Minutes 04-13-37SPECIAL NEETING OF ~PRIL 13, i93Vo A Special Neetir~ of the Board of Town of Boynton, Florida, was held at ir~ April 13, 193V at 9:00 o'clock A. Present: N. ~. Weems, J. P. Bowen, Town Commissioners of the the Town Hall on Tuesday morn- V~ce-Mayor. Town Clerk. The above constituting a majority of the Board of Town Com- missioners of the Town of Boynton, FlOrida. Commissioner Weems stated that this meetir~ had been called to take action on the followir~ Resolution which was presented to the Board by Cou~aissioner Bowen. Commissioner Bowen made a motion that the following Resolution be adopted, which motion was seconded by Commissioner Weems and duly carried, ~HEREAS, the Charter of the Town of Boynton, in Palm Beach County, Florida, embraced in C~pter $918, of the Laws of Florida, S~ecia! Acts of 1921, in the opinion of the Town Commission of said Town has become inadequate for the needs of said municipality; and ~fPflEREAS, in the opinion of the Town Commission of said Town it is deemed necessary, expedient and advisable and to the best interests of the Town of Boynton, its inhabitants, citizens and tax-payers~ tb~t certain sections of the said Cb~ter of the Town of Boynton be amended to provide for a Town Commission of five mem- bers, instead of tb~.ee as now provided for, prescribir~ ti~e term of office of the members of the Totem Commission, their Jurisdiction, powers and the mmuner in which they shall be nominated and elected; to provide for the election of two Commissioners; to prescribe the time for the holding of general elections in said ~nicipality; to prescribe ths qualifications of vo~ers at such general elections~ to provide further and additional powers for said municipality; to provide for a Municipal Co~mvt for said Tow-n, presided over by a Municipal Judge to be appointed by the Town Commission, instead of the May~s Court presid~d.~ver by the Mayor as mow provided for; to provide for an election for the ratification or rejection of such amendments by the ~alified vo~e~ who are freeholders in said Town~ and to repeal al~ other laws or parts of laws relatir~ to or affect- ing said To~m in conflict with such amendments; NOW THEREFORE BE IT RESOLVED BY T~ T0~N COI~ISSi0N OF THE T0i~ OF BOYNTON, iN P~&L. rM BEACH COUNTY, ~0RIDA: That a special act to be entitled: "AN ACT TO AI\CEND SECTIONS 5, 8 AND 8 OF ARTICLE I; SECTION I of AETICI~ iII$ SECTIONS !, 2, 3 a~ud 5 OF ARTICLE IV$ ~ND SECTION I OF ~.RTiCLE V OF THE CHARTER OF THE T0%VN OF BOYNTON, IN PALM BF<~CH COUNTY, FLORIDA? That notice of intention to apply to the Legislature of the State of Florida at its ~93V session for the passage of the special act as set forth in Section l, hereof, be published in the Palm Beach Times, of '~est Palm Beach, Florida, one ti~_e as provided by the Constitution and Laws of the State of Florida, notwithstanding the fact th~at there shall be a referendum attach- ed to said special act. 3. That a copy of this Resolution s.hall be sent with said special act zo the Representatives from Palm Beach County, Florida, as well as the State Senator representing Palm Beach County, Florida urging them to pass said special act. That ~m. p. Somerville, a resident, citizen and tax- payers of the Town of Boynton, Florida, be and he hereby is appoint- ed a Deputy Town Clerk of the Town of Boynton, ~torida, for the purpose of typewritir~ said special act and taking same when com- pleted to Tallahassee, Florida, and presenting sa=~ to the Represen- tatives and State Senator, representing Palm Beach County, Florida, to introduce for passage by the Legislature 1937 session; and that Wm. Somerville, present, be paid $V5.00 immediately from the General Fund on account expenses in connection with his trip to Tailahassee with sm~endment to the Town Charter, which motion was seconded by Com~missioner Weems and duly carried.
