O74-17 ORDINANCE NO. 74- /7 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING CHAPTER 25 OF THE CODIFIED ORDINANCES OF SAID CI_T¥~ BY ADDING ADDITIONAL SECTIONS 25~15~ 25-16 aND 25 1~'~ pRovIDING FOR REQuIREFIENTs AND C6NTROLS , AS TO~ CONSTRUCTION AND RESTOI{ATION WITHIN SAID CiTY S RIGHTS-OF-WAY, INCLUDING PERMITS, APPLICATION FEES, AND OTHER 'REQuiREMENTS ~;' PROVIDING FOR AUTHORITY TO CODIFY', SAVINGS' CLAUSE, REPEALING PROVISIONS, AN EFFECT~'vE DATE AND FOR OTHER PURPOSES~ WHEREAS, the City Council of the City of Boynton Beach, Florida, deems it necessary and advisable for the promotion and protection of the health, safety and general welfare of the community to establish additional requirements and controls with regard to construction work and restoration thereof within the City's rights-of-way; NOW, THEREFORE, BE IT ORDAINEE BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That Chapter 25 of the Codified Ordinances of the City of Boynton Beach, Florida, be and is hereby amended by adding thereto additional sections which shall read as follows: "Section 25-15. Permitted construction, etc., within rights~of-way--Required. (a) No person shall begin to construct, reconstruct, repair, alter or grade in or upon any area of the City's rights-of-way without first obtaining a permit from the City Insuectoras provided in this Section. The permit shall entitle the applicant to work in a maximum of i~0'0 linear feet of the City's rights-of-way. A separate permit must be obtained for each additional L60D linear feet. On a continuous run complete restoration must be completed on the first permit before a third permit may be issued. At no time shall more than two permits be issued for one location. The permit shall be in the custody of the foreman or his designated representative at the work site. (b) A sign shall be displayed at the work site, indicating the name and telephone number of the contrac- tor and the name of the organization requesting the work. (c) Barricades used to safeguard job site and all traffic conurol techniques shall conform to the stand- ards set forth in the Department of Transportation's 1972 manual ~Traffic Controls and Safe Practices for Street and Highway Construction, Maintenance, and Utility Operations.' (d) When it zs necessary to cut pavement, the trench must be filled with suitable material in 12-inch lifts, each lift being compacted to 95% of maximum density. The last 12-inch lift shall consist of two 6 inch layers of compacted limerock or shell rock. "(e) At the end of each work day if the back fill has been completed the roadway shall be opened to traffic. Leaving unprotected ~base exposed to traffic will not be pe~tted, it must be co~ered with asphalt when it is open to traffic. In the event the final wearing surface cannot be scheduled, a tempomary asphalt surface, con- sisting of c01d mix may be used. tn the even~ that a temporary asphalt patch is placed, it must be repla~ed wit~ th~ final plavement within twent~7~(~d~s.~?B~6r~ ~he~ fina~ asphalt p~tch is placed, the ~aU~me~ ~g~s shall men~andlines to~ ~o~de~he new su~face.M~PrO~e~ Connecti6~ b~W~en ~h~~ old pave- (f) A~i pavement replacement ~o~ within rlghts- of~way shal~ be guaranteed by the e0~!ralctor for one year, and &ny ~ailur~ 6r ~ro~iemsde~el0ping due to the construction or reconstruction Of the pavement will be the responsibility of ~he contractor, ~6 be repaired by him as dire~ted- by the City Engineer at no cost to the City. (g) When working in parkways improved by adjacent property owners, the'ic~ntractor ~r c6~anv r~~ for work shall furnms~ written notification of the proposed construction to such adjacent property owner prior to construction. The restoration of the~parkway areas shall be at least equal to the condition of the parkway prior to the construction. The restoration shall be completed within.five (5.) working days from the time the area h~s been back filled. (h) Sidewalks, curbs, and driveways, if removed for construction, shall be replaced in'accordance with City standards, and no concrete shall be placed without prior inspect~ion of forms and excavation by the City Inspector. (i) Ail areas within six feet of pavement when back filled shall be compacted or stabilized to meet a minimum Florida Soil Bearing Value of 30 P.S.I. unless the original area did not meet such requirements. (j) Final restoration shall~include the removal of all construction rubble and dirt mounds from the area and the removal from the pavement of all dirt and dust caused by the construction." "Section 25-1~o Same--Application and Fe~s. (a) An applicant for the permit required under Section 25-1~ hereunder shall file with the City Engineer an application showing: (1) Name and address of the contractor performing the work. (2) Name and address of the person or company for whom the work is being performed. (3) Location of the work area. (b) The following fees shall accompany an appli- cation for a permit required under Section 25-15: "(1) The filing fee shall be Fi~e~DOllars ($'5..0Q} for each permit where con- struction does not require the street pavement to be cut. (2) The filing fee for a permit where con- st~uctioh will cut the street pavement shall be Twenty-Five Dollars ($25.00) for each cross pavement cut or portion thereof.'~ "Section 25-1~ Sa~e--Issua~ee. The City Inspector shall issue a permzt hereunder when ha finds that the application has been approved and signed by the City Engineer." S__ection 2. Authority hereby granted to codify and City's existing Code. to Codify: Specific authority is incorporate this Ordinance in the Section 3. Sep~rabilityL Each of the provisions of this Ordinance is separable, including word, clause, phrase or sentence, and if any portion thereof shall be declared invalid, the remaznmng portion shall not be affected but shall remain in full force and effect. Section of ordinances Section 4. Repealing Provision: Ail ordinances or parts in conflict herewith are hereby repealed. 5.
