AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA AMENDING
CHAPTER 23, OF THE LAND DEVELOPMENT
REGULATIONS, "PARKING LOTS", BY AMENDING
ARTICLE I., "IN GENERAL", SECTION 1, PURPOSE
AND OBJECTIVES, SECTION 3, EXEMPTIONS AND
VARIANCES AND SECTION 4, MINIMUM
STANDARDS; AMENDING ARTICLE II. "REQUIRED
IMPROVEMENTS", BY AMENDING PARAGRAPHS
"A", "E", "Q" AND "R"; PROVIDING FOR CONFLICTS,
SEVERABILITY, CODIFICATION AND AN EFFECTIVE
DATE.
WHEREAS, it has come to the attention of the City Commission of the City
of Boynton Beach that some clarification is required regarding certain Sections and
Articles in the recently adopted Land Development Regulations; and
WHEREAS, upon recommendation of staff, the City Commission of the City
of Boynton Beach has deemed it to be in the best interests of the citizens and
residents of the City of Boynton Beach to amend these Land Development
Regulations;
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. Chapter 23, Article I. "In General", Section 1, is hereby
amended by adding the words and figures in underlined type, and deleting the
words and figures in struck-through type, as follows:
ARTICLE I. IN GENERAL

Purpose.
The purpose of this chapter is to provide a set of regulations to govern the

design and construction and maintenance of parking lots within the City of
Boynton Beach. It is intended that these regulations provide a minimum set
of standards to be followed when parking lots are constructed in order to
protect the health, safety and welfare of the public. Furthermore, the City of
Boynton Beach recognizes the relationship of these regulations to the goals
and objectives of the comprehensive plan.
Section 2. Chapter 23, Article I. "In General", Section 3. Exemptions and
variances, is hereby amended by adding the words and figures in underlined type,
and by deleting the words and figures in struck-through type, as follows:

Exemptions.
These regulations shall not be applicable under the following conditions:

When temporary office trailers are proposed where the public is not
invited; or
When temporary construction or storage trailers are proposed where
the public is not invited; or
When the parking of equipment or work vehicles or the storage of
materials is proposed; and or
When the number of parking stalls in an existing parking lot is
expanded by less than twenty-five (25) per cent beyond what was
originally approved and no building(s) is proposed to be enlarged or
constructed, the existing portion of the parking lot need not comply
with the requirements of this chapter: However, any newly
constructed areas must comply with the requirements of this chapter:;

when a multi-family residential project is proposed and is designed to
include units containing garages served by driveways, then these units
shall be exempt from the requirements of this chapter. This exemption
shall not apply to multi-family units that do not contain garages:; or
When proposed modifications or renovations would not increase the
number of dwelling Units in an existing residential project:; or
when the proposed improvements are of a maintenance na_n~re such
as repairs to existing lot(s), re-striping~ overlays, drainage
improvements, etc.; or
When the proposed improvements are upgrades to existing lot(s) such
as lighting, curbs, landscaplng~ irrigation, sidewalks, and drainage.

Section 3. Chapter 23, Article I. "In General", Section 4. Minimum

All areas proposed for parking or storage including those instances exempted in

ARTICLE H. REQUIRED IMPROVEMENTS.
Each parking lot constructed or reconstructed shall include improvements as follows:

with LDR Chapter 2, Section 4, Paragraph N7.
Section 5. Chapter 23, Article II. "Required Improvements", paragraph E,

or a raised continuous curb. Areas to be protected include all landscaped
islands, landscaping adjacent to parking stalls and landscaping adjacent to
curvilinear driveways where encroachment is likely to occur. Curb shall
extend six (6) inches above pavement and shall comply with city standards
utilizing twenty-five hundred (2500) psi concrete.
Section 6. Chapter 23, Article II. "Required Improvements", paragraph Q,
is hereby created, as follows:
Parking lot pavement. Six (6) inches of Palm Beach County approved shell
or lime rock on a twelve (12) inch sub-grade compacted to 98% of maximum
dry density as determined by AASHO T-180. Shell rock ,~hall have a retention
of 50% over a number four sieve and ,~hall have a minimum calcium carbonate
content of 40% and a minimum modified proctor of 120 lbs. If lime rock is
used, it shall meet the requirements of the current D.O.T. specifications for
road and bridge construction. The compacted base .qhall be primed and paved
with one inch of compacted Type S-II or S-III asphalt in compliance with
F.D.O.T. standards.
Other types of construction that may be submitted for approval are portland
cement concrete, paving blocks, and stabilized sod.
Section 7. Chapter 23, Article II. "Required Improvements", paragraph R,
is hereby created, as follows:
Stacking space at drive-up openings. Drive-up openings thru which food is
passed shall be served by a drive-thru lane which provides a minimum of
seventy (70) feet of vehicular stacking space which does not obstruct or
restrict in any way the free movement of emergency vehicles, service vehicles
or any other type of vehicles. See also Chapter 9, Section 11, paragraph H.
Section 8. That each and every other provision of the Land Development
Regulations not hereinbefore specifically amended shall remain in full force and
effect as previously enacted.
Section 9. All laws and ordinances applying to the City of Boynton Beach
~n conflict with any provisions of this ordinance are hereby repealed.
Section 10. Should any section or provision of this Ordinance or any
portion thereof be declared by a court of competent jurisdiction to be invalid, such
decision shall not affect the remainder of this Ordinance.
Section 11. Authority is hereby given to codify this Ordinance.
