AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA AMENDING
CHAPTER 4, "SITE PI_AN REVIEW" OF THE LAND
DEVELOPMMENT REGULATIONS, BY DELETING
SECTION 4 IN ITS ENTIRETY AND CREATING A
NEW SECTION 4. ENTITLED 'TECHNICAL REVIEW";
BY AMENDING SECTION 7. "SUBMISSION
REQUIREMENTS"; BY AMENDING SECTION 9.
"MODIFICATION OF APPROVED SITE PLAN"; AND
BY CREATING A NEW SECTION 12. ENTITLED
"APPEALS"; PROVIDING FOR CONFLICTS,
SEVERABILITY, CODIFICATION AND AN EFFECTIVE
DATE.
WHEREAS, it has come to the attention of the City Commission of the City
of Boynton Beach that some clarification is required regarding certain Sections and
Articles in the recently adopted Land Development Regulations; and
WHEREAS, upon recommendation of staff, the City Commission of the City
of Boynton Beach has deemed it to be in the best interests of the citizens and
residents of the City of Boynton Beach to amend these Land Development
Regulations;
NOW, THEREFORE BE IT RESOLVED BY THE CiTY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. That Chapter 4, Site Plan Review, Section 4. Site plan review.
is hereby amended by deleting said Section in its entirety and creating a new
Section 4., entitled "Technical Review", as follows:
,Section 4. Technical Review.
When site plan review is required by the provisions of this chapter, the review will be,
conducted as outlined in Chapter 1, Article VIII~ Development Reviews.
Section 2. That Chapter 4, Site Plan Review, Section 7. Submission
requirements, is hereby amended by adding the words and figures in underlined
type and by deleting the words and figures in struck-through type, as follows:
Section 7. Submission requirements.
Each applicant shall submit to the planning and zoning department the following plans
and exhibits in the number of copies specified by the planning and zoning department,
together with a site plan review application and a fee adopted by resolution by the City
COmmission.

F. Drainage plan:

A separate scaled drawing (at the same scale as the site development
plan) showing elevations, flow arrows, proposed drainage structures,
proposed treatment facilities, etc.
An engineer's certification in writing that drainage will conform with
all rules, regulations, codes, etc. including, but not limited to, Chapter
6, Article IV, Section fi of these Land DeveloPment Regulations.
Section 3. That Chapter 4, Site Plan Review, Section 9. Modification of
approved site plan. is hereby amended by adding the words and figures in
underlined type and by deleting the words and figures in struck-through type, as
follows:
Section 9. Modification of approved site plan.
When any determination of major/minor modification made by the planning
and zoning director is challenged or contested by the applicant, the
ehapte~, an appeal may be taken as outlined in Chapter 1, Article VII, Section
1_.

Section 4. That Chapter 4, Site Plan Review, Section 12. Appeals is hereby
created, as follows:
When an a.qRrieved party wishes to appeal an administrative, board or
commission decision, it must be filed as outlined in Chapter 1, Article VII, Appeals.
Section 5. That each and every other Section of Chapter 4 not herein
specifically amended shall remain in full force and effect as previously enacted.
