19-027 1 ORDINANCE NO. 19 - 3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA AMENDING LAND DEVELOPMENT 5 REGULATIONS, CHAPTER 4, "SITE DEVELOPMENT STANDARDS" BY CREATING A NEW ARTICLE XII, ENTITLED "SUSTAINABLE DEVELOPMENT STANDARDS"; PROVIDING FOR PURPOSE AND • INTENT, APPLICABILITY, EXEMPTIONS, 11 SUSTAINABLE DEVELOPMENT OPTIONS AND 11 MAINTENANCE; PROVIDING FOR CONFLICTS, 1 SEVERABILITY, CODIFICATION AND AN EFFECTIVE 1 DATE. 1' 1 WHEREAS,the purpose for creating Sustainable Development Standards is to require 1 : new development and redevelopment projects to utilize a level of site and building design 1 options that conserve energy, promote a healthy sustainable landscape, support public health 1 and safety and increase the development's sustainability; and 1• WHEREAS, the standards ensure that developers implement '`green" practices above 21 and beyond the City's existing Code requirements yet allow them to choose which specific 21 practices they will implement to achieve the required number of points. 2• NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF 2 ' THE CITY OF BOYNTON BEACH, FLORIDA,THAT: 2' Section 1. Each Whereas clause set forth above is true and correct and incorporated 2' herein by this reference. 2: Section 2. That Chapter 4, Article XII, entitled "Sustainable Development 2 Standards"is hereby created by adding the words and figures in underlined type,and by deleting 2: the words and figures in struck-through type, as follows: 2• CHAPTER 4,ARTICLE XII. SUSTAINABLE DEVELOPMENT STANDARDS 31 Section 1.General 31 A. Purpose and Intent. 34 The purpose and intent of these standards is to promote sustainable development practices as a 3 ' means of addressing global climate change, protecting natural resources, and ensuring a high quality 3' life for existing and future residents. More specifically, it is intended to require new development 3' and redevelopment projects to utilize a level of site and building design options that conserve 3: energy, promote a healthy,sustainable landscape, support public health and safety, and otherwise 3 increase the development's overall sustainability. 3: S:\CA\Ordinances\LDR Changes\Sustainable Development Standards-Ordinance.Docx - 1 - 3• B. Applicability. 41 All applications for approval of a New Site Plan, Major Site Plan Modification,or Minor Site Plan 41 Modification (resulting in an increase, or replacement, of building square footage by 5,000 square 4• feet or more), involving multifamily and planned unit residential, nonresidential,and mixed use 4 ' development shall incorporate a sufficient number of sustainable design options from Table 3-1, 44 Sustainable Development Options and Points,to demonstrate achievement of the minimum number 4' of points required below: 4: 1. Multifamily residential development consisting of a minimum of 3 dwelling units and up 4 to 25 shall achieve at least 15 points. 4: 2. Multifamily residential development consisting of more than 25 dwelling units shall 4' achieve at least 20 points. 51 3. Mixed Use and Planned Unit residential development consisting of a minimum of 3 51 dwelling units and up to 20 shall achieve at least 15 points. 5• 4. Mixed Use and Planned Unit residential development consisting of a minimum of 21 5 ' dwelling units and up to 50 shall achieve at least 20 points. 54 5. Mixed Use and Planned Unit residential development consisting of more than 50 units 5' shall achieve at least 25 points. 5: 6. Nonresidential development of a size less than one(1) acre shall achieve at least 20 5 points. 5: 7. Nonresidential development of a size greater than one (1) acre shall achieve at least 25 5• points. 61 61 C. Exemptions. 6� 1. Interior renovations to existing buildings and structures; 6 ' 2. Construction of single-family or duplex dwelling unit on an individually platted lot within 6' single-family or two-family residential districts; and 6' 3. Buildings exempt from local building permits or governmental review pursuant to state 6: or federal statutes. 6 D. Sustainable Development Options. 6: Table 3-1, Sustainable Development Options and Points, sets forth a range of sustainable site and 6• building design features and the number of points achieved by incorporating each design feature (or 71 specified levels of the deign feature). 71 7. Section 2. Required Sustainable Development Standards(Table 2-1) 1. Required Sustainable Development Standards Outdoor Utilization of Warm White LED lighting for parking lots, pathway Lighting lighting,accent lighting and exterior building lighting.
