O96-53 ORDINANCE NO. O96-~-¢'j~ AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA AMENDING CHAPTER 3, "MASTER PLAN REVIEW"OF THE LAND DEVELOPMMENT REGULATIONS, ARTICLE I, SECTION 4. TECHNICAL REVIEW COMMITTEE (TRC); BY AMENDING ARTICLE II, SECTION 3. "WAIVER OF MASTER PLANNING",; AND BY AMENDING ARTICLE IV, SECTION 3 AND AMENDING SECTION 4, "TECHNICAL REVIEW"; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE. WHEREAS, it has come to the attention of the City Commission of the City of Boynton Beach that some clarification is required regarding certain Sections and Articles in the recently adopted Land Development Regulations; and WHEREAS, upon recommendation of staff, the City Commission of the City of Boynton Beach has deemed it to be in the best interests of the citizens and residents of the City of Boynton Beach to amend these Land Development Regulations; NOW, THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. That Chapter 3, Article I In General., Section 4. Technical review committee (TRC) is hereby amended by adding the words and figures in underlined type and by deleting the words and figures in struck-through type, as follows: LDRRev. Chpt.3 10/31/96, Rev. 1/16/97 1 tl Section 4. Appeals. When an aggrieved party wishes to appeal an administrative, board or commission decision, it must be filed as outlined in Chapter 1, Article VII, Appeals. Section 2. That Chapter 3, Article II Applicability., Section 3. Waiver of Master Plan is hereby amended by adding the words and figures in underlined type and by deleting the words and figures in struck-through type, as follows: Section 3. Waiver of master planning. F~.Master plan review may be waived by the planning and zoning director or designee based upon submission of written application; payment of fee; and all of the following: -I~.A._If the remodeling, alteration, modification, development or redevelopment does not change the preexisting configuration of buildings or site or reduce emergency vehicle access; and ~B: If there is no change of use which increases the required number of off'-street parking spaces; and ~.C If there is compliance with the land development regulations of the City of - Boynton Beach. In the event a property owner or his agent disputes the planning and zoning director's determination regarding compliance, the work shall be subject to review. Section 3. That Chapter 3, Article IV Applicability., Section 3. Master Plan Content. is hereby amended by deleting the words and figures in struck-through type, as follows: V. LDRRev. Chpt.3 10/31/96, Rev. 1116/97 Tree survey as described in 2 Chapter 7.5, Article I, Section 7, Site Plan Information, paragraph D as well as a written tree management plan describing how the applicant intends to comply with Chapter 7.5 Environmental Regulation. Section 4. That Chapter 3, Article IV, Master Plan Preparation and Submission, Section 4. Technical Review, is hereby deleted in its entirety and a new Section 4 is hereby created, as follows: Section 4. Technical Review. When Master Plan review is required by the provisions of this Chapter, the Review will be conducted as outlined in Chapter 1, Article VIII: Development Reviews. Section 5. That each and every other Section of Chapter 3 not herein specifically amended shall remain in full force and effect as previously enacted. FIRST READING this ~ day of November, 1996.
