City to adopt rules of procedure. The city administration is hereby directed to adopt a rule or rules of procedure for the determination of a project under the Consultants' Competitive Negotiation Act and this article. These procedures may include: (a) Determination of a project which constitutes a grouping of minor construction, rehabilitation, or renovation activities. (b) Determination of a project which constitutes a grouping of substantially similar construction, reha- bilitation, or renovation activities. (c) The above rules of procedure and any amendments or dele- tions therefrom shall be submitted to the city commission for approval, which approval may be made by motion. As used in this article: Code inspector means those authorized agents or employees of the city whose duty it is to insure code compliance. Enforcement procedure. • (a) It shall be the duty. of the code inspector to initiate en- forcement proceedings of the various codes. (b) If a violation of the codes is found, the code inspector shall notify the violator, unless subsection (c) of this section applies, and give said violator a reasonable time to correct the violation. Should the violation continue beyond the time specified for cor- rection, the code inspector shall notify an enforcement board and request a hearing. The code enforcement board, through its cleri- cal staff, shall schedule a hearing, and written notice of such hearing shall be hand delivered or mailed as provided in section 281 to the said violator. At the option of the'code enforcement board, notice may additionally be served by publication or post- ing as provided in section 2-81. If the violation is corrected and then recurs or if the violation is not corrected by the time speci- - fled for correction by the code inspector, the case may be presented to the enforcement board even if the violation has been corrected prior to the board hearing and the notice shall so state. (c) If the code inspector has reason to believe a violation pres- ents a serious threat to the public health,safety and welfare,or if the violation is irreparable or irreversible in nature, the code inspector shall make a reasonable effort to notify the violator and may immediately notify the enforcement board and request a hearing. (a) Upon request of the code inspector, or at such other times as may be necessary, the chairman of an enforcement board may call a hearing of an enforcement board; a hearing may also be called by written notice signed by at least three(3)members of an enforcement board. Minutes shall be kept of all hearings by each enforcement board and all hearings shall be open to the public. Supp. No. 33. 231 §2-77 BOYNTON BEACH CODE The city clerk shall provide clerical and administrative personnel as may be reasonably required by each enforcement board for the proper performance of its duties. (b) Each case before an enforcement board shall be presented by either the board attorney or by a member of the building department administrative staff. (c) An enforcement board shall proceed to hear the cases on the agenda for that day. All testimony shall be under oath and shall be recorded. The enforcement board shall take testimony from the code inspector and alleged violator. Formal rules of evidence shall not apply; however, fundamental due process shall be ob- served and govern said proceedings. (d) At the hearing the burden of proof shall be upon the admin- istrative official to show by preponderance of the evidence that a violation does exist. Assuming proper notice of the hearing has been provided to the respondent, a hearing may proceed in the absence of the respondent. (e) At the conclusion of the hearing the enforcement board shall issue findings of fact and conclusions of law and shall issue an order affording the proper relief consistent with powers granted herein. The findings shall be by motion approved by a majority of those present and voting, except that at least four(4)members of the enforcement board must vote for the action to be official. An aggrieved party may appeal a final administrative order of • an enforcement board to the circuit court of Palm Beach County. Service of notices. (a) All notices required by this act shall be provided to the alleged violator by certified mail, return receipt requested, or by • hand delivery by the sheriff or other law enforcement officer, code inspector, or other person designated by the local govern- ment body, or by leaving the notice at the violator's usual place of residence with some person of his family above fifteen (15)years of age and informing such person of the contents of the notice. (b) In addition to providing notice as set forth in subsection (a), at the option of the code enforcement board, notice may also be served by publication or posting, as follows: (1) a. Such notice shall be published once during each week for four(4)consecutive weeks (four(4) publications being sufficient)in a newspaper of general circulation in the county where the code enforcement board is located. The newspaper shall meet such requirements as are prescribed under Chapter 50, Florida Statutes,for legal and official advertisements. b. Proof of publication shall be made as provided in Sec- , tions 50.041 and 50.051, Florida Statutes. (2) a. (3) Notice by publication or posting may run concurrently with, or may follow, an attempt or attempts to provide 111 notice by hand delivery or by mail as required under= sub- section (a). Evidence that an attempt. has been made to hand deliver or mail notice as provided in subsection (a), together with proof of publi- cation or posting as provided in subsection(b), shall be sufficient to show that the notice requirements of this chapter have been met, without regard to whether or not the alleged violator actu- ally received such notice.
