A RESOLUTION OF THE CITY OF BOYNTON
BEACH, FLORIDA ASSESSING THE COSTS OF
ABATEMENT OF CERTAIN NUISANCES
AGAINST THE OWNERS OF THE PROPERTIES
INVOLVED; AND PROVIDING AN EFFECTIVE
DATE.

1 WHEREAS, a contract vendor was requested by Code Compliance to mow the lots,
1 remove vegetation and board up structures on the properties, described in Exhibit"A"; and
1 - WHEREAS, the owners of the parcel(s) of property hereinafter described were
1: invoiced by the Finance Department in an effort to recoup these costs with no response; and
1
1: WHEREAS, said nuisance was not abated as required; and,
1•
21 WHEREAS, all of the property owners listed in the attached Exhibit "A" were sent
2 letters offering them an opportunity to remit within 30 days in order to avoid incurring a lien
2. on their property; and

2, WHEREAS, the City Manager or her authorized representative has made a report of
2• costs actually incurred by the City and abatement of said nuisance as to the property(s)involved,
2. which is described in Exhibit"A"attached to this Resolution; and

2: WHEREAS, upon passage of this Resolution, the property owners will be furnished
2• with a copy of this Resolution, and given one more opportunity to remit all costs associated
31 with the abatement in full within 30 days of the passage of the Resolution,before transmittal to
31 the County for recordation of Liens; and

3, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
3- THE CITY OF BOYNTON BEACH,FLORIDA AS FOLLOWS:

3 Section 1: Each Whereas clause set forth above is true and correct and incorporated
3: herein by this reference.

4• Section 2: The amount of costs incurred by the City and the abatement of the above-
41 described nuisance as to the parcels of land, owned and indicated to wit:

4 Subject amount is hereby assessed as liens against said parcels of land as
4: indicated, plus an additional administrative charge of $30.00 for each Lien.
4• Liens shall be of equal dignity with the taxes there from for the year 2018, and
51 shall be enforced and collected in like manner pursuant to applicable provisions
5 of law. In the event collection proceedings are necessary, the property owner
5• shall pay all costs of the proceedings, including reasonable attorneys fees.
