes Agenda Preview Conference Bovnton Beach. Proposed Resolution No. R01-305 Re: Approving Addendum to Letter of Appointment for Doug Solomon, Technical Services Manager, Police Department, and authorizing the City Manager to execute the Addendum City Manager Bressner explained that for the above addendum and the other two on this agenda, there are no new vehicles beinc~ purchased. Two of them provide an automobile allowance and one is for an assignment of an existing vehicle. VI.C.10. Proposed Resolution No. 01-308 Re: Approving Amendment i to Project No. STM 007 with Kimley Horn and Associates for new additional engineering services for the East and West Industrial Avenue/Lake Boynton Estates Stormwater Improvements Project in the amount of $108,820 City Manager stated that this is a change order for the scope of work by the Consulting engineer. He said that much of the work was necessitated by design changes that resulted from community meetings. The engineer has performed the work and is entitled to payment. · VII.A. Status Report on Mangrove Park High School City Manager Bressner stated that staff has reviewed the latest proposal and has information 'egarding insurance for the building. Staff still believes that the building should be demolished. Quintus Greene, Director of Development, said that the Historic Society only provided a cost breakdown of major areas of work to be done and an architect's schematic drawing of how the building could be used. After some discussion, it was noted that Mr1 Greene will fax staff's report and the insurance figures to the Historic Society to offer them the opportunity to respond whether they are willing ant able to assume liability for the building. · VII.B. Report on Water Conservation Strategies City Manager Bressner distributee a water conservation strategies report to the Commissioners for their review, · VII.C. Redevelopment Code Issues for Non-conforming Lots and Buildings in Commercial Areas Since nothing was received from the Planning & Zoning Division regarding this issue, City Manager Bressner pulled the item from the agenda and will taIk with Quintus Greene & Mike Rumpf. Boulevard City Manager Bressner said that he was waiting for additional information from Bob Katz who is looking for some economic incentives regarding water and sewer capacity charges. This item will be pulled from the agenda. He will have something by the December 4th meeting. VIII.B. Project: Federal Highway Corridor Plan - Rezoning and Code Amendments Agent: City of Boynton Beach Location: Federal Highway Corridor segment between the Boynton (C-16) Canal on the NOrtf~, and Wo° bright Road on the South, and lying between the Intracoastal Waterway on the East, and the right-of-way of the Florida East Coast (FEC) Railway on the West Description: 1~ Proposed Zoning Regulations for Mixed Use and Mixed Use Low zoning categories, consistent with the recommendations of the Federal Highway Corridor Redevelopment Plan; 2. Rezone Area II! of the Federal Highway Corridor Redevelopment Plan from Central Business District (CBD) to Mixed Use (MU); 3. Rezone Area ~ and Area 1~/ of the Federal Highway Corridor Redevelopment Plan (excluding Boynton Isles and Lee Manor Isles Subdivisions) from Single,family Residential R-l-AA and R-l-A), Single- & TWo:fa. mily Residential (R-2), Multi-family Residential (R- 3)f Office[Pf°feSSional (C-1), Neighborhood Commercial (C-2), Community Commercial (C-3) and General Commercial (C-4) to Mixed USe-LoW (~MU-L) At the CRA meeting~ some concerns were raised by business owners regarding non-conforming uses and damage or destruction up to a certain percentage or interruption of business. City Manager Bressner suggested that staff compile a list of uses that were in the old classifications that would no ionger be allowed under the mixed use. There was discussion regarding an ,additional saving clause wherein an owner could rebuild with the same use after catastrophic destruction, City Attorney Cherof stated that it is best not to have a lot of conditions that are associated with non-conforming uses and their expiration. · IX.A. Review of Proposed Amendment to Development Agreement- Marina Project (December 4, 2001) City Manager Bressner said that he will know whether this item will be discussed on December 4~ after the meeting on Monday, 4 Meeting Minutes Agenda Preview Conference Bovnton Beach. Florida November 15r 2001 · ~C.C. Discussion Regarding Nonconforming (unpermitted) Canopies (December 4, 200:1.) City Manager Bressner is waiting for a staff report on this item regarding some comparable enforcement mechanisms elsewhere. He will attempt to provide a preview copy to the Commission. ~C.D. Public Hearing - 2002/03 Fire Assessment - Proposal to ][nclude in Uniform CoUection System (via County tax bills) in lieu of Local Collection for 2002-03 (December 4, 2001) This item will start the process of collection by Palm Beach County via the tax bills. There will be a proposed interlocal agreement for the County. This does not establish the rates. City Manager Bressner said that for this first year of the assessment, there will be an optional three-installment plan with a due date at the end of March. · 7~C,E. Discussion of Possible Corridor Study for Congress Avenue (December 4f 2001) City Manager Bressner stated that this item is specifically for the area south of Golf Road along Congress Avenue. The study will deal with proposed options for rezoning of the property and whether the City or the property owner will initiate the requests. · XT. New Business There will be an item entitled "Discussion of Proposed Ordinance Changes for CRA Staffing Options" added under New Business XT]LB.2. Proposed Ordinance No. 01- Re: Amending Chapter 2, Zoning, Section 11.H. (16)(1) to provide for legal non- conforming off-street parking for detached single-family dwellings in the R-l-A, R-1 and R-2 zoning districts City Manager Bressner pulled this item from the agenda pending review by the Planning & Zoning Division and the CRA. X[I.B.3. Proposed Ordinance No. 01-58 Re: Amending Chapter 26, Article lB/, Division 4, Subsection D, Section 26-143 Discharge of Restricted Wastewater as it relates to the Tndustrial Pretreatment Program by adopting by reference the local limits as set by the South Central Regional Wastewater Treatment and Disposal Board (SCRWTDB) Assistant City Manager Sugerman explained that the SCRVVTDB sets the disposal limits and through this ordinance, the City will use these limits by reference. 5 Meeting Minutes Agenda Preview Conference Bovnton Beach, Florida November 15r 2001 · Other City Manager Bressner informed the Commission that there may be police and fire pension amendments on a December agenda, Commissioner McCray asked why some items that are under Future Agenda Items are being carried over from one agenda to the next. City Manager Bressner explained that sometimes it is because of agenda planning and some things are beyond our control. He said that if a Commissioner sees something listed under Future Agenda Ttems and would like a pre-report, he will provide a draft to them ahead of time. Comm,~ssioner McCray asked why some trees were removed in the Cherry Hills section and Assistant City Manager Hawkins said that the trees were dying and people had knocked theft down.
