AN ORDINANCE OF THE CITY COlViMISSION OF THE
CITY OF BOYNTON BEACH, FLOPdDA AMENDING
LAND DEVELOPMENT REGULATIONS, CHAPTER 2
"ZONING", SECTION 8.A.l.d., PROVIDING FOR THE
ADDITION OF A NEW PEPdViITTED USE, 'GY1V[NASTIC
CENTERS," TO THE M-1 ZONING DISTRICT;
PROVIDING FOR CONFLICTS, SEVERABILITY,
CODIFICATION AND AN EFFECTIVE DATE.
WHEREAS, Ctmpter 2, Section 8. A.l.d. of the Land Development Regulations of
the City of Boynton Beach Code of Ordinances l~mits the M-1 zoning district to specific
miscellaneous uses and doesnot include gymnasiums or gymnastic centers; and
WItEREAS, the City Commission of the City of Boynton Beach deems it to be in the
best interests of the citizens and residents of the City to amend the Land Development
Regulations to include gynmastic centers as a permitted use.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The foregoing whereas clauses are true and correct and are now ratified
and confirmed by the City Commission.
Section 2. That Chapter 2. "Zoning", Section 8 A.l.d., of the Land Development
2ity of Boynton Beach Code of Ordinances is hereby amended by creating
a new subsection (9), by adding the words and figures in underlined type and by deleting the
· vords and figures in struck-through type, as follows:
(9). Gymnastic centers
Section 3.
Each and every other provision of the Land Developmc~nt Regulations
nOt herein specifically amended, shall remain in full force and effect as originally adopted.
Section 4. All laws and ordinances applying to the City of Boynton Beach in
conflict with any provisions of this ordinance are l~ereby repe~ed.
Section 5. Should any section or provision of this Ordinance or any portion
thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not
affect the remainder of this Ordinance.
Section 6. Authority is hereby given to codify this Ordinance.
Section 7. This Ordinance shall become effective immediately.
