RESOLUTION NO. ROO- 89
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF BOYNTON BEACH, FLORIDA, ADOPTING FEES FOR
ACTIVITIES DESIRING TO UTILIZE CITY OWNED
RIGHTS-OF-WAY AND CONTROLLED EASEMENTS IN THE
CITY OF BOYNTON BEACH, AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Boynton Beach previously adopted an ordinance,
specifically Ordinance No. 74-17, which provided requirements and controls as to
construction and restoration within the City's rights-of-way including permits,
application fees and other requirements, and
WHEREAS, the City of Boynton Beach previously adopted an ordinance,
specifically Ordinance No. 81-6, which adopted a new "Code of Ordinances", which
superceded all general and permanent ordinances adopted on or before July 1,
1980, repealing those that were not recognized and continued in force by reference,
and
WHEREAS, Ordinance No. 74-17 was not recognized and continued in force
. by reference, and
WHEREAS, the City of Boynton Beach subsequently adopted an ordinance,
specifically Ordinance No. 95-02, separating the Land Development Regulations
(LDR) into a document which was made available to the public as a separate set of
rules and regulations for development and improvements within the City, and
WHEREAS, the City of Boynton Beach has previously adopted Resolution No.
R95-45, establishing a list of fees for Land Development related activities, which did
not include any related activities within City rights-of-way, and
WHEREAS, in the LDR, Chapter 22, Article II, Section 3 (Permit Fees), fees
for work within the rights-of-way, shall be as established by the City Commission
from time to time by resolution, and
WHEREAS, the City Commission of the City of Boynton Beach deems it to be
in the best interest of the citizens and residents of the City to adopt fees for work
within the its rights-of-way.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The definition of Public rights-of-way means the surface, the air
space above the surface, and the area below the surface of any public street,

. highway, lane, path, alley, sidewalk, boulevard, drive, bridge, tunnel, parkway,
waterway, public easement, or similar property in which the City now or hereafter
holds any property interest, which, consistent with the purposes for which it was
dedicated, may be used for the purpose of constructing, operating and repairing a
cable system or open video system. Public rights-of-way do not include buildings,
parks, or other property owned or leased by the City.
Section 2. The City Commission desires that the Department of
Engineering monitor, address and issue permits for those activities desiring to use
the rights-of-way and easements situated under the control of the City of Boynton
Beach.
Section 3. The List of Fees for the Department of Engineering to charge
for those services noted in Section 2 above are attached hereto as Exhibit "AIf is
hereby adopted.
Section 4. That this Resolution shall become effective immediately upon
passage.
