Minutes 04-01-47REGUL~ MEETING OF THE CITY COMMISSIONERS OF THE CITY OF BOYNTON BEACH, FLORIDA HIL l, 19 7 At the regular meeting of the City Commissioners of the City of Boynton Beach, Florida, held at City Hall on April 1, 19~7 there were present: Paul Mercer, Mayor B. V. Tattersall, Vice Mayor Clarence Benson, City Clerk Mr. Senior brought before the City Commissioners a proposed ordinance of the City of Boynton Beach granting tO Florida power & Light Company its successors and assigns~ an electric franchise and imoosing provisions and conditions relating thereto. The proposed ordinance will be for the period of 30 years and would voi~ when accepted, the l0 years remaining on the present operating electric franchise. Mr. Tattersall read the proposed ordinance in fmll and at the close of ~he reading made a motion that, in view of the fact the City would be benefited.by the payment to the~city ef the difference between 6% of the gross amount of revenue and the taxes, licenses or other impositions the city levies on the Florida Power and Light Co., the ordinance be adopted. Mr. Benson seconded the motion and all CommiSsioners Voting in the affirmative. It was agreed that the proposed ordinance be incorporated in one publishing of the Boynton Beach News and immediately following the edition and after l0 days have elapsed since motion was made and carried for adoption, s special meeting will be held by the City Commissioners for final reading and affixing signatures and city seal. Then the ordinance will be published for four consecutive weeks to completely legalize the transaction. Mr. Senior asked the C~ity Commissioners to be released from his duties as Fire Chief in view of the fact that his work takes him out of town a great deal and he finds that he cannot give the Fire Department the attention it requires. Mr. Senior also asked that the Commission appoint him 'HonorarY Fire Chief and assured the Commission he is willing to spend as much time as possible with the dep~mtment. By action of the Commissioners it was decided a resolution will ~be drawn up setting forth Mr. Senior as Honorary Fire Chief and also appointing Mr. krthur R. Cook as Fire Chief. Motion made by Mr. Tattersall and seconded by Mr. Benson with all Commissioners voting in the affirmative to adopt such resolution. The Boymton Beach Volunteer Firemen are beginning a training course in fire fighting on April 2nd, 19~? at the suggestion of Mr. Senior. This met withapproval by the Commission. A letter was read from Martin W. Williams who appeared in-person at the meeting asking the Commissioners to regulate taxi fare and adopt rules and regulations covering operation of taxis in Boynton Beach. Mr. Williams also mentioned that competition was under- charging customers and also was soliciting business in his territory. The Commissioners roled that at the next special meeting to be held in April, the two men representing the taxi business in Boynton Beach appear and at that time their differences could be settled and a set of rules set up by the City Attorney in regard to all taxi business. Mr. Hatless appeared before the Commissioners as spokesman for Mr. Joe Reese who desires permission to set up a modern trailor camp in the city after he found out material was too expensive to build homes. The Commission refused Er. Reese permission in view of the fact that the Zoning Beard rejects all trailor camps within the city limits. Harry Hill appealed to City Commissioners in regard to his delinquent taxes. It was made known that he had been charged 13 years back taxes instead of five years plus current year on which basis the Com~ission had authorized settlement. It was ruled that amount of refund due Mr. Hill would be applied against his current taxes still outstanding. ' the Mr. Tattersall proposed that at least 10 acres be set aside for cometary adjoining the present cometary. He has had an offer from Harvel and Woolbright to do the clearing and grading of the 10 acres for an estimated price of $600 The 10 acres will need approximately 1OO0' of road and the road to b~ 16' wide. Cost of laying ~oad would be $13%0. The Garden Club nas agreed ~o furnish shrubbery landscaping. The plattings.of the acreage into plots will have to be done at extra cost. Mr. Benson made motion to have cleaning.and grading started and to have the new cometary named "The Boynton Beach Memorial Park". Mr. Mercer seconded the motion. The consensus of the Commission is that the City is in desperate need of a city garage to house city equipment. Jolly & Ward have offered to build a city garage on cost plus 10%. Mr. Tattersall is going to investigate further in regard to cost and will report at next special meeting. Inasmuch as a new fire track has been Purchased and supplies such as fire hose~ etc., it was deemed advisable by the Commission that a letter be written to Ocean Ridge to the effect that a charge cf $30.00 per month be levied to aid in defraying expenses of the Fire Department, firemens payroll, and depreciation of the engine and that Ocean Ridge pay $1.00 per man per hour when called to a fire in Ocean Ridge. It was also. mentioned that the cost of maintenance of fire plugs is $18.00 per year and there are six in Ocean Ridge. Mr. Benson requested Commission approval on a proposed purchase of 100, X 150' parcel of city-owned property on Federal Highway opposite the City Hall.
