R92-//~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE A HURRICANE DISASTER AGREEMENT BETWEEN THE CITY OF BOYNTON BEACH AND FLORIDA PUBLIC UTILITIES COMPANY/FLO-GAS CORPORATION TO PROVIDE EFFICIENT AND TIMELY RESPONSE TO ANY GAS RELATED EMERGENCIES RESULTING FROM A HURRICANE IN THE CITY; A COPY OF SAID AGREEMENT IS ATTACHED HERETO AS EXHIBIT "A"; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Boynton each has determined that it is in the best interest of the ~ity to enter into an agreement with Florida Public Utilities Company/Flo-Gas Corporation to provide efficient mnd timely response to any gas related emergencies resulting from a hurricane; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION THE CITY OF BoYNToN BEACH, FLORIDA THAT: Section 1o The City Commission of the City of 3oynton Beach hereby authorizes and direc%s the Mayor and ~ity Clerk to execute an agreement between the City of Boynton Beach and Florida Public Utilities Company/Flo-Gas Eorporation, to provide efficient and timely response to any ~as related emergencies resulting from a hurricane, a copy Df which Agreement is attached hereto as Exhibit "A". Section 2. This Resolution immediately upon passage. shall take effect PASSED AND ADOPTED this ~/ day of July, 1992. CITY OF BOYNTON BEACH, ~yor FLORIDA ~TTEST: Vice Mayor HU~ICANE DISASTER AGREEMENT THIS AGREEMENT entered into this 1992, by and between FLORIDA PUBLIC CORPORATION (hereinafter referred to and the CITY OF BOYNTON BEACH day of July , UTILITIES COMPANY/FLO-GAS as the "Gas Company~')w (hereinafter referred to as the "Municipality"). WHEREAS, the parties wish to establish'procedures in the event of a Hurricane Disaster to provide and timely emergency service to the public, It is agreed as follows: 1. This Agreement shall be effective whenever a Warning has been issued for Palm Beach County. 2. For the duration of the Hurricane Warning Municipality will provide Gas Company personnel at to be predetermined by the Location: Fire Stations 1. to be followed more adequate Hurricane housing for approximately following Fire Department Municipality, 2 and 3. the ten (10) locations personnel and 3. Gas Company personnel will arrive no earlier than six (6) hours prior to a Hurricane landfall and will be provided housing until adequate aftermath restoration allows their return to Gas Company facilities. The Gas Company will provide food, clothing and necessary supplies to their personnel, and will assign a supervisor to each Municipality who will be responsible for the direction of Gas Company personnel. 4. The Municipality agrees to provide adeguate outdoor parking for six (6) vehicles to Gas Company on Fire Department property. and hold officials and causes of action of of bodily injury, death, 5. Gas Company personnel will not be permitted to respond to emergency situations on equipment owned by the Municipality. 6. The Gas Company agrees to protect, defend, tndemn~fy harmless the Municipality and its respective officers, and employees, from and against all claims, demands every kind and character on account or damage to property arising out of the activities of Gas Company personnel acting under and pursuant to this Agreement. 7. This Agreement shall remain in effect until terminated in writing by either party delivered to the other by certified mail.
