R92-/~ A RESOLUTION OF THE CITY COMMISSION OF THE CiTY OF BOYNTON BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE A PROJECT AGREEMENT AMENDMENT BETWEEN THE CITY OF BOYNTON BEACH, FLORIDA AND FLORIDA INLAND NAVIGATION DISTRICT EXTENDING THE BOAT CLUB PARK GRANT THROUGH SEPTEMBER 1, 1993; A COPY OF SAID AGREEMENT IS ATTACHED HERETO AS EXHIBIT "A"; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Florida Inland Navigation District Board f Commissioners, at their meeting on July 25, 1992, ~pproved the extension of the FIND Project No. PB BB 91-14 ~t Boat Club Park through September 1, 1993; and WHEREAS, the City Commission of the City of Boynton ~each, Florida, has determined that it is in the best interest of the citizens and residents of the City to ~xecute a Project Agreement Amendment between the City of ~oynton Beach, Florida and the Florida Inland Navigation )istrict to effectuate this extension. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION )F THE~CITY OF BOYN~ON BEACH, FLORIDA THAT: Section 1. The City Commission of the City of Boynton Beach hereby authorizes and directs the Mayor and lity Clerk to execute a Project Agreement Amendment between the City of Boynton Beach and Florida Inland Navigation District, a copy of which Contracn is attached hereto as ~xhibit "A". Section 2. This Resolution shall take effect immediately upon passage. Frederick, Director of Recreation & Parks' is DATE: November 10, 1992 / SUBJECT: Boat Club Park Channel Dredging Project Status G / HISTORY 9 -0 In March of 1991, the Commission initiated this project by authorizing Gee & Jenson to serve as our design and engineering consultant to proceed with a grant application to the Florida Inland Navigation District (F.I.N.D.); and, if successful, to proceed with necessary permit processing to authorize the project. In October of 1991, the City and F.I.N.D. finalized an agreement for the project with an $80,000 grant award. Since this time, we have been involved in the arduous and frustrating task of designing and re- designing the project to meet objections and permitting requirements of many agencies, including the State Department of Environmental Regulation (D.E.R.), the County Department of Environmental Resource Management, the Corps of Engineers, the U.S. Fish and Wildlife Service, the National Marine Fishery Service, the State Department of Natural Resources and the Coast Guard. The most difficult task has been to achieve a mitigation plan which would satisfy different environmental concerns of the various agencies for the loss of sea grasses which will occur due to the dredging. PERMIT STATUS On October 23, 1992, D.E.R. finally issued a permit for the project subject to a long list of conditions including the mitigation plan. On November 2, 1992, permit correspondence was received from the Corps of Engineers (C.O.E.) authorizing the project upon execution of the permit agreements by the City Commission. This document is on the November 17, 1992 Commission meeting agenda for approval. Upon our approval, documents will be returned to C.O.E. for their sign -off and return to the City. The County Environmental Resource Management (ERM) permit should be in hand by November 20, 1992. We anticipate receiving the COE placard and US©S permits approximately four WIK$ after submitting the signed materials.
