19-00510 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 ORDINANCE NO. 19 -005 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA APPROVING AN AMENDMENT TO POLICY 1.3.1 b "DEVELOPMENT OF REGIONAL IMPACT (DRI)" OF THE FUTURE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN TO DELETE THE BOYNTON BEACH MALL DRI FROM THE LIST OF DRI -CLASSIFIED SITES; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Boynton Beach, Florida ("City") has adopted a Comprehensive Plan, and as part of said plan, adopted Policy 1.3.1, pursuant to Ordinance 89-38 in accordance with the Local Government Comprehensive Planning Act; and WHEREAS, the proposed future land use amendment, changing the Mall's future land use classification from Development of Regional Impact (DRI) to Mixed Use Low (MXL), has been initiated by City staff in preparation for the site's future redevelopment and requires an amendment to the above reference policies of the Future Land Use Element of the Comprehensive Plan removing the Boynton Beach Mall DRI from the list of DRI -classified sites; and WHEREAS, after public hearing, the City Commission deems it to be in the best interest of the inhabitants of the City to amend the text of the City's Comprehensive Plan by amending Policy 1.3.1b as provided herein; and WHEREAS, the City Commission finds that the adoptions of - these Comprehensive Plan Amendments are in the best interest of the health, safety and welfare of the citizens and residents of the City of Boynton Beach. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. The foregoing Whereas clauses are true and correct and are now ratified and confirmed by the City Commission. Section 2. The Quantum Park (fka Boynton Beach Park of Commerce) Development of Regional Impact (DRI) approved by City of Boynton Beach Ordinance 84-51, and most recently amended by Ordinance 12- 001, is a mixed use project containing industrial, office, commercial, residential and governmental/ institutional uses. All laws and ordinances applying to the City of Boynton Beach in conflict with any provisions of this Ordinance are hereby repealed. Section 5. Should any, section or, provision of this Ordinance or any portion thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance. Section 6. The effective date of this plan amendment shall be: The date a final order is issued by the Department of Community Affairs finding the amendment to be incompliance in accordance with Chapter 163.3184, F.S.; or the date a final order is issued by the Administration Commission finding the amendment to be in compliance in accordance with Section 163.3184, F.S.
