A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA~
AUTHORIZING THE CITY A~TOR~Y TO EXECUTE
A STIPULATION CLARIFYING FINAL JUDGMENT
IN THE TRADEWINDS DEVELOPMENT CORP.
LAWSUIT ON BEHALF OF THE CITY AND FILE
THE SAME WITH THE COURT; A COPY OF SAID
STIPULATION IS ATTACHED HERETO AS
EXHIBIT "A"; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, Tradewinds Development Corp., and the City of
~oynton Beach entered, into a Stipulation of Settlement and
%greement for Entrance of Final Judgment on January 27,
[990; and
WHEREAS, a Final Judgment was entered in Palm Beach
iounty Circuit Court on January 7, 1990 incorporating the
~erms of the Stipulation; and
WHEREAS, the City Commission of the City of Boynton
~each has deemed it to be in the best interests of the
:itizens and residents of this City to authorize the City
~ttorney to execute the Stipulation Clarifying Final
Judgment on behalf of the city and to file the same with the

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
)F THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. The City Commission of the City of Boynton
~each, Florid~ hereby authorizes the City Attorney to
~xecute the Stipulation Clarifying Final Judgment attached
~ereto as Exhibit "A" on behalf of the City and to file the
~ame with the Court.
Section 2. This Resolution shall take effect immediately
lpon passage.

STIPULATION CLARIFYING FINAL JUDGMENT,
This Stipulation entered into between TRADEWINDS
CORP. and the CITY OF BOYNTON BEACH this .. day of

DEVELOPMENT
WHEREAS, the parties have heretofore entered into a
Stipulation of Settlement and Agreement for Entrance of Final
Judgment dated January 27, 1990; and
WHEREAS, a Final Judgment was entered in Palm Beach County
Circuit Court, Case No. CL-86-3661-AE on January 7, 1990,
incorporating the terms of the Stipulation; and
WHEREAS, the Stipulation and Final Judgment required the CITY
to "expedite" the processing of development applications submitted
to the CITY by TRADEWINDS without defining the term expedited; and
WHEREAS, the parties have reached an understanding and
agreement regarding a procedure for processing development
applications which would constitute an "expedited" procedure.
NOW, THEREFORE, the parties agree as follows:
1. The following procedure shall be implemented and followed
by both TRADEWINDS and the CITY in the filing and processing of all
requests for development approval:

P&Z meeting, if P&Z meeting will occur within two
(2) weeks. If P&Z meeting is not within two (2)
weeks, a special P&Z meeting will be called.
Following P&Z action, application placed on next
City Commission agenda.
In the event that public notice is required by City ordinance
or state law for public hearing, then in that event, the scheduling
of meetings under Step 7 and Step 8 shall be extended to meet the
notice requirements of law.
