R92-/~.~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT BETWEEN THE CITY OF BOYNTON BEACH AND POLICE SERGEANTS FRATERNAL ORDER OF POLICE; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Boynton Beach deems it to be in the best interest of the citizens and residents of the City of Boynton Beach, Florida to enter into an Agreement with the Police Sergeants Fraternal Order of Police for a one year period commencing October 1, 1992; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF EoYNToN~BEA~H, FLORIDA THAT: Section i. The City Commission of the City of Boynton Beach, Florida, hereby authorizes and directs the Mayor and City Clerk to execute the Agreement between the City of Boynton Beach, Florida and Bolice Sergeants Fraternal Order of Police, effective October 1, 1992, as attached hereto as Exhibit "A". Section 2. This Resolution shall take effect-October 1, 1992. PASSED AND ADOPTED this ~ day of October, 1992. Wages for fiscal year 1992/93 will be paid in accordance with the 1992/93 Compensation Pla~, attached to and included as a part of this contract; which is a 3% com- pensation adjustment above the compensation plan under which the members of the bargaining unit were paid during the fiscal year 1991/92. Section 2. Those employees who are selected members of the SRT team shall be compensated an additional 10% for hazardous duty when said team is actually called to duty. Members of the Organized Crime Bureau and Directed Patrol who are active shall receive a 5~ pay supplement. No employee shall receive more than one assignment pay. Section 3. Members of the Police Department shall be eval- uated annually under the City's Merit Program. The Merit Program for fiscal year 1991/92 will not have any additional monetary compensation attached to the performance rating. -17 - 7/12/89 3/6/90 11/7/91 10/5/92 ARTICLE 18 SICK LEAVE Section 1. Employees will earn ninety-six (96) hours of sick leave per year at the rate of eight (8) hours per month. The use of sick leave will be governed in accordance with the Civil Service Rules and Regulations. Section 2. Employees who have more than one hundred twenty (120) hours of sick leave as of October I of any contract year may convert fifty percent (50%) of the excess over one hundred twenty (120) hours to a cash straight-time payment not to exceed one hundred (100) hours in the contract year. Those hours over one hundred twenty (120) not converted in this contract year may be converted in the next contract year. This provision shall not be applicable for FY 92-93, and shall be subject to the collective bargaining process for subsequent fiscal years. Section 3. It shall be the policy of the City to permit an employee the opportunity of donating accrued sick leave, providing the contributing employee has 120 hours accrued sick leave, to a designated employee whenever extraordinary circumstances require the designated employee to be absent from work for a lengthy period of time, and when the employee has exhausted all accrued sick and annual leave to the equivalent of his/her current annual earned vacation rate. Extraordinary circumstances shall be defined as lengthy hospitalization, -24- 4/25/89 7/14/89 11/7/91 lC/5/92 ARTICLE 19 VACATION Section 1. Vacation shall be accrued in accordance with the Civil Service Rules in effect as of October 1~ 1989. Section 2. Seniority will prevail in the granting of vacations. Section 3. Vacation requests may be submitted from forty- eight (48) hours to thirty (30) days in advance. In the event of dual requests for vacation dates, the senior mem- ber's request shall prevail if it was submitted twenty-one (21) days prior to the date or dates requested. Vacations of three (3) days or less may be made within twenty-four (24) hours advance notice, provided that the City incurs no over- time in the granting of such request. Section 4. Requests for emergency vacation leave shall be individually considered by the Chief of Police. Section 5. Accrual of vacation time will be subject to Civil Service Rules. Section 6. No member shall be denied vacation nor shall vacation privileges be suspended or cancelled except as spe- cifically set forth in this Agreement or in time of declared emergency, as defined in this Agreement. Section 7. Ail sergeants shall receive in addition to the existing vacation accruals 32 hours of personal time which may be used in four hour increments (non-accumulative and cannot create an overtime situation). 5/1/89 3/6/90 -26- 10/5/92 ARTICLE 45 DURATION OF AGREEMENT Section 1. This agreement shall become effective October 1, 1992 and shall continue in full force and effect up through and including September 30, 1993. Section 2. Negotiations for a successor agreement shall commence by the exchange of proposals not later than June 1993 and the parties shall hold their first bargaining session not later than July 1, 1993. 15, 3/6/90 11/7/91 10/5/92 -65-
