Minutes 05-01-50MINUTES OF THE REGUL~q MEETING OF THE CITY COUNCIL OF THE CITY OF BOt~NTON BEACH, FLORIDA~ HELD AT THE CITY NELL ON THE 1ST OF MAY 1950 The City Council convened at the regular meeting at the City Hall, at 7:30 P.M., May 1st, 1950. Councilmen Present: Mr. F.L. Purinton Mr. A.E. Shook Mr. C.H. Hood Mr. Clifford Province Mr. Henry Merkel Jr. The meeting was called to order by the Mayor. Minutes of the previous meeting were read by City Clerk D.V. Williams and accepted on motion of Commissioner Hood seconded by Commissioner Province. Mayor Purinton said, desoite assurances to the contrary, the Dixie Highway is not to be widened one inch through Boynton. He said plans have been okayed and contracts let for some re-surfacing, improving of the shoulders, but no widening. A discussion followed on the possibility of an appeal from this decision. The City Attorney offerred to look into this to see the genesis of the program. Mr. Merkel suggested the County Commission be asked to help. Mr. Hood suggested a direct appeal to John Bollinger. All suggested a resolution of protest. ~opies of this hypothetical resolution to go to anyone who might help. City Attorney Griffith was asked to draft this resolution. This was on motion of Commissioner Merkel, seconded by Commissioner Province. RESOLUTION WHEREAS, at the May let meeting of the City Council of the City of Boynton Beach, Florida, there was brought to the attention of the Council the present plans of the State Road Department concerning a contract let to Rubin Construction Company, West Palm Beach, Florida, under which work is to begin immediately for the resurfacing of the read and improvement of shoulders of the U.S. No 1 Highway in this area; and WHEREAS, for sometime the Council has put its concerted effort for the improvement of the highway in question, even to the extent of attendln§ meetings with the officials of the road department discussing this problem~ and ~HEREAS the impression made by these meetings was that the next improvements on this right-of-way would be widening and an elimination of se~eral curves. NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Boynton Beach, Florida, to do all in its Dower to have the present con- tract cancelled, or at least held up unti~ it can be altered so as to include these requirements necessary to enable the road to handle the traffic over this route. BE IT FURTHER RESOLVED, that a copy of this resolution be sent with an ernest request for favorable action to Senator John Beacham, Representative John E. Bollinger, and Mr. Merrill Barber. Passed and adopted this let day of May, ~.D. 1950. Mayor Councilman Councilman Councilman Councilman - 3 - Commissioner Shook made, and Commissioner Hood seconded, a motion to accept the agreement offerred by K.L. (Jack) Sharp for maintaining the water tank. The agreement~ however, is to be signed only after Mr. Sharp's current job of cleansing the tank has been concluded satis- factorily. A. Letter from William A. Lord, local attorney, (written in his capacity as National Counsellor of the Boynton Chamber of Commerce) asked cooperation of the Boynton City Commission in getting sand dredged from Lake side of the Lake Worth Inlet. City Attorney Griffith reported he had, already, drafted a~ letter to held in this campaign. A letter was requested to James M. Owens Jr., tax assessor, for Palm Beach Cottnty requesting he meet with the City Co~tmissioR Monday May 8th at City Hall. Jack Talbot, lessee of Rainbow Gardens, asked permission to erect thatched-roofed huts for the Indians which will he part of his "Indian Village" attraction. Mr. and Mrs. Milton E. Claypoole, operators of the Sand Piper Motel next door; and Mr. and Mrs. ~,rthur-C. Worrell, operators of Valentine Court, appeared to protest the proposed building and the erection of the alligator pit which will be part of the Indian Village. The Commission tabled decision until they could investigate the proposal and could get word from the Zoning Board. On the suggestion of City Attorney Griffith a motion was made to appoint a committee to do this. The motion was made by Mr. Shook, seconded by Mr. Province. This committee was not appointed that night. When set it will, also, report back on the query of Fred and Ernest Wilhelm who want to build efficiency apartments on the Dixie Highway. They want to put Duplex units with efficiency k~tchens behind the 150 feet Uommercial zone now approved. Post Commander Stanley Weaver of the local ~merican Legion spoke on the annual July Sth cblebration planned for 1950. This will be called "Homecoming Day" and will commemorate the incornoration of Boynton 30 years age. He asked cooperation of the Commission in consumating the eleborate plan of day-lonE activity. He also, asked for a resolution commemorating this day as "Homecoming Day". The Commission decided to pass this requested resolution at the next meeting, May 15th. Mayor Purinton said "this job cannot be done with half-dozen workers, I suggest a big committee of two members from each local organization". He oromised the Commission would be re- presented at the "kick-off" me~ting the following Wednesday at the American Legion hall. Mr. Hood moved and Mr. Shook seconded the motion to hold a tax sale on the first Monday in June the 5th at 9:00 A.M. City Attorney Griffith reported on a letter from Nm. Claughton of Miami asking for an extension of his option on lot 25 in the Dewey sub-division. He also wants an option (or a price) on lot 26. The Commission granted the extension on motion of Mr. Province seconded by Mr. Hood. ~he second request was tabled oending the surveying of the land by the City Commission. It was discussed the situation of the Moseley properties that his pl~us when he finished present building were to include a filling station on corner of Lake Avenue and Federal Highway and the council has notice of his intentions. Therefore, any action taken g~verning filling stations will be taken subject to his rights. This action also applies to Lot 25 of Dewey's S/D, such property being the corner of intersection of Lake Avenue and Federal Highway. Ordinance #216 became a law (after second reading this night) on motion of Mr. Hood, seconded by Mr. Province. ORDINANCE NO. 216 AN ORDINANCE REGULATING THE OPERATION OF MOTOR VEHICLES~ AND OTHER TRAFFIC ON THE ROADS AND HIGHWAYS OF THE CITY OF BOI~NTON BEACH AND PRO- VIDING A PENALTY FOR THE VIOLATION THEREOF; REPEALING ALL ORDINANCES OR P~RTS OF ORDINANCES IN CONFLICT ~JITH SUCH 0R~INANCE. The City Attorney read the first reading of the following ordinances: ORDINANCE NO. 217 AN ORDINANCE OE THE CITY OF BOYNTON BEACH, AMENDING ZONING ORDINANCE NO. 205 OF SAID CITY: REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT WITH SUCH ORDIN- ANCE. ORDINANCE NO. 218 AN ORDINANCE OF THE CITY OF BOYNTON BEACH AMENDING BUILDING CODE ORDINANCE NO. 173 REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT k~TH SUCH ORDINANCES ORDINANCE NO. 219 AN ORDINANCE OF THE CITY OF BOYNTQN BEACH AMENDING ORDINANCE NO. 80 REGULATi~G THE WATER DEPARTMENT OF THE CITY OF BOYNTON BEACH AND REPEALING ALL CONFLICTING ORDINANCES.
