Minutes 08-20-51MINUTES OF THE REGULAR~TiNG OF THE cITY COUNCIL AT THE CITY OF BOYI~ON BEACH, FLORIDA, AT THE CITY HALL ON AUGUST 20, 1951. The City council ~convened at the City Hall at 7.30 P.M. on August 20, 1951. Councilmen present: N~. C.HoHood. Mr. A.E.Shook, Mr. Henry Merkel Mr. Clifford Province. Mr. Hood, in the absence of Mayor Purinton on account of illness, took the Chair and called the meeting to order. Dorothy VoWilliams read the minutes of the last regular meeting of the Council, held on August 6, 195i. Mr. Province made a motion, seconded by Mt. Shook, that the minutes be accepted as read. After showing the film, the representative said that Lake Worth and Delray Beach have already adopted this method, and that West Palm Beach is using it now on an experimental basis, but hopes to get it included in next year's budget. He said that Belle Glade and Tampa also use it, and that it is much less expensive than incinerator me,hods, the initial cost being ~$out $9,000 to $10,000 for the m~chinery, which could also be made useful for other jobs around the ~mty. Mr. Hood thanked the representative for taking the trouble to come and show the pictures, which were most inter- esting. He said that some day the City's garbage disposal system ~ould need changing, and when that time came the Clewiston Motor Company would be communicated v~th~ The City Clerk read the following Resolution: ~ESOL~UT-IO~ Upon motion duly made ~nd seconded~ th~ following resolution was unanimously adopted: BE IT R~SOLVED by the City Commission of the City of Boynton Beach~ a municipal corporation of the State of Florida~ as follows .~ (1) That the City of Boynton Beach, a municipa% potation of the State of Florida~ does hereby contract and agree to enter into an agreement with Scott H. 5oftin and John ~artin~ as Trustees of the prop&rty of Florida East Coast Rail- way Company~ and not individually~ wherein and whereby the said City of Boynton Beach is given the right and privilege to install, maintain ~ud use A subgrade water carrier pipe line consisting of ~ inch galvanized steel pipe installed in a 4 inch cast iron casing pipe oxtendlng easterly and westerly across the right of way af the Railway and under its tracks at Boynton Beach~ Florida~ at a point located 898 feet southwesterly from the Railway~s ~il~ Post No. $11 from Jackeonville~ Florida, said right of way of the Railway having a total width of 75~0 feet at this location~ lng 50~0 feet ~d BSa0 feet ~u width on the northwest= eriy and southeasterly sides respectively of the center line of the Railway~s northbo~ad main track~ All as shown colored yellow upon blue print of part of the Railway~s plan VS~SlSb dated Narch 5~ 198!~ attached to said agreement and by this reference there~ to is made a part hereof. all as more fully described and under the further te~s ~ud con~ ditions each and ever? in copy of proposed agreement now on file with the City Co~ission of Bo~ton Beach, Florida, ~ud by rsfer~ ence thereto made a pa~t hereof~ (~) That the Mayor~ with the attestation of the City Cterk~ be and they are hereby authorized and directed to execute said agreement for and on behalf of said City of Boynton Beach° (8) That this resolution shall,take effect immediately upon its passage. ~o Province made a mo~ion, seconded by Mt. Shook, that the Resolution be adopted. Motion passed unanimously. Mr. Griffith read a letter from the F.E.C. Railway re- garding a flag stop for Boynton for trains coming South. They said they had already 18 stops between Jacksonville and Miami and have many complaints from passengers on account of the frequent stops. Under the circ,~m~tances they regretted being unable to comply with the request. It was suggested that the City might retaliate by making the trains slow dowm when passing through the City limits, but it was pointed out that grudges of that kind could work both ways. At the suggestion of ~r. Griffith it was decided to invite the F.EoC. to send a representative to a Council meeting so that the matter could be discussed generally. Mr. Hood asked Mr. Griffith to send such an invitation. ~. Anderson raised the question of payment for building inspection work during the absence of ~. Greenwood, Building Inspector. It was decided that the payment to Mt.Anderson for such inspection work should be $50.00 a month, A long discussion followed supplying C.W.Ne!son with water necessitated crossing under the on the expense to the City in service for his property, which highway and the railroad. Mr. Griffith thought nothing could be done as if the property were sold the new purchaser would not allow the pipe to be dug up. Mr. Shook suggested the meter be moved to the property line unless and until the property owner grants an easement on the East end of his property, when meters can be installed as needed on his lots.
