A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH~ FLORIDA,
AUTHORIZING AND DIRECTING THE MAYOR AND
CITY CLERK TO EXECUTE AN AGREEMENT
BETWEEN THE CITY OF BOYNTON BEACH AND
PALM BEACH COUNTY FOR THE PURPOSE OF
SERVICE AS HOST AGENCY FOR SENIOR AIDES
UNDER TITLE V OF THE OLDER AMERICANS
ACT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton Beach,
Florida, has determined it to be in the best interest of the
citizens and residents of the City of Boynton Beach to execute
an Agreement between the City of Boynton Beach and Palm Beach
County for the purpose of service as Host Agency for Senior Aides
under Title V of the Older Americans Act, which Agreement is
attached hereto as Exhibit "A";
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. The Mayor and City Clerk are hereby directed
to execute the Agreement between the City of Boynton Beach and
Palm Beach County, attached hereto as Exhibit Ao
Section 2. This
immediately upon passage.
Resolution shall take effect

THIS AGREEMENT, made and entered into at West Palm Beach,

WI T N E S S E T H:
WHEREAS, Palm Beach County is a sponsor of a Senior AIDES
program under Title V of The Older Americans Act and has been
granted Federal funds thereunder by The National Council of
Senior Citizens through~ the U.S Department of Labor; and
WHEREAS, in order to comply with the provisions of the
National Council of Senior Citizens Senior AIDES ~rogram
guidelines~ it is necessary for the Sponsor Agency to enter into
agreements with Host Agencies delineating the duties and
responsibilities of each.
NOW, THEREFORE, in consideration of the mutual benefits,
promlse~s ~ and covenants hereinafter set forth, the part ies a~ree
as follows:
1. THE SPONSOR AGENCY agrees:
To be responsible for the administration and fiscal
components of the Senior AIDES program including the
provision of salary and fringe benefits as required by
law,
To provide the Host Agency with an orientation ano
oeriodic updates on the goals and objectives of the
Senior AIDES orogram.

To recruit and refer eligible partici0ant(s) to the
Host Agency to ]e interviewed and when such
particioant{s) meet the Host Agency's approval to
enroll the participant(s) into the Senior AIDES
program.
To counsel both with the Senior AIDE(s) and the Host
Agency Supervisor, in matters Pertaining to the
Senior AIDES(s) work performance and unsubsidized
placement.
The HOGT AGENCY agrees:
To provide adsquats supervision ko enable the
'Se'nior AIDE to perform as a ~-oductive and
effective worker.
To ~rovide orientation~ instruct~ion~ and training
concerning the Host Agency~ its activities, and
the Senior AIDES day to da'>, responsibilities.
To assure that each Senio~~ AIDE has a copy of
his/her job descl-iotion and to upgrade the Job
description as responsi.~ilities change.
D. To provide safe and sanitary working conditions.
E. To ensure that the Senior AIDE'S activities will:
(I) Not result in the partial or total displace-
ment of currently employed workers~ (~> Not impair
existing Contracts or result in the substitution
of Federal fun~e for other funds in connection
~ith work that ~ould otherwise be done~ (3) Not to
be used as a replacement for a position from which
another person has been la-id off~ (4) one~ and ONL?
ONE TITLE V CONTRACTOR will serve this agency.

To provide the Sponsor Agency with time anO
attendance records as designated by the Sponsor
Agency~ activity reports~ and evaluations (when
~equested), and accurate in-kind contributions
records as required by the Sponsor A~ency.

To assure that the Senior AIDE(S) work only the
total number of hours authorized by the Sponsor
Agency. Volunteer or overtime hours are not
permitted~ unless~ the Host Agency agrees to pay
the enrollee for the overtime hours.
To make no significant changes in a Senior AIDE~S
work schedule~ hours, ~ob duties~ supervisor,
place of work, or status within the Agency without
notification/approval of the Sponsor Agency.

3. Duration of assignment:
It is understood
remain in one assignment for more than 84 months. It is also
understood ny the HOST AGENCY that the SPONSOR AGENCY reserves
the right, following reasonable notice, to -eassign a~y Sen~o-

opportunities for training or unsubsidized employment, or will
otherwise serve the best interests ~'~ the Senior AfDE, or ~ill
better s~tpport the goals and objectives of the Senior AIDES

shall begin on July 1, 1998~ and shall terminate
on ~0~ 1~93! however, this agreement may be terminated by
el r party upon thirty (30) calendar days by written notice to

fuods. No amendment or mc, dification of this Agreement shall be
v.alid unless in writing and until duly executed by the parties.
5. Notices:
All notices required in this Agreement shall be sent by certified
mail, return receipt requested, and if sent to the SPONSOR AGENC%~

6. This Agreement contains all the terms and conditions agreed
upon by by the oarties. All items incorporated by reference are
physically attached. No other agreements, oral or otherwise,
regarding the subject matter of this Agreement, shal! be deemed
to exist or to bind any of the parties hereto.
