A RESOLUTION OF THE CITY COMMISSION OF
THE CiTY OF BOYNTON BEACH, FLORIDA,
DECLARING ACQUISITION OF CERTAIN
PROPERTY IN FEE SIMPLE, MORE
PARTICULARLY DESCRIBED HEREINAFTER FOR
DRAINAGE, ROADWAY RECONSTRUCTION~
CONSTRUCTION OF SIDEWALKS, AND UPGRADING
OF WATER AND SANITARY SEWER
INFRASTRUCTURES RELATED T° THE CO~NIT~
REDEVELOPMENT BLOCK GRANT AREA TO BE~
.UBLIC NECESSITY, AUTHORIZING THE
EMPLOYMENT OF APPRAISERS AND AUTHORIZING
THE FILING OF EMINENT DOMAIN
PROCEEDINGS.
WHEREAS, the City of Boynton Beach, Florida has
etermined that capitol improvements will curtail
~esidential blight and improve and stabilize the residential
~haracter of that area of the City bounded on the north by
~he Boynton Canal; on the east by the F.E.C. R~ilroad; on
~he west by Seacrest Boulevard; and on the south by Martin
~uther King, Jr. Boulevard; and
WHEREAS, the project for public improvements as
signed r~quires the acquisition of property for sidewalks~
improved drainage systems, and utility easements;
~nd
WHEREAS, the property which must be acquired in fee
~imple is more particularly described in Exhibit "A"
~ttached hereto and incorporated herein; and
WHEREAS~ funds are available for the above described
~cquisition; and
WHEREAS, this Commission finds that the acquisition of
~aid property, as described in Exhibit "A", in fee simple
~or the purpose of the construction of new sidewalks,
water and sanitary sewer lines, and utility hole
, is a public necessity and essential to the
interest of the City of Boynton Beach, Florida; and
WHEREAS, in order to accomplish the acquisition of this
~eded property it is necessary for the City A~torney to
real estate appraisers and to take legal action,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section t. This Commission adopts and
matters set forth in the foregoing recitals.

Section 2. The City Attorney is authorized and
.ed to employ real estate appraisers for t~e purposes

~ in Exhibit "A" attached hereto for the purpose of
~cquiring the aforementioned needed legal interest.
Section 3. The City Attorney is hereby authorized
~nd directed to take the necessary steps for Boynton Beach,
?lorida, to acquire in its own
name by d~nation, purchase or
domain proceedings the interesu neretofore mentioned
in the property described in Exhibit "A", attached hereto,
~nd to have prepared in the name of Boynton Beach all
)apers, pleadings and other
~urpose, and to see that all
~rosecuted to judgment.

Section 4. The City Attorney is hereby authorized
.nd directed to take such further actions as are reasonably
· equired to fully accomplish the purpose hereinabove
directed.
BE IT FURTHER RESOLVED that the property described in
~xhibit "A" is to be used for the following public purpose:
Drainage, roadway reconstruction, construction of
sidewalks, and upgrading of water and sanitary
sewer infrastructures related to the Community
Redevelopment Block Grant area.
